Ted Maurer's Auction Terms and Conditions of Sale Ted Maurer Auctioneer 1. Sale of Goods: All goods are to be sold "as is", "where is" without privilege of return unless damaged in shipping. 2. Condition of Goods: Ted Maurer's Auction has endeavored to accurately describe all items being sold, with description and photographs. All descriptions are subject to errors and omissions and should only be used as a guide. Purchasers should take advantage of inspection opportunities to satisfy any questions they might have as to the condition, etc. of any item being offered. Photos listed with each item have been reviewed for accuracy, but are not guaranteed to be correct. Except as set out herein, there shall be no warranty or guarantees expressed or implied, statutory or otherwise of any nature. No sale shall be invalidated by any reason or defect or accuracy of description in the inventory or otherwise, and no liability shall be borne by any representative of Ted Maurer's Auctions by virtue of any such fault or error. All sales are final. We do not test toy trains to see if they are in working condition. Due to the sensitive and mechanical nature of toy trains, we do not guarantee them to be in running or working order. Estimates reflect what we feel to be fair market value of said item(s). Note that group lots should be expected to be in mixed condition. Grading and conditions are subjective and should be used only as a basic guide to aid in your bidding. Our grading is based on TCA-accepted guidelines. Title of Goods: Title to all merchandise shall pass to the successful bidder at the word said "SOLD" by the Auctioneer. All items remain the property of the seller until payment has been made in full. 4. Absentee Bidders: Ted Maurer's Auction will attempt to execute all internet absentee bids against attending bidders and attempt to purchase items at the lowest possible price up to the amount bid by the internet absentee bidder. (We reserve the right to use any and all absentee bids of $50.00 and less as opening bids. Bids over $50.00 will be bid competitively). Bidding Example: if an internet absentee bid of $1,000 is made on an item and the highest bid on the floor is $600, the auctioneer will execute the absentee bid at the next increment, (Example $50) in effect at that point in the auction and the lot will be sold to the absentee bidder for $650.00. If an item is discovered to vary significantly in condition from the catalog description, we will not execute the bid. Registration for our November 26 & 27, 2004, eBayLiveAuction auctions will close at 5:00 p.m. on Wednesday, November 24. No registrations will be accepted after that time. 5. Disputes: The highest bidder shall be the buyer. If any dispute arises between two or more bidders, the Auctioneer shall decide the buyer or immediately put the item up for sale again. 6. Payment terms: All purchases made through EbayLiveAuctions must be paid in full by credit card in US currency within 10 days of auction sale date. We accept Visa and MasterCard. A buyer’s premium of 17% will be applied to the purchase price of all items purchased through eBayLiveAuctions. We reserve the right to not issue a bidder number or to withhold merchandise if appropriate credit is not established. WE DO NOT OFFER CREDIT, other than the terms listed above. 7. Sales Tax: Some auctions are subject to 6% Pennsylvania Sales Tax. To qualify for exemption, you must have a photocopy of your reseller's tax exemption certificate on file with us. 8. Buyer's Premium: All items sold using our internet bidding process are subject to a 17% buyer's premium which will be added to the successful bid price and will be payable by the purchaser as part of the total purchase price. 9. Notification of Successful Internet Bids: The following information will be sent to you by E-Mail if your bids were successful. 1. Sale date: date of train auction in which you have submitted successful bids. 2. Lot# - same as catalog number. 3. Amount - Successful bid amount plus 17% buyer's premium and PA sales tax if applicable. 4. Remit to address. 10. Shipping and Handling: We use a third-party shipper to ship all items. Upon notification of payment received for items purchased, you may contact UPS at 610-718-0544 to provide credit card information for shipping terms & shipping payment. PLEASE NOTE: Due to the sensitive nature of lots 91 thru 127 (Lionel or Lionel/Porter Chemistry, Electronic, & Construction Sets) in the Friday, November 26, auction, these items CANNOT be shipped. If you are the successful bidder on any lot 91-127 in Friday’s auction, arrangements must be made for pick-up of these items. 11. Agreement to Terms: Bidding on any item indicates your understanding and full acceptance of these Terms & Conditions of Sale. If a purchaser breaches any of these Terms & Conditions, including the obligation to pay for purchased items, Ted Maurer's Auctions may and will seek all remedies under the law.
