Terms & Conditions
The following terms & conditions and important notices are designed to give you clear information about buying and selling at Luckner's. It is important that you read this information carefully as it is in accordance with English law and governs the way that Luckner's conducts its business.
1.
Terms & Conditions Concerning all Clients
1.1
The Auction Contract
Unless otherwise stated, Luckner's acts as agent for the seller. Thus the contract for the sale of a lot at Luckner's is between the seller and the buyer.
1.2
Age Restrictions
In order to conduct business with Luckner's you must be minimum 18 years of age, or present written permission to us from either a parent or legal guardian.
1.3
Photographs & Illustrations
The seller and the buyer gives Luckner's the complete and absolute right to photograph and illustrate all items that are consigned to them for sale on auction, whether on the Luckners website or any other publicly accessible written media or other media (with or without connection to an auction).
Clients are also reminded that colours in digital imagery may from time to time vary from real life. Whilst we make every effort to ensure an accurate illustration of all lots, Luckner's shall not be held responsible for any variations.
1.4
Luckner's Discretion
Luckner's has absolute discretion at any time to: divide or combine any two or more lots, withdraw any lot/ lots from the auction, cancel/ refuse bidding and annul the sale of an item at any given time without giving reason or any previous notice.
Reserve prices are not confidential and can be viewed by the general public on the Luckners website.
All client information (personal data and transactions) is treated with complete confidentiality. However exceptions include:
a. Posting the seller's name on the Luckners website for the reason of provenance, when given express permission by the seller.
b. Disputes.
c. Suspicion of breach of law or contract.
d. If required by law or otherwise.
1.5
Cataloguing
Whilst Luckner's makes every effort to ensure an accurate description and cataloguing of all lots:
1. Regardless of statements on condition made in the lot cataloguing or separate individual condition reports, all lots are sold "as seen".
2. Luckner's does not accept responsibility for date, age, period, authenticity, attribution, origin, authorship, quality or condition of any lot, unless informed in writing to do so buy the seller. In such an event Luckner's acts as the seller's agent and shall not be responsible for such claim.
3. All statements made about lots, whether on the Luckners website or made orally concerning the above-mentioned matters are of opinion only and are not to be interpreted as guarantees or representations of fact by Luckner's (unless informed in writing to do so buy the seller). In such an event Luckner's acts as the seller's agent and shall not be responsible for such claim.
4. All dimensions are approximate only.
1.6
Storage
All lots must be collected by clients no later than 12 days after an auction. Failure to collect lots within the 12 day limit will result in an initial £5 fee per lot and a £2 storage fee per lot per day thereafter.
1.7
Loss & Damage
Luckner's shall not be responsible for loss or damage on items consigned for auction, unless caused by the negligence of a member of its staff.
1.8
Third Party Liability
All persons on Luckner's premises at any time shall be deemed to be there at his/ her own risk and shall therefore have no claim against Luckner's, it's employees or agents in the event of an accident, injury, damage or loss howsoever caused, save insofar as the accident, injury, damage or loss is caused by the negligence of Luckner's.
2.
The Buyer
2.1
Inspection of Lots
By placing a bid on a lot, the buyer has acknowledged that he/ she has satisfied himself completely by physically inspecting the lot, the lot cataloguing and all the terms & conditions that apply for doing business with Luckner's.
2.2
Buyer's Premium
The standard buyer's premium is 22.5% on the hammer (but a minimum £5 premium per lot) inclusive of VAT.
2.3
Post-Auction Sales
Buyers are reminded that unsold lots might be re-offered on the Luckners website at the same or lower reserve for a minimum auction period of 24 hours.
2.4
Payment & Collection
All lots bought at Luckner's must be paid in full and collected within 7 days of winning an auction. Lots purchased at auction cannot be claimed or removed until full payment has taken place. Payment can be made by:
- bank transfer
- credit & debit card
- cheque
- cash
- banker's draft
Lots bought at auction can be either:
- collected in person by the buyer.
- sent to the buyer by insured postal service,if the item is small enough, and meets general postage requirements.
- be collected by a carrier/ shipping company, by presenting a copy of the buyer's receipt.
2.4A
Postage & Shipping
For items that require either postage or shipping, Luckner's charges a handling/ packing fee. Depending on the size of the item, packing fees vary from £5 to £15.
Items that are either small enough, or meet the general requirements of the British Royal Mail/ Parcel Force can be posted to the buyer, at the buyer's expence. If you are unsure if any item that you are interested in can indeed be posted, please contact Luckner's prior to the auction.
For larger/ more delicate items please see below for a detailed list of carriers/ transport companies. It is advisable to contact a shipping company with the measurements and approximate weight of the item you wish to purchase before bidding.

