Bidder approval is at the sole discretion of Jeffrey S. Evans & Associates (JSE & Assoc).

If your registration is received after 5:00 PM ET the day before the auction, your status may still be pending while the sale is in progress. We will review all pending registrations as quickly as possible.

If you have limited or no history on Live Auctioneers (LA) or with JSE & Assoc., we may request references.

1. By bidding with JSE & Assoc. either directly or through another online auction provider (e.g. Live Auctioneers), you are agreeing to abide by all associated auction terms and conditions.

2. Your bid constitutes a legally binding contract. If you bid on a lot and win (even if the bid was placed accidentally), you are liable for payment.

3. The auctioneer reserves the right to reopen bidding on a sold lot (under extreme circumstances only) and is the sole determinant concerning all bid disputes and the final authority in regard to all auction terms and conditions.

4. Each lot won through LA is subject to a 20% buyer's premium.

5. All purchases are subject to a 5% Virginia state sales tax unless we have appropriate tax exemption documentation on file in our office.

6. VA state law requires that all dealers have a valid, signed VA Dept. of Taxation Sales & Use Tax Certificate of Exemption on file with us (form ST-10 or ST-14). This is required per auction for non-VA dealers. We must also have a current copy of the non-VA dealer's resale license on file.

7. Absentee bids placed in person at our gallery are accepted any time prior to the sale of the lot. THE DEADLINE FOR ALL OTHER ABSENTEE BIDS IS TWO HOURS PRIOR TO THE START OF THE AUCTION. Online absentee bidding is available through our website, www.jeffreysevans.com (visit our BUYING page for details).

8. Competing non-LA bidders include floor bidders (someone who is present at the sale), telephone bidders (someone who is bidding remotely by phone) and absentee bidders (someone who placed absentee bids directly with our auction house and not through LA).

9. The auctioneer reserves the right to make verbal corrections to the catalogue and provide additional information from the auction block at the time of sale. Absentee bids placed directly with the auction house will not be executed on lots found to be other than as described in the catalogue unless a member of our auction staff has personally conveyed the updated catalogue description to the absentee bidder. The auction house does NOT have access to absentee bids placed through LA.

10. Requests for additional information or images on catalogued lots will be accepted until 24 hours prior to the start of the auction.

11. INVOICING & SHIPPING SERVICE: WE WILL EMAIL INVOICES TO WINNING BIDDERS WITHIN 2 BUSINESS DAYS OF THE AUCTION (initial invoices are usually sent the Monday after an auction). WE PACK FOR SHIPPING ONLY UPON REQUEST FROM THE BUYER. We do not crate/ship furniture or oversized objects; however we can pack and ship most other items. Our packing fee is billed at $15/hour and buyer pays cost of packing materials when applicable. 12. Winning bidders must contact us by 5:00 PM ET on the Friday following an auction to confirm receipt of initial invoice and make arrangements for payment and shipping or pick up. Any lots won should be reflected in your LA account. **Contact by telephone should be made during our normal office hours.

13. METHODS OF PAYMENT: WE DO NOT ACCEPT PAYPAL. We accept cash, check, money order, VISA or MasterCard. If payment is made with an uncertified check, items may be held for up to 10 business days before we ship or release for pick up. Bank wire transfers are accepted; however, this method results in an additional fee for you. If you wish to wire funds, please email us for additional information. CREDIT CARD: A secure online credit card payment form is located at https://www.jeffreysevans.com/credit_card_order.php or you may call us during our normal office hours.

14. PAYMENT IS DUE WITHIN 5 DAYS OF THE DATE OF YOUR INVOICE. If your request for packing/shipping is made by 5:00 PM ET on the Friday following the auction, payment in full is due within 5 days of the date of your FINAL invoice (includes shipping charges). If your request for packing/shipping is made AFTER the Friday following the auction, you must pay your invoice total immediately so that we can settle all accounts; you may pay the shipping charges separately after packing is completed.

15. Accounts that are unpaid after 30 days of the sale date will be subject to a 2% monthly finance charge.

16. Each returned check is subject to a $50.00 service charge.

17. The buyer is liable for all fees/costs associated with the collection of balances due, including attorney's fees.

18. Unless pre-arranged with JSE & Assoc., merchandise not removed within 2 weeks of the sale date is subject to a storage fee; merchandise not removed within 60 days of the sale date is considered abandoned.

19. Refunds will be given at the sole discretion of the auctioneer and will only be considered on lots that are determined not to be authentic or have major damage or significant restorations/repairs that were not outlined in the condition report. Lots catalogued without circa dates are not guaranteed as to age. All rugs are sold strictly AS IS with no guarantee as to age or condition. No refunds will be considered on rugs.

20. Refunds in regard to condition for items purchased in person at the gallery must be requested before those items are removed from the gallery.

21. All refund requests must be received in our office within 25 days of the sale. Requests in regard to authenticity must also include at least one supporting written and signed statement from an authority recognized by the auctioneer. Note: Your timeliness and method of payment directly affect the time allowed for a refund transaction.

22. Returned items must be insured for the full value including buyers premium. We do not refund the cost of return shipping.

23. Absolutely no refunds will be made after 25 days of the sale date.

24. Do not return any item until a refund authorization has been obtained from JSE & Assoc. Once a refund is approved and the complete lot is returned to the satisfaction of the auctioneer, a full refund of the hammer price and buyer's premium will be issued. We do not offer partial refunds.

25. Additional conditions of sale apply as noted on our website and/or as announced by the auctioneer prior to the auction.

26. These terms and conditions, as well as the respective rights and obligations hereunder, shall be governed by and construed and enforced in accordance with the laws of the Commonwealth of Virginia. The purchaser shall be deemed to have consented to the jurisdiction of the state courts of, and the federal courts sitting in, the Commonwealth of Virginia.

CATALOGUE INFORMATION & OUR GUARANTEE

GLASS & LIGHTING

1. All catalogue descriptions are guaranteed to be accurate in the matter of authenticity, condition and measurements unless otherwise noted in the catalogue description. Measurements are guaranteed to be accurate to within one inch. Requests for more precise measurements must be received at least 24 hours prior to the start of the auction.

2. We are very meticulous in our description of the condition of each piece. Many of the minor flaws that we note are perfectly acceptable and do not detract from the item's desirability or value. We do not consider light wear, small manufacturing flaws, glass impurities or lightly tinted glass to be notable flaws.

3. If you are a bidder who demands flawlessness, it is recommended that you examine the item(s) in person, or have a trusted representative inspect the item(s) on your behalf.

4. Lamps are measured to the top of the collar and are without burners and chimneys unless otherwise noted.

ANTIQUES, AMERICANA & DECORATIVE ARTS

1. All catalogue descriptions are believed to be accurate in the matter of authenticity and condition, but ultimately all lots are sold AS IS. Antiques, by their very nature, will exhibit wear, minor losses and breaks, and small repairs commensurate with age. We only note condition issues that in our opinion significantly affect the integrity of the item. Returns will only be considered for items found to be fake/reproduction and/or have significant damage/restoration not noted in the catalogue description.

2. If you are a bidder who demands flawlessness, it is recommended that you examine the item(s) in person, or have a trusted representative inspect the item(s) on your behalf.

3. All measurements are approximate. Requests for more precise measurements must be received at least 24 hours prior to the start of the auction.

4. All rugs are sold strictly AS IS with no guarantee as to age or condition. No refunds will be considered on rugs.

5. Fine jewelry is guaranteed only regarding gold content and authenticity of diamonds. Authenticity of other stones and grades of any stones are not guaranteed.
