These "Conditions of Sale" are the complete and only understanding on which property in any PASEO AUCTION GROUP (herein called “the seller”) sale is sold. All property purchased from the seller is sold "AS IS" without any representations or warranties, express or implied, by Paseo Auction Group or its consignor(s) as to the merchantability, fitness for a particular purpose, or description of any property. BY BIDDING ON ANY ITEM YOU ARE ENTERING INTO A BINDING LEGAL CONTRACT. ANY ITEM THAT REMAINS UNPAID AFTER SEVEN (7) DAYS OF THE AUCTION WILL MAKE THE SALE OF SAID ITEM VOID. IF THIS IS AN INTERNET SALE WE WILL REPORT THE BUYER AS A NON PAYING BIDDER. 1A. Limited Return Clause: All items are researched to the best of “the seller’s” abilities and we have offer no guarantees of authenticity, as per point 1 above, nor will historically descriptive information contained in descriptions be taken as a guarantee of authenticity of the work If the item is materially different from its condition report, property may be returned, provided the written claim is received within 7 days of BUYER RECEIVING MERCHANDISE. “THE SELLER” must receive credible evidence within 15 days of buyer receiving the item/items, and the property must be received by “the seller” within 20 days of the auction close, in the same condition as when it was sent. Return shipping costs will be shared equally by the buyer and “the seller”. 2. BUYER PREMIUM, SHIPPING, SALES TAX: a 17% buyer’s premium fee will be added to the final bid price, and is payable by the buyer, together with packing and shipping costs if any, and Los Angeles County sales tax (8.25%), unless the property is shipped to a state other than California, or the property is purchased for resale under a proper State resale number, or other legal exemption. 3. PAYMENTS: Visa, Master Charge, American Express through PayPal, cash, bank or certified checks, wired funds, or personal checks drawn on a local bank, are acceptable forms of payment, and property may be immediately picked up or shipped by us. Personal checks drawn on non-local banks are acceptable; however, property may not be picked up or shipped until the 11th day following receipt of the check. At “seller’s” sole discretion, a sale may be nullified if payment is not received from the buyer within 10 days of the auction close. 4. RESERVES: this is a no reserve sale and the starting price is the minimum sale price that our consignors will accept for the merchandise . 5. MISCELLANEOUS: (a) all measurements and weights are approximate, (b) Seller has shipping capabilities of items within the UPS size limitations, and will ship purchases as requested-all costs paid by buyer (c) “the seller”, in its sole discretion, reserves the right to refuse a bid or withdraw property for any reason prior to the final auction close, (d) ) “the seller”, will decide any bidding disputes, (e) “the seller”, will not be responsible for computer breakdowns, viruses, interruptions, or programming errors, (f) if purchased property cannot be delivered by “the seller”, for any reason, the sale shall be deemed cancelled without any liability to “the seller”,. (g) Under no circumstance will “the seller”, liability will exceed the purchase price of an item. (h) legal matters will be governed under California law. 6. BUYER'S OBLIGATIONS: (a) Pay promptly in good US funds, (b) buyer pays all shipping, insurance and packing costs, (c) buyer must remove or cause property to be shipped from “the seller’s”, premises within 3 days of the auction close. Storage charges of $10.00 per item per day will be incurred by the buyer beyond the 3 day limit and must be paid before the property is released, (d) promptly advise “the seller’s”, of any problems. 7. SHIPPING INFORMATION: You will receive a general email approximately three days after the last day of the auction notifying you if you have won any lots and asking you to provide a mailing address and payment information. Also you will be four digit buyer number. It is essential that you provide a mailing address so that shipping quotes can be made. The quotes are estimates that may be adjusted. In all correspondence with “the seller’s”, use the four digit buyer number to identify yourself. Allow four to six weeks for the delivery of your packages. If you win an oversized lot that “the seller’s”, cannot ship, we can provide you the names of alternate shippers, at your request. All third party shipping charges and correspondence are the responsibility of the buyer. In this case, a prompt decision on which shipping company you wish to use for an oversized item must be made so that “the seller’s”, can receive the monies due for the lots before shipping will occur. INTERNATIONAL SHIPPING will be provided by UPS International service, under NO circumstances will international items be shipped via US Postal Service International mail. International buyers are responsible for all duties and taxes. Items cannot be refused by the buyer for duties and taxes due, and buyer will hold “the seller’s”, harmless for such.
