Terms & Conditions
Conditions of Sale These Conditions of Sale contain all of the terms on which IslandAucitonAssist and the seller of each respective lot contract with the buyer. They may be amended only in writing by IslandAuctionAssist prior to the sale. By bidding at auction you agree to be bound by these terms. 1. PRIOR TO THE AUCTION All items sold by IslandAuctionAssist are sold "as is," without representation or warranty of any kind by IslandAuctionAssist or the consignor. Buyers should ask any and all questions regarding lots they intend to bid on. Only in cases where the item has been grossly misrepresented by IslandAuctionAssist, and proof can be provided by the buyer, would any return be considered or authorized. For purposes of auctions offered by IslandAuctionAssist, all sales shall be considered final, and no returns will be accepted. (a) Examination of lots Bidders are responsible for requesting information on an item’s condition before placing any bids. Since antique items often show normal signs of wear and use, if there is wear on a particular item, it may not be specifically noted in a condition report or in the listing, though usually sufficient photographs are taken and provided in the listing that an item’s condition can be accurately assessed. Bidders who have very particular or discerning taste may wish to inspect items in person. Items shall be available for inspection at their respective locations, at the consignor’s discretion and convenience. (b) Item Condition We strive to answer all questions regarding condition in a timely fashion. Additional photographs shall be provided only when the value of a piece shall warrant additional photographs. For lower value items, additional photographs will not be taken, as such additional cost and time is not justified by the item’s value. (c) Catalogue and other descriptions All statements in each listing are opinion, and such statements shall not be implied as a warranty, representation, or assumption of liability. (d) Reserves Most of the lost offered for sale by IslandAuctionAssist are offered with a reserve price, which shall not exceed the lower price estimate in the listing. The reserve price is the minimum price below which the lot will not be sold. 2. DURING THE SALE Any items being sold without a reserve shall have a bidding start price of 50% of the low estimate. Absentee bids received which are higher than 50% of the low estimate shall cause the bidding to start at the lower absentee bid. (a) Absentee bids IslandAuctionAssist requires that all absentee bids be submitted no later than 11:00 pm on the business day prior to the auction. In the event of competing absentee bids, the winning bid shall be one bidding increment above where the competing bids end. When sending absentee bids via fax or email, please call to confirm receipt. The following are the bidding increments for all items offered by IslandAuctionAssist: $10 for bids between 0 and 100 $25 for bids between 101 and 499 $50 for bids between 500 and 999 $100 for bids between 1000 and 2999 $250 for bids between 3000 and 4999 $500 for bids between 5000 and 9,999 $1000 for bids between 10,000 and 19,999 $2500 for bids between 20,000 and 29,999 $5,000 for bids between 30,000 and 49,999 $10,000 for bids between 50,000 and 99,999 $15,000 for bids over 100,000 Please adhere to these bidding increments. Any bidder placing a bid between two of the bidding increments shall have their bid automatically advanced to the next higher bidding increment. (c) Auctioneer's discretion The auctioneer has the right at his absolute and sole discretion to refuse any bid, to advance the bidding in such a manner as he may decide, to withdraw or divide any lot, to combine any two or more lots and, in the case of error or dispute, and whether during or after the sale, to determine the successful bidder, to continue the bidding, to cancel the sale or to re-offer and resell the item in dispute. If any dispute arises after the sale, the sale record of IslandAuctionAssist is final. (d) Successful bid and passing of risk The highest bidder accepted by the auctioneer will be the buyer, and the striking of the auctioneer’s hammer marks the acceptance of the highest bid and the conclusion of a contract for sale between the seller and the buyer. At the fall of the auctioneer’s hammer, all risk and responsibility for the item won passes to the buyer, including the responsibility for pick-up or shipping of said item, taxes, and export duties, if applicable. At the time of the striking of the auctioneer’s hammer, full resposibility for payment of the purchase price and all applicable taxes passes to the buyer. IslandAuctionAssist does not charge a buyer’s premium on lots sold. 3. AFTER THE SALE (a) Sales Results: Sales results shall be available two days following the auction. Invoices will be sent via email to the winning bidder. Any bidder whose bid was the high bid for any particular auction, where such bid was lower than the lower price estimate may, at the sole discretion of IslandAuctionAssist and its consignors, be contacted after the auction has ended to re-offer the item to that bidder for purchase. If the bidder accepts the offer for sale, the sale shall be considered, with respect to these terms and conditions, identical to all sales where the auctioneer has struck his hammer and declared a winning bidder. (B) Sales Tax: All New York State and City residents shall be required to pay New York State sales tax, and New York City sales tax, where applicable.
