Prospective Bidders. All prospective bidders must register online or complete and sign a registration form and provide identification before bidding. Basel Auction House Corp. reserves the right, in its sole discretion, to refuse admission to the premises or participation in any auction and to reject any bid registration before bidding. We may require bank or other financial references. Any bidder making a bid accepts personal liability to pay the purchase price including buyer?s premium and applicable taxes except as otherwise agreed to in writing by the parties prior to the auction. LOTS. All lots are sold ?AS IS? and without recourse and neither Basel Auction House Corp. nor its consignor(s) makes any warranties or representations, expressed or implied, with respect to: merchantability, fitness for purpose, correctness of the catalogue, description of the physical condition, size, quality, rarity, importance, medium, material, genuineness, attribution, provenance, period, culture, source, or origin. Buyers are advised to personally examine the lots they are interested in prior to the auction. Condition reports are provided for each catalog lot in the lot description. Some lots in the auction are subject to a reserve or a confidential minimum sale price requested by the seller. Notwithstanding the preceding condition, if within 14 days of the sale of any lot the purchaser of any lot gives notice in writing to the Auctioneer that the lot sold is a counterfeit and, if within 7 days, after such notice the purchaser returns to the Auctioneer, in the same condition as when sold, and gives written proof from a recognized impartial expert, which establishes beyond reasonable doubt, that the returned lot is in fact a counterfeit and that this was not indicated by a fair reading of the catalog or the Auctioneer's comments at the time of sale, the Auctioneer, as agent for the Consignor, will rescind the sale and refund the purchase price. Absentee Bids and Phone Bids. Absentee Bids and Phone Bids must register with Basel Auction House at least 48 hours before the day of the auction. We will make all reasonable efforts to execute absentee bids and phone bids. We will accept no liability for the failure to execute the bid or for any errors or omissions in connection with absentee bids. The auctioneer has the right, at his or her absolute and sole discretion, to refuse any bid, to advance the bidding in such a manner as he or she may decide, to withdraw any lot, and in the case of error or dispute, and whether during or after the sale, cancel the sale or re-offer the item in dispute. In the event of a dispute after the sale, the auctioneer record is conclusive and binding on all parties. The Winning Bid. The winning bid is the highest bid acknowledged by the auctioneer. In the event of a tie bid, the winning bid will be determined by the auctioneer in his sole discretion. Title passes upon auctioneer?s acknowledgment of the winning bidder (subject to the Terms and Conditions as set for the herein) and the winning bidder assumes full risk and responsibility thereafter. Buyer's Premium. Buyer?s premium is 21 % (twenty-one). In addition to the hammer price, the buyer agrees to pay Basel Auction House a buyer's premium and the applicable sales tax added to the final total. Third-Party Platform Fee. If the buyer bids through a third-party platform, the buyer agrees to pay a surcharge (the third-party platform fee) in addition to the buyer?s premium for a final buyer?s premium of 26% (twenty-six). Payment. Buyer must pay in full (including hammer price, buyer?s premium, third party platform fee, applicable taxes and shipping) within three (3) business days following the auction sale. Payment in U.S. dollars only. Payment in cash, personal check, money order, cashier?s check, wire transfer or credit card is accepted if the purchases is under $1,200 (twelve hundred). Basel Auction House Corp. reserves the right to hold merchandise for up to 14 business days for items paid by personal/corporate check. Buyer agrees to pay Basel Auction House Corp. a handling fee of $45.00 for any check dishonored by buyer?s bank. Works of art listed as ?Attributed to? an artist are offered without proof of authenticity and are offered without warranty as to authenticity. All measurements are approximate. The absence of any statement as to condition does not imply the lot is in good condition or otherwise free of wear, defect or effects of ageing. Packing and Shipping. Packing and shipping is the responsibility of the buyer. At your request, we can provide you with a list of available shippers. We will not be responsible for the acts or omissions of carriers or packers whether or not recommended by us. Property will not be released to the shipper without the buyer's written consent and until payment has been made in full. Packing and handling of purchased lots by us is at the entire risk of the purchaser. Basel Auction House Corp will have no liability for any loss or damage to such items. Purchased Lots. If for any reason, a purchased lot is lost or stolen prior to being picked up by buyer, or shipped to buyer, Basel Auction House Corp. shall not be liable for any amount in excess of that paid by the purchaser. Non-Payment. If we do not receive full payment in good cleared funds within seven (7) business days following the sale, we are entitled, in our absolute discretion, to the following remedies, in addition to any action available by law, to impose a late fee of three percent (3%) per thirty days of the total invoice amount, cancel the sale, bar the bidder from bidding at future auctions, hold the defaulting buyer liable for the total amount due and to begin legal proceedings for its recovery, together with interest, legal fees and costs to the fullest extent permitted under applicable law. If property is not picked up within seven (7) business days following the sale and payment, Basel auction House reserves the right to charge $10 per lot per day. Basel auction House shall have no liability for any damage to property left on its premises. Liability. Basel Auction House Corp. acts only as an agent for the consignor and in no event shall the seller, Basel Auction House or our staff be liable for any representation, warranty or guarantee or assume any liability of any kind for the lots with regard to merchantability, description, size, quality, condition, attribution, completeness, authorship, authenticity, rarity, provenance, breach or default by the consignor or any representation made by consignor to Basel Auction House. The Terms and Conditions herein may not be changed or modified unless Basel Auction House and the buyer have agreed to in writing and signed by both parties. The rights and obligations of the parties with respect to the Conditions of Sale, the conduct of the auction and any matters connected with any of the foregoing, shall be governed and interpreted by the laws and jurisdiction of Florida. If any part of the Conditions of Sale is found by any court to be invalid, illegal or unenforceable, that part shall be discounted, and the rest of the conditions shall continue to be valid to the fullest extent permitted by law. By registering to bid and/or bidding you agree and are fully bound by the Terms and Conditions set forth herein.
