A). All property is sold AS IS / WHERE IS and all sales are final. While the Auctioneer will, to the best of their ability, to describe the items for sale, there are no warranties, expressed or implied, that the property offered for sale is what it is described to be by the Auctioneer or the catalog. The bidder is solely responsible for determining the age, size, condition and value of the property before bidding. Neither the Auctioneer nor the Consignor will be held responsible for any descriptions of the rarity, quality, condition, size, importance, or provenance of the property, and no statement, whether oral or written, by the Auctioneer or by any representative of Billy The Kid Auction House shall be deemed a warranty or representation regarding the property offered for sale. ALL SALES ARE FINAL / NO RETURNS.
B). The buyer's premium on property purchased will be in the amount of 20% of the final bid price.
C). The Auctioneer or auction Administrator, at their sole discretion, reserves the right to reject any opening bid, which they feel is unacceptable or too low. The Auctioneer or auction administrator also reserves the right to withdraw any property before the sale.
D). Billy The Kid Auction House WILL NOT BE HELD RESPONSIBLE FOR LIVE INTERNET BIDS THAT ARE NOT SENT, RECEIVED, OR EXECUTED BY THE ADMINISTRATOR.
E). The highest bidder acknowledged by the Auctioneer will be the purchaser. In the event of a dispute between bidders, or in the event that there are multiple bids for the same amount due to the sequence and timing of bids received from floor bidders, online bidders, absentee bidders, and/or phone bidders, or in the event of doubt on the Auctioneer's part as to the validity of any bid, the Auctioneer will have the final discretion to determine the successful bidder, or the choice to re-offer and sell the property in dispute. In the event of a tie between an online bidder and a floor bidder, THE FLOOR BID WILL TAKE PRECEDENCE. The Auctioneer's decision will be binding and final.
F). Once the Auctioneer announces the word 'SOLD', title to the property will immediately pass to the highest bidder acknowledged by the Auctioneer. Once title to the property has passed to the highest bidder, such bidder assumes all risks and responsibilities and will pay the full purchase price plus buyer's premium.
G). All Lots must be paid for within 72 hours of the auction. Billy The Kid Auction House will email an invoice to all winning bidders within 48 hours of the end of said auction. If payment is not made within the 3-day time frame, the bidder will be automatically charged what is owed on the 4th day with the Credit Card on File with our auction house.
H). All Bidders from the State of New Mexico are subject to the state 7% sales tax unless purchaser has sales tax exemption number.
I). All terms and conditions of sale are governed in accordance with the laws of the residing state.
J.) If payment is not made within the 3-day time frame, the bidder will be automatically charged what is owed on the 4th day with the Credit Card on file with Live Auctioneers and or auction house.
1. U.S Buyers: All Items shipped Domestically in the U.S will be Handled and Shipped by Billy The Kid Trading Co. Auctions through USPS for a flat $5.00 fee, for each item, the maximum amount we will charge Buyers for domestic shipping is 25.00$ anything above that will be combined and paid for by Billy The Kid Auction House
2. International Buyers: All Items will be shipped Internationally anywhere in the world for a $25.00 flat fee.
3. Combined Shipping: Combined shipping is available and will be used if the bidder wins more than one lot during the same auction.
A 20% buyers premium will be charged for all won auctions. The buyer's premium on property purchased on Live Auctioneers will be in the amount of 20% of the final bid price. (15% from Billy The Kid Auction House and 5%
from Live auctioneers)
New Mexico State Sales Tax
All Bidders from the State of New Mexico are subject to the state 7% sales tax unless lot winner has sales tax exemption number.
