TERMS AND CONDITIONS OF SALE


1. All items are sold AS IS and all sales are final. It is the responsibility of the Bidder to examine all items in person or online prior to bidding to assess condition and value and decide level of interest in bidding on the items. Written or verbal descriptions of items shall not be deemed a warranty or representation regarding the items, and neither the Auctioneer, nor the consignors, nor the NSAA are responsible for the accuracy of any descriptions.

2. All items are framed and signed unless otherwise noted.

3. Questions about the Auction items or the Terms and Conditions of Sale must be addressed to NSAA
by email, to arts@nsarts.org, by 12 noon. on Saturday, August 11. NSAA will respond by email by 5:00 p.m. on Saturday, August 11, and Bidders are responsible for acting in accordance with the response. Please note that NSAA is unable to provide additional photos of the Auction items.

4. All times listed in these Terms represent Eastern Daylight Savings Time.

5. Absentee Bids are accepted as a convenience to Bidders, and must be delivered to NSAA by regular mail or in person by 5:00 pm on Saturday, August 11, along with complete contact and credit card information for billing purposes. Telephone Bids will be accepted only at the discretion of NSAA. Additional information and forms for Absentee Bids are available at www.nsarts.org. Neither the Auctioneer nor NSAA are responsible for any errors or omissions in connection with the execution of Absentee Bids.

6. Online Bids are accepted as a convenience to Bidders, through www.LiveAuctioneers.com. Bidders wishing to place Online Bids must register online at www.LiveAuctioneers.com and must provide complete contact and credit card information for billing purposes. Bidders are strongly advised to register by 5:00 pm on Saturday, August 11. Registrations after that time will be at the discretion of NSAA. Bidders must receive approval from NSAA prior to placing any Online Bids, and NSAA reserves the right to bar any Bidder.

7. Items in the Auction will be sold to the highest Bidder acknowledged by the Auctioneer. The Auctioneer has the sole right to settle disputed bids and determine successful Bidders, or to cancel the sale and re-offer the item. If a dispute arises after the sale, the record of sale kept by NSAA will be conclusive.

8. The Auctioneer reserves the right to reject an opening bid, or to withdraw any property before the sale.

9. Some items are offered subject to a reserve or confidential minimum selling price. Whether or not an item is subject to a reserve, the Auctioneer may reject any bid or raise not commensurate with the value of such item.

10. Items that fail to meet the reserve during bidding will be ?passed? but may be available for purchase after the close of the Auction by the first buyer who offers to meet the reserve.

11. Once items in Auction are deemed ?sold,? the buyer assumes complete responsibility for paying the full purchase price, within the time specified, and for protecting and securing the property.

12. There is no buyer?s premium on items sold in the Auction; however, Massachusetts sales tax will apply.

13. All items purchased in-person at the Auction must be paid for at the end of the Auction by cash, check or credit card, and all items must be removed, unless held at the discretion of NSAA until checks are cleared.

14. All items purchased Online or by Absentee Bid must be paid by credit card, and must be removed within seven days (by August 18). Payment will be charged to the credit card provided, unless alternative payment arrangements are made that are acceptable to NSAA.

15. Absentee and Online Bidders are responsible for shipping and handling arrangements and costs. NSAA will provide the names of local shippers with whom the buyer can deal directly.

16. All terms and conditions of sale are governed in accordance with the laws of the Commonwealth of Massachusetts.

17. Bidding on any items indicates your acceptance of these terms and conditions of sale.
