FINE ART SALE OF UNSOLD LOTS LOWERED RESERVES

1. There is a 20% buyer’s premium added to the hammer price of every lot purchased online through ebayliveauctions.com and paid for by check, money order, or cash, which is to be paid by the purchaser of that lot. Lots purchased online through ebayliveauctions.com and paid for by credit card, are subject to a 22.5% buyer's premium.

2. All sales are subject to a Connecticut state sales tax of 6% unless the purchaser provides the auction house with a valid resale certificate exempting him from payment of the tax, or if the purchaser is from outside of Connecticut and has the purchase shipped to a location outside of the state.

3. All items are sold “as is” and “where is.” Trinity Fine Arts, LLC disclaims any express or implied warranties or guarantees as to the condition or authenticity of items sold. All representations made by Trinity Fine Arts, LLC (herein after referred to as TFA) are done to the best of our opinion, and should be considered statements of opinion and not relied upon as statements of fact. Photographic images of items being offered, whether provided in print or online, as well as references in the catalogue entry or condition report to damage or restoration are for guidance only. The absence of such a reference does not imply that an item is free from defect or restoration, nor does a reference to particular defects imply the absence of any others. Items being offered should be evaluated by personal inspection by the bidder or a knowledgeable representative, and the purchaser is fully responsible for determining authorship and condition of the work. Neither TFA nor its consignors are responsible in any way for errors and omissions in the catalogue, or any supplemental material. All sales are considered final with the following exception: TFA will agree to a refund of the purchase price if within fourteen (14) days of purchase, the purchaser obtains a written letter from a recognized expert or authority on the artist stating unequivocally that the work is a forgery or not by the represented artist. The choice of expert or authority must be mutually agreeable to TFA and the purchaser. This exception will only apply to a work signed by the artist and not to an attribution, manner of, school of, circle of or follower of a particular artist. The letter must be signed, and on letterhead of the recognized expert or authority. Any exceptions to this rule must be specifically approved by TFA.

4. All merchandise purchased must be paid for and removed within three days of the sale, unless arrangements are otherwise made. TFA reserves the right to charge a monthly fee of one percent (1%) per month of the amount of the purchase price for any lot not removed after three days.

5. TFA is under no obligation, but may agree, to package and ship an item at the request of the purchaser. The purchaser agrees that packaging, shipping and handling is the absolute risk of the purchaser. The purchaser will pay all costs including, but not limited to, the handling and insurance associated with shipping. TFA will be held harmless from any claim and any rights of subrogation from an insurance carrier are waived against TFA.

6. Some items in the auction may be reserved. TFA is under no obligation to disclose if an item may be reserved or not.

7. TFA retains the right to withdraw any item from sale before or during the auction.

8. In the event of a dispute, the auctioneer has the sole authority to determine the successful bidder or to re-auction the item in question. His discretion is absolute.

9. Payment may be in the form of cash, personal check, bank check, MasterCard, VISA. TFA has the right to hold merchandise if paid for by personal check until such time as the check has cleared.

10. We will use reasonable efforts to carry out written bids delivered to us prior to the sale for the convenience of clients who are not present at the auction in person, by an agent or by telephone. If we receive written bids on a particular lot for identical amounts, and at the auction these are the highest bids on the lot, it will be sold to the person whose written bid was received and accepted first. Execution of written bids is a free service undertaken subject to other commitments at the time of the sale and we do not accept liability for failing to execute a written bid or for errors and omissions in connection with it. With regards to telephone bids, if a prospective buyer makes arrangements with us prior to the sale we will use reasonable efforts to contact them to enable them to participate in the bidding by telephone but we do not accept liability for failure to do so or for errors and omissions in connection with telephone bidding. With regards to absentee or live bids placed online through ebayliveauctions, we do not accept liability for failure of these bids being placed or for human or technical error associated with the placing of online bids. Likewise, we do not accept liability for failure to accept online absentee or live bids, due to the ebayliveauctions system going down or being otherwise unavailable.

11. TFA reserves the right to change the terms of the sale by verbal agreement, and these changes shall constitute changes to the terms and conditions.
