All items are sold "as is" and all sales are final. The auctioneer, consignor, or any affiliated parties to Old Port Auctions, LLC makes no representations or any warranties or of any manner in regard to the items, and in no event shall they be liable for the descriptions stated, the physical condition on any level including description, quality, size, medium, provenance, period, sources, origins, or any other statement provided. This includes all written and oral statements. It is the bidders responsibility to inspect the merchandise thoroughly before bidding at auction and to independently determine any components of the auction item. All sales are final & refunds will not be given. The auctioneer reserves the right to remove any items at auctioneers sole discretion before the sale without any liability for any reason. The auctioneer will be the final judge as to who is the successful bidder. In the event of any dispute the auctioneer shall at his discretion decide to reopen the bidding or not. Some of the lots in this sale are offered subject to a reserve. This reserve is a confidential minimum price agreed upon by the consignor & Old Port Auctions, at which is below such reserve, the lot will not be sold. Absentee bids if so authorized in writing are allowed. All absentee bids will be executed competitively during the sale. Items will be purchased for the lowest price possible regardless of the amount of the order bid. Where two absentee bidders bid the same amount the first received will be honored. Old Port Auctions, LLC will not be responsible for any liability or errors to properly execute the bids. On the fall of the auctioneers hammer, ownership to the offered lot will pass to the highest bidder acknowledged by the auctioneer, and as such the bidder assumes full risk and responsibility and will pay the full purchase price of the item(s). All items are subject to a 18% premium to Buyers that will be added to the successful bid price and shall be payable by the winning bidder as part of the total purchase price. Maine residents will pay applicable sales tax unless the purchaser possesses a sales tax exemption number.. In any event when a lot is subject to a reserve, the auctioneer may reject any bid not adequate to the value of the lot. Payment Terms: Cash, certain credit cards, Wire Transfer (Buyer's responsible for transfer fees), and the 18% Buyers Premium. First time buyers may be required to provide credit prior to auction to pay via check. Sales tax must be paid as applicable. Unless checks, cash, or money orders, any fees for credit cards or transfers must be the responsibility of the Buyer.
