Bidding on any item indicates the bidder's acceptance of the following terms and conditions. 1. Payment terms are Visa and Master Card. Pre-authorized checks may be accepted if the purchaser has been a purchaser from Mark Mattox Auctions in the past. 2. A buyer's premium of 13% will be added to the final bid price for each lot to determine the total purchase price. 3. All property is being sold as is. Inspection opportunities are available to those who wish to attend the scheduled preview for the auction. Preview: Sunday, Feb. 19 FROM 1 TO 5 P.M. E.S.T., with the preview to be held at the Mattox Auction Center located at 3740 Maysville Road, Carlisle, KY. Please review the additional photos of the individual lots to view any condition issues or deficiencies that may exist. 4. The Auctioneer reserves the right to withdraw any lot prior to being offered in the auction and shall have no liability whatsoever for withdrawal of the property. 5. The high bidder acknowledged by the auctioneer shall be the purchaser of that lot. The auctioneer is the sole determinant as to who is the successful bidder. Once an item is declared as "sold", the successful bidder assumes full risk and responsibility for the purchased lot. In the event of a disputed bid between an on-site and internet bidder, the auctioneer shall determine that the on-site bidder shall be the winning bidder. 6. Shipping: We are not in the shipping and packing business! Furniture and large items will not be shipped by the Auctioneer. Small items can be shipped at buyer's cost for shipping and insurance. Auctioneer will assist in shipment, but is in no way acting as a professional packer or shipper. See additional information below for shipping requirments. 7. State sales tax shall be the responsibility of the purchaser. 8. Your bid is a contract. Do not place a bid that you are unwilling, or unable, to honor. If you are declared as the winning bidder, you have entered into a legally binding contract to purchase the property offered. If you have questions about an individual item, please contact the auctioneer before bidding. 9. A live auction moves at an uncertain pace, so any ending time displayed will not be accurate. 10. A buyers premium will be added to the final price to determine total purchase price. 11. The system may incorrectly indicate that an internet bidder is the winning bidder. On-site bidding has priority over internet bidding in the event that similar bid amounts are entered simultaneously. In all instances, the auctioneer's declaration is the sole determinant of a winning bid. 12. Additional Terms from the BOSS!! The buyers premium on property purchased on Live Auctioneers will be in the amount of 13% of the final bid price. Live internet bidding is available as a courtesy during the auction. Mark Mattox Real Estate & Auctioneer, Inc. WILL NOT BE HELD RESPONSIBLE FOR LIVEINTERNET BIDS THAT ARE NOT SENT, RECEIVED, OR EXECUTED BY THE ADMINISTRATOR.

All items must be paid for within 5 business days of the auction. An invoice will be emailed to all winning bidders within 48 hours of the end of said auction. Shipping will not be included in the original invoice, it will be billed to the credit card provided after item is shipped, if we ship. A CREDIT CARD MUST BE PROVIDED FOR PACKING/SHIPPING CHARGES. The buyer is responsible for arranging shipping on all items, which we will deliver to the UPS store in Lexington, KY at a minimal charge. We will pack and ship only at the buyers request. Our packing fee is billed at $20/hour and the buyers pay cost of packing materials, with a minimum of $10/box and we will pack as many lots as is reasonable in a box. WE DO NOT CRATE/SHIP FURNITURE OR OVERSIZED OBJECTS. WE DO NOT PACK TO SHIP INTERNATIONALLY. Mark Mattox Real Estate & Auctioneer reserves the right to hold items paid by check until the check clears. There is a handling charge of $50.00 for returned checks. Also, we ship items out in a first-pay, first-ship basis. We strive to ship your purchases as soon as possible, but we cannot guarantee that your items will be shipped immediately upon receiving payment.

If purchases are not removed from the premises of Mark MattoxReal Estate & Auctioneer, Inc. within 2 weeks from the auction date, a storage fee of $10/day per item will be charged. Merchandise not removed within 30 days of the sale date is considered abandoned and will become the property of Mark Mattox Real Estate & Auctioneer, Inc.
