Please carefully read and sign the Conditions of Sale to follow: We are not responcable for ANY shipping but we will cordinate and refer shippers with the buyer. We refer a packing and mailing company who the buyer is responable for paying directly, and upon virtulaliveauctions being paid we deleiver the items to the shipper and they will pack and ship all items. The property offered for sale by VIRTUALLIVEAUCTIONS (VLA) is an agent for the consignor(s) to purchasers is subject to the following terms and conditions: 1. The property is sold in “as is” condition and without recourse, and neither VLA nor the consignor makes any representations or warranties, express or implied, as to catalogue description, attribution, authenticity, provenance, origin, size, age or condition of any of the property offered for sale. The descriptions and any estimates of value attributed to any property simply represent our best guess based upon our experience and the information that may be available to us. It is the responsibility of the purchaser, prior to the auction, to examine the property by asking for more photos and condition reports and make a determination as to the value, condition, description, authenticity, provenance, origin, size and age of the property. 2. The highest bidder acknowledged by VLA shall be the purchaser. VLA reserves the right to reject any bid. VLA shall advance the bid at our discretion. VLA’s sole discretion may determine to re-offer any lot in dispute. In the event of any dispute, VLA’s record of the bids shall be accepted as conclusive. 3. VLA reserves the right in its sole discretion at any time before bidding commences to withdraw, combine or divide any lot. 4. At the close of any lot, title will pass to the highest bidder, and the bidder thereupon assumes full risk and responsibility for the property, including the obligation to pay the full price or such price as VLT may require. All bidders may be requested to give their name, residence, business address, telephone number, driver’s license and credit card. VLA shall have the right to reject any bid from anyone who has not established credit with us prior to the auction. 5. The purchase price paid by the buyer shall be the amount of the final bid plusTWENTY percent (20% buyer’s premium. Example, if the final bid is $500, the purchase price is $600 (shipping not incuded). All purchases are subject to state and local taxes where applicable, which are computed on the purchase price. 6. Property purchased from VLA by a successful bidder will not be shipped or leave our premises until the full purchase price (which includes the buyer’s premium) and all applicable sales taxes have been paid. The purchaser must pay for and have shipped all property from our premises within 15 day’s of auctions end. VLA shall be held harmless from any claim or liability relating to the care, custody or condition of any property remaining on premises after the 15 days for any reason. 7. If the purchaser fails to fulfill these conditions, in addition to all legal remedies available to VLA, VLA may cancel the sale and retain any payments made for costs and or damages; resell the property for the account of the buyer, in which case the buyer shall be liable to VLA for all its costs and damages, including the commissions for both auctions: All at the risk and expense of the buyer. 8. All property must be removed within the 15 day period. For example, if the auction takes place on Monday, all property must be removed within 15 days from then. After that time, if the property is not picked up or shipped within that manner, VLA will add a $50.00 handling charge to the purchase price. After 21 days, VLA reserves the right and will leave a non-paying bidder alert and or relist the property all at the expense of the purchaser. ACCEPTED & AGREED: Date.________________
