-Please note that anyone bidding at Travis Mitchell Auctions is expected to agree to the following terms and conditions of sale. If you do not understand any of these terms or conditions, please contact a staff member for clarification before registering.
-All lots to be sold AS IS, WHERE IS, WITH NO WARRANTIES EXPRESSED OR IMPLIED. ALL SALES FINAL.
-Payment must be made within 3 business days of winning auction.
-The accepted methods of payment are: Bank wire transfer, cash, cashier’s check, money order, Visa, Mastercard, or PayPal account.
-The highest bidder shall be the buyer at the hammer price and any dispute shall be settled at the Auctioneer's absolute discretion.
-The Auctioneer has the right at his absolute discretion to refuse any bid and to advance the bidding as he may decide.
-All equipment is sold FOB our dock in Garland, Texas unless otherwise stated in auction.
-A fee of $50 per pallet needed for items will be added to the final cost of auction.
-For a fee, we can pack, band, and palletize your item for customer pick-up.
-For customer pick-ups, an 8.25% Texas State Sales Tax will be added to the sale price.
-Resale Certificate & Tax Exemption forms must be on file at Travis Mitchell Auctions at the time of registration. Contact a staff member for more information.
-Buyer will pay actual shipping.
-The seller accepts no responsibility for the item after it leaves our dock. We are not responsible for damage incurred during shipping. Damage claims sustained during shipment are the sole responsibility of the buyer. (Please inspect items for damage before accepting from carrier and note any damage.)
-The property in a lot shall not pass to the buyer until the purchase price has been paid in full, but, the lot shall be at the buyer's risk in all respects from the fall of the hammer.
-All items not picked up within 10 business days from close of auction will be re-sold. Any monies paid related to these items will be forfeited by the buyer. Any returns and refunds are at the sole discretion of the seller. If merchandise return is accepted, a restocking fee of 20% may be accessed. Packing & shipping charges are not refunded in the case the seller accepts a return.
-Seller warrants to hold Auctioneer harmless from, and indemnify Auctioneer against, any claim, action, suit, cost, damage, deficiency, expense, loss, or liability or every kind, including attorney’s fees and costs of defense, asserted by any person, real or artificial, or by any entity of government, against Auctioneer in connection with the offering or sale of the property.
-Any dispute or controversy regarding this sale agreement will be heard in the venue of Dallas County, Texas and shall be decided by the laws of the State of Texas.
