Florida Auctions and Estate Sales 606 Savage Court, Longwood, Florida 32750 Budget Shopping LLC, dba Florida Auctions and Estate Sales herein known as Florida Auctions and Estate Sales, Terms of Service These Terms and Conditions defined by Florida Auctions and Estate Sales is an irrevocable contract between bidders, winning bidders and Florida Auctions and Estate Sales. Bidders accept and hereby comply to be compelled by all TERMS AND CONDITIONS established by Florida Auctions and Estate Sales upon participating in our auctions. All lots are sold "AS IS" without any recourse. Pictures and descriptions are not warranty, not a guarantee and no assurance. BUYER'S PREMIUM = 20% of HAMMER PRICE (AN ADDITIONAL FEE TO EACH WINNING ITEM) CANCELLATION OF WINNING ITEM = 20% OF HAMMER PRICE, STRICTLY NO TESTING OF BIDS ALLOWED. Auction house does not have the ability to remove bids. Florida Auctions and Estate Sales will not be responsible for any bid testing, internet failure, power outage or any interruption or technical errors occurred before, during and after the sale closed. +3% applied for all PayPal or credit card payments. PRIOR TO BIDDING: Online bidders must request and complete a credit card authorization form and a signed terms of auction form. A bidders pack can be sent through Adobe signature for those who cannot scan completed forms the send back by email. When sending completed and signed forms back to Florida Auctions and Estate Sales a valid driver license or government issued form of identification must be included. GENERAL INFORMATION: Bidder recognition: The auctioneer shall only accept bids from properly registered bidders who place bids by online bid. The auctioneer shall acknowledge the top bidder as the winner. In the event of a disputed bid, the auctioneer will have sole and exclusive authority to resolve the dispute and determine the winning bidder. The auctioneer has sole discretion and reserves the right to: 1 Reject or refuse to accept any bid or bidder that may be deemed inappropriate for any reason. 2 Pass/withdraw any items in the auction which do not open at a price commensurate with the items value. 3 Open bidding and bid up to, but not exceed the reserve on behalf of the seller. 4 Anyone 18 years of age or older and of good creditworthiness (as determined by Florida Auctions and Estate Sales), may bid at this auction, including the auction staff. 5 Bidding on behalf of others: Unless you are registered as a buyers agent prior to the start of the auction and we have written authorization from your buyer naming you as his/her appointed bidder, you are responsible for all the purchases under the terms and conditions of this bidding agreement. 6 Buyers Premium on all items purchased in this auction: The buyers premium is 20% for all internet bidders. 7 Reserves: Some items in this auction may be offered subject to a reserve, which is a confidential, minimum price, below which the item cannot be sold. 8 Any dispute or litigation resulting from the sale of items in this auction will take place in the judicial system in the State of Florida. TAXES: All winning bidders from the State of Florida, each winning item is subject to additional 7% FL TAX. Business bidders located in the State of Florida must provide a copy of a valid state-issued resale (tax) certificate prior to bidding (business type must pertain to the items being purchased), NO EXCEPTIONS! Billing: STRICTLY NO RETURN NO EXCHANGE AND NO CREDIT ALL SALES ARE FINAL. WE STRICTLY DO NOT ACCEPT RETURNS, NO EXCHANGE AND NO CREDIT. ALL ITEMS SOLD AS IT IS. IT IS THE BIDDERS' SOLE RESPONSIBILITY TO CHECK VERACITY OF ITEMS PRIOR TO BIDDING. IF IN SPECIAL CASES THAT WE WILL BE ACCEPTING RETURN, AUCTION HOUSE WILL BE DEDUCTING 40% RESTOCKING FEE. BOTH AUCTION PREMIUM AND SHIPPING FEES ARE NON REFUNDABLE. Note: For credit card payments, bidder agrees that no chargeback is to be filed against Florida Auctions and Estate Sales. Bidder waives his right to file claim, chargeback or dispute payment. Florida Auctions and Estate Sales select the bidders to join auction and not all bidders who want to join and participate gets lucky to get into our auction. Florida Auctions and Estate Sales only accept Paypal and wire transfers for payment however for bidders' insisting to pay with credit card (through Paypal), bidder waives their right to file chargeback and if so bidder agrees to pay additional $100.00 to settle chargeback. All dispute should be settled only between bidders and Florida Auctions and Estate Sales and not to a third party or credit card institution. To prevent dispute, it is the bidders' responsibility to check the item first before bidding and agreeing that all sales are final once the item has been sold. Successful online bidders are expected to pay in full for all purchases immediately following the auction. Buyers must pay the entire amount including the hammer price, buyers premium, all applicable taxes and other charges at auction end, shipping and handling charges will be billed separate, NO EXCEPTIONS! Successful online bidders will be notified of their purchases by email at close of the auction. Payment is due at closing of auction and invoice is emailed informing winning bidder of final winning bid and fees. Payment for packing and shipping is a separate charge covered under the Shipping section. All payments must be in US Dollars. We accept payments in cash, by personal, business, bank or cashiers check, Visa, MasterCard, Discover, American Express, PayPal and bank wire transfer. For domestic buyers, payments in excess of $5,000 must be made by wire transfer unless otherwise approved. For international buyers, payments by checks drawn on US banks or a wire transfer are the only acceptable methods of payment. No items will leave Florida Auctions and Estate Sales until payment is made in full. Florida Auctions and Estate Sales reserves the right to hold all merchandise until payments clear our bank. All returned checks will be assessed a $35.00 processing fee. In the event payment in full is not received within 15 days from the date of the auction, any outstanding amounts will be charged to the credit card on file. 1 If payment is not received 30 days from the sale, there will be a 3% surcharge added to the total invoice, and; 2 If no credit card is available or if payment has not been received within 30 days, Florida Auctions and Estate Sales will pursue alternate collection avenues in order to collect the balance due plus any storage, administrative, collection, attorney and/or court fees. 3 After 30 days from the day of the sale, storage fees will be charged at $50 per item, per month. 