In pencil, not dated or signed by Jack Ruby, but signed in red ink in the middle of the first page by his brother, Earl Ruby," executor of Jack Ruby's estate. In preparation for a new trial, Jack Ruby explains why he always carried a gun. At the time, in Texas, there were only two degrees of murder. Murder with malice" carried the death sentence, but murder without malice" carried a maximum of five years in prison. The difference was determined by premeditation. If the murder had been planned in any way, it was committed with malice, but a murder committed because of spur-of-the-moment circumstances was committed without malice. The fact that Jack Ruby brought his gun into the Dallas Police Station was a key point in the prosecution's successful case.
