Terms and Conditions of Sale Please contact Liveauctioneers if you have difficulties using the Liveauctioneers.com website or logging in. 1. This auction is conducted under the laws of the State of Maryland. 2. This is a live auction. 3. A buyer's premium of 20% will be added to the final hammer price of each lot purchased directly through Greenwich Luxury Auctions and a buyer's premium of 25% will be added to lots sold through any other third-party bidding platform, i.e. Invaluable, Liveauctioneers, BidSpirit, etc. 4. The Auctioneer reserves the right to reject any bid for any reason. In exceptional cases of clerking errors, third-party bidding platform errors, miscommunication, or other errors beyond the direct control of the auctioneer, the auctioneer reserves the right to withdraw the lot after the hammer has fallen but only before any payment has been accepted. 5. The Auctioneer reserves the right to withdraw any lot for any reason at any time. 6. In the event of duplicate high bids, the earliest bid received will be the winner. 7. Some lots may carry a reserve beneath which the item will not be sold. Any reserve will always be at or below the low estimate. Reserves and maximum bids will not be disclosed. 8. Descriptions regarding condition are for guidance only and do not constitute a representation or warranty by Greenwich Luxury Auctions. 9. A bidder, whether acting in his own interest or as an agent, warrants that he is not subject to trade sanctions, embargoes or any other restriction on trade in the jurisdiction in which he does business as well as under the laws of the United States, and is not owned in any part or controlled by such sanctioned person(s), and the funds used for purchase and settlement of the lot(s) are not connected with nor have any link to nor are derived from any criminal activity, including without limitation to any criminal activity. The bidder also warrants the he is neither under investigation, nor has been charged with or convicted of tax evasion, money laundering, terrorist activities or other felonious criminal activity. (b) Bidder further warrant that the lot(s) purchased will not be used for purposes of, or be used in any way connected with, or to facilitate breaches of any applicable tax, anti-money laundering or anti-terrorism laws or regulations. (c) Bidders acting as agents must conduct appropriate customer due diligence on the purchasers they represent in accordance with all applicable anti-money laundering and sanctions laws and regulations, tax evasion, and that the ultimate buyer(s) is not under investigation, or has not been charged with or convicted of money laundering, terrorist activities or other felonious criminal activity; (d) Greenwich Luxury Auctions reserves the right to seek identification of the source of funds received, and to make enquiries about any person transacting with it. Refusal to provide such information will be deemed just cause for recission of sale, in auctioneer?s sole option. 10. If a ?trademark? goods item is shown to be ?counterfeit?, subject to the terms below, Greenwich Luxury Auctions will set aside the sale and refund to the buyer the total amount paid by the buyer for the item. ?Counterfeit? shall be deemed as a lot which in the auctioneer?s reasonable opinion is an imitation or forgery created with the intention to deceive. This definition shall apply solely to trademarked items. This guarantee does not apply if the catalogue description was in accordance with the generally accepted opinion(s) of expert(s) at the date of the sale, or the catalogue description indicated that there was a conflict of such opinions; or the process or method of determining the item was counterfeit did not exist at the time of sale. This guarantee does NOT apply to any damage, color change, repair, modification, improvement, alteration, or any other change made to an otherwise original, authentic item. This guarantee is provided for a period of fifteen (15) days from the date of receipt of the item by the purchaser and is not transferable. Those choosing to make a claim must notify Greenwich Luxury Auctions in writing within the 15 day guaranty period, specifying the lot number, date of the auction at which it was purchased and the reasons why it is thought to be counterfeit, and then return the item to Greenwich Luxury Auctions in the same condition as at the date of sale, free from any third party claims arising after the date of the sale. Greenwich Luxury Auctions may require the purchaser to obtain at his cost reports from two independent and recognized experts in the field, mutually acceptable to the auctioneer and purchaser. Greenwich Luxury Auctions shall not be bound by any reports produced by the buyer, and reserves the right to seek additional expert advice at its own expense. In the event Greenwich Luxury Auctions decides to rescind the sale under this guarantee, it may refund to the purchaser the reasonable costs of up to two mutually approved independent expert evaluations. 