Painting Sculpture Charity Irish Art Auction

THE FOLLOWING ARE SUGGESTED TERMS & CONDITIONS FOR THE ART AUCTION FOR THE BENEFIT OF THE NIALL MELLON TOWNSHIP TRUST, THE AUCTION BEING HELD IN THE OLD BANK HOUSE CAFE, KINSALE, ON FRIDAY 15th AUGUST 2008. 1 The Purchaser is deemed to have inspected the Work of Art and to have familiarised himself/herself with same prior to the Auction. The Work of Art is being sold as seen and no Warranties or Representations are being given in respect of same. Once a Purchaser has paid the purchase money no requests for refunds will be entertained. 2 The Purchaser agrees and accepts that no Statement, Account or description contained in any Auctioneer's Advertisement, Newspaper or any other Statement contained in any Brochure, Hand-out shall constitute or represent an inducement to the Purchaser to purchase the Art Work. The Purchaser accepts that any Statement, Description contained in any such particulars or in any format are for illustration purposes only and are not taken as matters of fact and that any mis-statement or mis-description or incorrect information given verbally or in the form of any printed particulars shall not give rise to any cause of action or claim for compensation against the Niall Mellon Township Trust. And furthermore shall not entitle the Purchaser to have any right of recision of the purchase. 3. Any Purchaser who wishes to bid may, if they so wish, register with the Auctioneer prior to the Auction and they will be furnished with a number. Said prospective Purchasers may then bid by Reference to their number and will not be obliged to disclose their name, when they are bidding. 4. The Niall Mellon Township Trust reserves the right to entertain telephone bids, e-mail bids and bids by other means of electronic format which potential Purchasers may use. 5 There shall be a reserved price for each Lot and the Auctioneer may refuse to accept any bid. If any dispute shall arise as to any bidding, the Auctioneer shall at his option either determine the dispute or again put up the Lot in question at the last undisputed bid. No person shall advance at bidding a sum less than that fixed by the Auctioneer, and no accepted bid shall be retracted. Subject to the reserve price being reached, the highest accepted bidder shall be the Purchaser of the Lot in question. 6 If the Lots have not reached there reserved price, the Niall Mellon Township Trust, may withdraw any one or more of such Lots at any time before the same has been sold without disclosing the reserved price in respect of each Lot. 7. The Vendor Warrants to the Purchaser that all purchased Lots shall be the Purchasers unencumbered property and that same shall not be subject to any Lease, or Chattel Mortgage. 8. All differences and disputes between the Vendor and the Purchaser shall be submitted to Arbitration by a Sole Arbitrator to be appointed (in the absence of Agreement between the Vendor and the Purchaser) upon such appointment and on the Application of either of them, by the President ( or other Officer endowed with the functions of such President) for the time being of the Law Society of Ireland and such Arbitration shall be governed by the Arbitration Acts l954- l998 provided howsoever that if the Arbitrator shall relinguish his appointment or die, or if it shall become apparent for any reason, that he shall be unable or unfit or unsuited ( whether because of bias or otherwise) to complete his duties or if he shall be removed from office by Court Order, a substituted Arbitrator may be appointed in his place and in relation to any such appointment the procedures hereinbefore set out, shall be deemed to apply as though the substitution were an appointment de novo which said procedures may be repeated as many times as may be necessary. 9. Purchasers who purchase Lots shall be required to pay for same on the night by means of either Bank Draft, Cash (In House Only), Guaranteed Cheque or Credit Card. 10. When the purchase monies are paid, the Lot is then the property of the Purchaser, who is responsible for same. If the Purchaser requires same to be delivered to his/her residence, same can be arranged at the Purchaser's expense, in respect of carriage and delivery. The carriage and delivery shall be at the risk of the Purchaser and the Niall Mellon Township Trust, will not be responsible for any damage which may occur to the Painting while in transit, or howsoever caused.
