The lots listed in this catalog will be offered by E Pearl Art subject to the following terms and conditions. By bidding at this auction, you agree to be bound by these Terms and Conditions of Sale. CORRECTNESS OF DESCRIPTION ? E Pearl Art has tried its best to catalog and describe correctly and accurately to the property to be sold. But E Pearl Art cannot warrant the correctness of description, attribution, authenticity, or condition of said property. No statements shall be deemed as such a warranty or representation or an assumption of liability, but are to be construed as our opinions only. It is bidder?s responsibility to personally examine the property to be sold prior to the auction and to bid based on your own judgment. All the items are sold AS-IS with all faults. All the sales are final with no exceptions. CONDITION OF PROPERTY - The property to be sold are often of considerable age (by being antique) and will exhibit wear, color fading (such as in textile), cracks (such as in ivory), and minor damages which may not be listed in descriptions and may not be considered as condition issue. The absence of any reference to the condition of a lot does not imply that the lot is in perfect condition or completely free from wear and tear, imperfections or the effects of aging. Bidders are encouraged to preview property to be sold prior to the auction. All items are sold AS-IS and without recourse, absolutely NO RETURN based on condition. COMMUNICATIONS - Pre-auction: All the questions and requests regarding to this sale must be communicated by email to epearl.art@gmail.com or in writing mail to us to avoid any confusion. No calls, please. After-auction: Any complain or dispute for an item purchased in this sale must be communicated with E Pearl Art within four weeks after the sale date (by December 18, 2017). Otherwise, case is closed. No exceptions. AUCTION HOUSE RIGHTS ? E Pearl Art reserves the right to withdraw any lot and reject any bid. RESERVE - Some lots are subject to a reserve which is the confidential minimum price below which such lot will not be sold. The reserve may not exceed the high estimate of the lot in most of cases. The auctioneer may continue to bid on behalf of the seller up to the reserve. ABSENTEE BID - This is an online auction only. However, auction house may accept absentee bids by email. E Pearl Art will not be responsible for errors or failure to execute bids. BUYERS PREMIUM - 25% of the hammer price will be added to final purchase price for all bidding. The buyer agrees to pay E-pearl Art buyer?s premium and 7% Missouri sales tax in addition to hammer price unless the items will be shipped out of State or with resale license. PAYMENT - Success bidder should pay for lots won within 10 business days from the date of the sale. We accept payment of cash, cashier's check, money order, and wire transfer. You can also pay through Liveauctioneers.com payment system. PACKING AND SHIPPING - Buyer is responsible for all packing and shipping cost. A list of local shippers will be provided in your invoice. NON PAYMENT - If we do not receive payment in full, in good cleared funds, within 10 business days following the sale, we are entitled in our absolute discretion to exercise one or more of the following measures: a) to impose a late charge of 2 percent (2%) per thirty (30) days of the total purchase price; b) to hold the defaulting buyer liable for legal fees and costs for us to collect the payment; c) to cancel the sale and resell the property publicly or privately without reserve, and with the purchaser liable for any deficiency, cost, and our commission on both sales. FAILURE TO COLLECT PURCHASES - A property must be picked up within 15 business days following the sale. E-pearl Art shall have no liability for any damage to property left on its premises for more than 14 business days following the sale. Property which is paid for but left on our premises for any over sixty (60) calendar days is subject to sale by us with the balance of any funds recovered in excess of storage charges and any other fees being remitted to you.