11. If Greenwich Luxury Auction sells any gemstone or pearls which the buyer subsequently shows to reasonable satisfaction not to be genuine or of natural origin, Greenwich Luxury Auctions will set aside the sale and refund to the buyer the total amount paid for the item. This guarantee is provided for a period of fifteen (15) days from the date of receipt of the item by the purchaser and is not transferable. Illustrations of lots in this catalog and our website may have had size, color, brightness and contrast modifications for display purposes only. Any defects or damage to any items have NOT been altered or corrected in images in any way. ADDITIONAL IMAGES OF EVERY LOT MAY BE AVAILABLE UPON REASONABLE NOTICE. MOST LOTS MAY ALSO BE AVAILABLE FOR IN-PERSON VIEWING, BY ADVANCE NOTICE. Estimated selling prices are for your guidance only. Actual selling prices may be higher or lower than the estimate indicated. 15. The placing of a bid legally binds the bidder to purchase the lot at or below the bid placed, plus buyer's premium (see item 3). Bids may not be retracted without our approval: those doing so will be banned from future participation and will be reported to the trade. Please think before you bid! You are legally bound once you do so. 16. Absentee Bidding. All bidding is undertaken in a competitive manner. The winning bid will always be one bidding increment over the second highest bid. The minimum acceptable bid for any lot is one-half of the low estimate given in the item description. Bidders may call us at 203-276-1570 during office hours, Monday through Friday 10 A.M. - 5:30 P.M. EST. Live bidding: Bids entered during the course of the sale by bidders on the floor, on the phone, or live on the internet will be taken at the amount bid. 17. Payment is expected immediately upon, (but not before) receipt of invoice. We accept cash, business and personal checks, cashier's checks, money orders, and bank transfers. All accounts are payable to Greenwich Luxury Auctions. Payment must be made in U.S. funds. Wire transfer details are available upon request. Please note that lots purchased are subject to sales taxes where applicable unless a resale number is filed with us prior to the auction. Invoices not paid within thirty days of the date of invoice will incur a 1.5% per month late payment fee. 18. Taxes: Sales tax of 6% will be charged for all Maryland residents, unless a resale certificate is submitted to us prior to any payment. We are not responsible for import duty, taxes or any other fees charged by authorities of foreign countries. 19. Shipping Terms: Shipping, handling and insurance charges will be added to all invoices. Shipments are sent via FEDEX. Shipments will only be sent to the registered bidder address; re-routing shipments is not permitted. All shipments require an adult direct signature, no exceptions. As required by law the full value will declared as is required by law and customs for international shipments. Customers who supply their own courier account number will still be charged a handling fee. Please allow 2-3 weeks for shipments after receipt of payment due to the high volume of packages being shipped. Shipping to certain countries is extremely expensive and will be invoiced according to dimensional weight. Please inquire before bidding! 20. Any property made of or incorporating endangered or protected species may have import and export restrictions established by the Convention on International Trade in Endangered Species of Wild Fauna and Flora (CITES). These items may have international and/or domestic shipping restrictions. By placing a bid the bidder acknowledges that he is aware of these restrictions and accepts full responsibility in obtaining any license(s) or permit(s) required for delivery of the product. Greenwich Luxury Auctions does not accept liability for purchaser's failure to exercise due diligence in researching lots and obtaining necessary documentation. Some items may be described as being sold with a "CITES CERTIFICATE". It is the buyer's responsibility to ascertain whether such certification is sufficient for lawful shipping from Auctioneer to buyer or his agent. 21. Descriptions may indicate that certain purse and non-jewelry fittings are ?gold? or ?silver?. These terms refer to the metal color of the hardware, rather than implying that the actual composition of the fittings is that of a precious metal. Unless there is specific mention as to carat weight or precious metal weight of these fittings, all descriptions incorporating the terms "gold" or "silver" are descriptive of color of the hardware only. 22. Greenwich Luxury Auctions will in no way be responsible for any pre-existing hidden damage or defect, nor defect inherent in the material of the object(s) sold. 23. Property purchased and paid for by successful bidders but remaining unclaimed after 120 days will be deemed abandoned and title will be ceded to Greenwich Luxury Auctions LLC. 24. The placing of a bid shall constitute acceptance of the preceding terms and conditions of sale as well as the Bidding Procedure guidelines posted online and in this catalog.
