Any and all items that are either paid or unpaid which are not picked-up, not paid for storage, and/or paid to be shipped within 30 days of the auction will become property of the auction without refund.

By bidding at the auction whether present in person, by agent, written bid, telephone, internet and/or by other means, the buyer agrees to be bound by the conditions of sale as follows..

Neither the consignor nor Donny Malone Auctions can assure any warranties or representations with respect to any lot sold including but not limited to the correctness of the catalogue description, the physical condition, size, quality, rarity, attribution, authorship, importance, medium, provenance, exhibitions, literature or historical relevance, and no statement anywhere, whether oral or written, shall be deemed such a warranty or representation.
All sizes listed are approximate.
Prospective bidders should inspect the property before bidding to determine its condition, size, and whether or not it has been repaired or restored. The consignor and Donny Malone Auctions disclaim any and all warranties expressed or implied including but not limited to the implied warranty, merchantability, or fitness for any particular purpose. No warranties are made that any of the merchandise complies with any applicable governmental rules, regulations or guidelines of any kind or nature whatsoever. Neither Donny Malone Auctions as agent nor the consignor is responsible for any faults or defects in any lot nor to the correctness of any statement as to the authorship of any origin, authorship, date, age, attribution, genuineness, provenance or condition of any lot.
A buyer's premium of 25% on any amount bid will be added to the purchase of all lots in the sale.
This premium is payable by the purchaser as part of the total purchase price.
All bids placed and all payments made must be in U.S. Dollars drawn on a U.S.Bank unless payment in U.S. Dollars wired from a foreign bank has been pre-arranged. Internet bills may be paid via Paypal with Paypal funds or credit card.
All invoices which are not paid one week ( 7 days) after the sale will be canceled and an unpaid dispute will be sent. Buyers will be who are subject to unpaid invoices will be suspended/blocked for future auctions.
3. Shipping Information
We are offering an in-house shipping service to cut down costs, most items will be shipped within 3-5 days after the paid invoice through either UPS or USPS fully insured with tracking. Shipping invoices will be sent separately by the email, on file on the buyer?s invoice, as in the form of a paypal invoice. Invoices can be paid by paypal funds or by credit/debit cards including visa, discover, american express, and mastercard. Shipping invoices will be sent separately after invoices are paid
How are shipping invoices calculated:
Exact shipping price as quoted/calculated on the UPS website, plus a 4 dollar charge for a box ( oversized items above 28 inches will be put in a wardrobe box that cost 17 dollars, paintings above 1,000 dollars will be shipped in a heavy duty tv box that cost between 20-25 dollars), plus a 20% labor service.
If your item is too large for the U.S. Postal Service: The buyer is responsible for arranging pick-up or delivery of merchandise at buyer's risk and expense. All arrangements may be made through the buyer's own shipper. We cannot provide estimates, you must obtain your own by contacting your choice of shipper.
Merchandise that is not picked-up within 14 days preceding the sale, a storage fee of $30 U.S. Dollars will be charged to the buyer. Every sequential 30 days preceding that day an additional $30 U.S. Dollars will be charged.

4. Right to refuse service
As a private business Donny Malone Auctions reserves the right to refuse, deny, cancel , or terminate any/all sales without excuse or reason. Sales that are not completed will be refunded and then terminated.
Any and all items that are either paid or unpaid which are not picked-up, not paid for storage, and/or paid to be shipped within 30 days of the auction will become property of the auction without refund. Unpaid purchases will be canceled. Paid purchases will be cancelled without refund and items will become property of the auction. Unwillingness to pay storage fees will result in a termination of the buyer?s purchase(s) with no refund and items will become property of the auction. It is not the responsibility of the auction to retrieve the buyer?s merchandise that is purchased, paid or unpaid.
