TERMS AND CONDITIONS OF SALE: All bidders are responsible for reading, understanding and agreeing to these Terms and Conditions of Sale, as well as any supplemental notices provided either in writing or verbally prior to the start of the auction. Bidders are required to provide valid and current contact information with their registration. Failure to do so may result in significant delays in processing payment and shipping of lots won. AUCTION INFORMATION: Lots in this auction are offered to settle the estate of Roman E. Johnson, Franklin County Probate Court #514005, Adam R. Rinehart, Administrator. Cheri Gray, Auctioneer LLC is the auctioneer of contract for this auction with Belhorn Auction Services, LLC providing support services in regard to internet bidding. The auction will be conducted live with live internet bidding provided by LiveAuctioneers. In addition to the lots offered online, a number of uncataloged lots will be offered at the auction immediately following the cataloged portion. BUYER'S PREMIUM AND PAYMENT: A 13% buyer's premium applies to all lots purchased via absentee or internet bid regardless of payment method. Ohio sales tax of 6.75% will be charged on-site at the auction and for bidders residing in Ohio bidding by absentee or internet bid unless a valid tax exemption number is provided. Any out-of-state bidders may be responsible to report purchases and pay use tax under their own state law. All bidding will be in and must be paid in U.S. Dollars. For buyers purchasing items via absentee or internet bids we accept Visa and MasterCard only. All payments must be made prior to any property being removed from the auction venue or our offices. Invoices are due immediately upon receipt and must be paid in full before any property can be removed from the auction venue or our offices. If payment is not received within thirty (30) days of sale, Belhorn Auction Services, LLC and Cheri Gray, Auctioneer LLC reserve the right to void the sale and deny participation in future auctions. INVOICES: Invoices will be emailed within 24 hours of the end of the auction and are due immediately upon receipt. Upon receipt of the invoice, it is the buyer's responsibility to contact us to make payment via Visa or MasterCard. If payment is not received within two (2) business days, we will attempt to contact the buyer using the information provided at the time of registration. Full and detailed payment instructions will be included with invoices. RESERVES, OPENING BIDS & ESTIMATES: All items are offered without reserve. A minimum opening bid of $10.00 will be placed on each lot. If bids on a lot fail to receive an opening bid, the lot will be "passed." The pre-auction estimates provided are opinion of what the property may sell for at auction. These estimates are based generally on appraised values provided for the benefit of the Estate, which may by derived by prices paid at our or other past auctions, reference materials available on the subject property, or the subjective opinion of experts in the field. By no means are pre-auction estimates to be taken as a guarantee or warranty of the value or marketability of any particular item(s). CONDITION & GUARANTEE: All items are offered "as is, where is" and without guarantee. Any information offered, whether verbally, in writing or via electronic methods (email, internet, etc.) should be considered reliable but not guaranteed. All sales are final and placing a bid is a legally binding obligation. Condition reports are offered as convenience to bidders, but should be considered only as opinion and not as statement of fact. SHIPPING: Shipping services to both domestic and international buyers are offered through Pak Mail. In addition to Pak Mail's professional service and quick turn-around, a 15% discount off of their standard rates has been negotiated for our customers. Once your initial invoice (hammer price and buyer's premium) for your purchase is processed, we will take your item(s) to Pak Mail on your behalf and free of charge with your contact information. DISPUTES, JURISDICTION AND OHIO LAW: The laws of Ohio shall govern this auction conducted by Belhorn Auction Services, LLC and Cheri Gray, Auctioneer LLC. Any disputes that may arise in connection with the auction and/or any auction purchase, and all of the terms and conditions set forth herein above, shall be governed by and construed in accordance with Ohio law. Anyone who participates in the auction and/or makes auction purchases agrees to submit to the jurisdiction of the courts of the State of Ohio with respect to any dispute arising in connection with the auction and/or any auction purchases. In the event that Belhorn Auction Services, LLC and/or and Cheri Gray, Auctioneer LLC needs to bring an action to enforce the terms and conditions herein and/or to collect any sum due and owing to it Belhorn Auction Services, LLC and/or and Cheri Gray, Auctioneer LLC shall be entitled in addition to collect its reasonable attorney's fees, collection agency fees, and cost of suit. MISCELLANEOUS: If any provision of portion of these Terms and Conditions of Sale shall be deemed unlawful, void, or unenforceable under applicable law, that provision or portion shall be stricken and severed from the remaining provisions, which shall remain in full force and effect. Failure to enforce any of the provisions in these Terms and Conditions of Sale shall not be deemed a waiver of the right to enforce any other provisions of these Terms and Conditions of Sale.

Roman E. Johnson was born Sept 4, 1917 and raised in Columbus, Ohio. Johnson was one of six children, and a sickly child who was encouraged by his mother to draw. Johnson studied painting formally for two years with African-American artist Cletus Butler and in 1941 met Emerson Burkhart. Burkhart and Johnson worked together for six years painting many of the same eastside scenes. In 1946 Johnson went to New York to study at the Art Student's League. Johnson spent ten years in New York and a year in Paris before returning to Columbus. While in New York, Johnson studied under Edwin Dickinson and Ernest Fiene. A statement Johnson wrote for an exhibition when he was 72 best summarizes his seriousness of purpose as an artist: I do paintings in an effort to enhance or continue the culture of Black people. In the 40s and 50s when I visited the Museum of Modern Art in New York, I never saw any art by or about Blacks. So I decided to do that. I am personally indebted as an artist to Edwin Dickinson, Emerson Burkhart, Ernest Fiene and Kuniyoshi. It would be a damn shame to let those guys down considering all the time and attention they gave me. I labor on every painting out of respect for them; to do my subjects justice; and because painting is hard work. Roman E. Johnson was acknowledged with an Honorary Doctorate of the Arts Degree, at the Ohio Dominican College's Spring Commencement in 1998. In 2003, Dr. Johnson was distinguished as the Governor's Award for the Arts in Ohio, Individual Artist recipient. Dr. Roman E. Johnson died Oct 24, 2005.