4 After 30 days, the warranty no longer applies. 5 If payment in full is not received 45 days from the sale, all ownership rights to any items on a bidders invoice are forfeited and the bidder will be responsible for any outstanding amounts including, but not limited to storage and collection fees. 6 Additionally, Florida Auctions and Estate Sales may report the buyers name to other auction houses and online platforms regarding creditworthiness and restrict the buyer from future bidding at Florida Auctions and Estate Sales and our associated online platforms. SHIPPING / PICK-UP / STORAGE FEES: Florida Auctions and Estate Sales will coordinate shipping. Your shipping invoice will include shipping and handling costs. Please contact Florida Auctions and Estate Sales with any questions. If either someone else other than the buyer, or a shipper other than one represented on the invoice, will be picking up your items, the buyer must inform us in advance so we may release the item(s). Items for shipment will not be released without prior requesting and returning a signed release form with either the shipping company name and details or if a personal representative a valid driver license or government issued form of identification. Personal representative must also present their valid driver license or government issued form of identification before item can be released. Shipments will be insured for the full purchase price unless other coverage is requested by the buyer. Any damage or delivery issues (regardless of any assistance offered by Florida Auctions and Estate Sales) are between the buyer and their chosen shipper. Florida Auctions and Estate Sales will not alter any catalog descriptions or declare less than the full purchase price on any international customs paperwork. All international customs documents and costs are the responsibility of the buyer. All items must be picked up from our auction facility within 30 days of the sale unless prior arrangements have been made. For items unclaimed after 30 days: 1 Items left at Florida Auctions and Estate Sales for more than 30 days will be subject to a storage fee of $50 per item, per month to be paid prior to collection of items. 2 Items left at Florida Auctions and Estate Sales over 45 days after the date of sale may, at the sole discretion of Florida Auctions and Estate Sales, be re-sold on buyers behalf. The above costs of storage, plus any other costs directly related to the items and an auctioneers commission of 30% will be subtracted from the proceeds. 3 Items unsold or unclaimed by 180 days from the date of this agreement will become the sole property of Florida Auctions and Estate Sales and may be sold or otherwise disposed of without reporting or liability of any sort to the buyer. 4 The inability to choose an acceptable shipping option is NOT a reason for non-payment of an items full purchase price. 5 Attention online bidders: Any items won during auction will not be available for pick-up until after first Wednesday after the auction. Please call ahead! 6 Anyone planning to pick up property from Florida Auctions and Estate Sales, should call 48 hours in advance to make arrangements. 7 Pickup day is on a Wednesday only 11 a.m to 3 p.m., NO EXCEPTIONS! Firearms: Background Checks and Final Sales Anyone that bids on firearms must be of legal age to do so. Highest bidders of firearms must be able to pass a federal background check and legally purchase firearms. All sales of firearms will not be considered final until the background check is successfully passed by the highest bidder. In the case that the background check comes back unapproved then the bidder will be refunded the hammer price of the firearm(s) but will forfeit the buyer's premium and any additional fees that were due in the processing of their unsuccessful transaction. The firearm will be kept by the auction company and sold to the back-up bidder or re-sold at a future auction. Bidder(s) that knowingly bid on firearms when they cannot pass a background check or legally possess a firearm risk being banned from any and all future auctions with our auction company. NOTE! Firearms will not be shipped direct to winner bidder, you will be required to pick up any firearms at a local Licensed Firearm Dealer in winner bidders State of residence, NO EXCEPTIONS! You will not be able to pick up the firearm from the Auction Company, firearms will be stored at a local firearms dealer in Auction Companies area. Extra: All property is sold "AS IS" "WHERE IS", and ALL SALES ARE FINAL. Property is open to thorough public inspection by appointment only on Wednesdays between the hours of 11:00 a.m and 3:00 p.m.. It is the Bidders responsibility to determine condition, age, genuineness, value or any other determining factor. Budget Shopping LLC may attempt to describe the merchandise in advertising, on the Internet, and at the auction but makes no representations. In no event shall Budget Shopping LLC or our representatives be held responsible for having made or implied any warranty of merchantability or fitness for a particular purpose. Bidder shall be the sole judge of value and authenticity. Bidders who bid from off site and are not present at the preview understand and acknowledge that they may not be able to inspect an item as well as if they examined it in person. It is the Bidders responsibility to determine condition, age, genuineness, value or any other determinative factor. Budget Shopping LLC shall endeavor to describe in detail each item and any pertinent information about it. Budget Shopping LLC will not be responsible for any errors or omissions in the description of the merchandise unless it is a material and intentional misrepresentation of the item itself. Bidder agrees that everything is sold as is and that they may not return any item they purchase. THERE ARE NO REFUNDS.