Packing and Shipping: The buyer is responsible for the shipment of all purchased Property. As a convenience to the buyer, Luckners maintains a database of names and contact details for a number of transport and shipping companies. These companies will pack and ship or arrange shipment for you via UPS, FedEx or other carrier, fully insured, for a fee payable in advance by credit card. Shipments are made within a few days after payment has been received. (If you have any shipping preference for any reason, please make sure your shipper carries insurance. We are not responsible for any damage or loss that occurs while your objects are in another's care. We will also not be responsible for any damage or loss that occurs if you choose a shipping method that we have advised against and we will require a waiver from you acknowledging this.) All international customs, duties, and other tariffs are the responsibility of the Buyer. The Auction House and the shippers will declare the selling price as the value in all cases
2.5
Non Payment
In the event of non-payment/ collection by the buyer, Luckner's have the discretion to exercise one or more of the following rights:
1. To charge the buyer non-payment and storage fees.
2. To cancel the buyer's client number and refuse any future bids or consignments from or on behalf of the buyer.
3. To sell any item belonging to the buyer that may be in our possession.
4. To hold the buyer liable for the total amount and to commence legal proceedings for recovery of the funds, including legal and other related fees.
5. To re-offer the lot for a new auction period.
2.6
Export License
It is the responsibility of the buyer to apply for any export license required to ship purchased lots out the United Kingdom. Examples include endangered species, such as ivory, tortoiseshell and whalebone.
Unless otherwise agreed in writing with Luckner's, the requirement for a buyer to apply for an export license post-auction does not affect nor obviate that buyer's obligation to pay in full for lots bought within the 12 days of auction ending.
2.7

All lots bought at Luckner's must be collected no later than 12 days after the auction. Failure to collect lots within the 12 day limit will result in an initial £5 fee per lot and a £2 storage fee per lot per day thereafter.

Insurance
Lots bought at auction are insured by Luckner's for a maximum period of 12 days after an auction. Lots that are not collected within the 12 day limit by the buyer do not fall under Luckner's insurance and are therefore the sole responsibility of the buyer.
2.9
Technical Faults
In the event of a server breakdown at Luckner's, or any other technical problem that might arise that renders it impossible for clients to either access and/ or bid on the Luckners website, all lots ending their auction period within 24 hours of the occurrence of the problem will have their auction period extended by 24 hours. Lots that have ended during the problem period will likewise be re-activated for a 24 hour period.
In the event of a technical problem arising, but not relating to Luckner's, (e.g. a problem with a client's computer or Internet service provider) auctions shall not be extended. If such problems should occur, clients are advised to contact Luckner's in order to place a commission/ telephone bid.
3.
The Seller
3.1
Valid Identification
For consignment of items to Luckner's, the seller is required to present a valid form of photographic identification. Acceptable forms of identification are passport and driving licence.
3.2
Seller's Obligations
By consigning any item/ items to Luckner's the seller confirms that:
1. He/ she is the rightful owner or has proper authorisation from the owner to sell the item.
2. Full ownership can pass to the buyer without any third party rights or claims, including copyright claims.
3. You have complied with all requirements, legal or otherwise, relating to any import or export of the lot and you have notified Luckner's in writing of any failure by third parties to comply with such requirements in the past of which you are aware.
4. All information supplied regarding the seller's identity and consigned items is true and accurate.
5. No information regarding the item's date, age, period, authenticity, attribution, origin, authorship and condition is withheld.
Withholding relevant information about origin, condition, originality etc. will result in the withdrawal of the lot in question and may lead to your permanent suspension from Luckner's.
3.3
Condition Reports
The seller gives Luckner's complete and absolute right to state the condition of all lots alongside their respective cataloguing texts on the Luckners website and in separate written condition reports if required to do so by the buyer.
3.4
Seller's Commission
Luckner's operates with a seller's commission of 10% on the hammer (but with a minimum £5 commission per sold lot) inclusive of VAT. Additionally every lot consigned for auction at Luckner's is subject to a £2 non-refundable cataloguing fee. Lots failing to sell at the reserve price are not subject to a seller's commission.
3.5
Withdrawal of Items/ Lots
After consignment of an item/ items has taken place, it can only be withdrawn by the seller by payment in full of the buyer's premium (22.5%) and seller's commission (10%) on the estimate of each item withdrawn.
When a lot has been activated for auction and is publicly displayed on the Luckners website it can only be withdrawn by Luckner's. This discretion will be used in the event of disputes, whether legal or otherwise and in any other case where any information about the withdrawn lot has come to light after the lot was activated for auction.
3.6
False Bidding
It is advised that sellers do not bid on their own lots. Sellers who buy their own lots must pay both the seller's commission and the buyer's premium in full for every lot purchased.
3.7
Post-Auction Sales
In the event of a lot not selling, Luckner's has absolute discretion to re-offer the lot for a 24-hour or longer period at any time without the consent of the seller.
3.8
Payment of Seller's Proceeds
The seller's proceeds will be paid between 15 and 30 days after the auction, providing that the buyer has paid the hammer price and buyer's premium in full. In the event that the buyer fails to honour his/ her obligation, the transaction is annulled and ownership falls back on the seller.
3.9
Collection & Storage Charge
All un-sold lots must be collected by the seller no later than 12 days after an auction. Failure to collect lots within the 12 day limit will result in an initial £5 fee per lot and a £2 storage fee per lot per day thereafter.

Insurance
Lots consigned for auction are insured by Luckner's for a maximum period of 12 days after an auction. Un-sold lots that are not collected by the seller within the 12 day limit are not insured and are therefore the sole responsibility of the seller.
