Terms & Conditions for Desert West Live Auctions: Terms: All merchandise is sold as is, where is to the highest bidder. Neither we, nor the consignor make any warranties or representations with respect to the correctness of description, genuineness, attribution, provenance, period, culture, age, source, origin, authenticity, or condition of any item sold. All statements, written and oral, are the opinion only of Desert West Auctioneers. Any questions about items should be asked prior to the auction.
*** If an item is materially different than was described by the Seller, Buyer shall have 48 hours from the date the property is received to notify the Seller. After the 48 hour period all items are considered as is, without recourse. No buyers premium or shipping will be re-embursed on items returned for any reason.
*** By bidding in this auction you are entering a binding legal contract to pay for your items within 1 week of the close of the auction. Non payment will result in a non pay warning. Items not paid for upon the non pay warning, will be relisted for resale within 10 days. You represent that you are over the age of 18 and can enter into legal contracts.
*** The highest bidder acknowledged by the auctioneer shall be the purchaser, regardless of the time the bids were placed. In the event of a tie between bidders, the auctioneer shall have the sole and final discretion either to determine the successful bidder or to re-offer and resell the article in dispute. If any dispute arises after sale, the Company's sale record shall be conclusive in all respects.
*** Specific Lot Questions: If you have any questions regarding an items, send an email or call with your questions prior to bidding. All inquiries regarding lots for sale must be received 24 hours prior to the start of the auction. Please register to bid and logon to Live Auctions 2 hour before the start time, 10am MDT.
*** Payment: We honor American Express, Master Card, Visa, Discover, Money Orders, Cashiers Checks, and PayPal. If paying by Paypal, Winning bidders must log on to the PayPal web site directly and request payment to be sent to firstname.lastname@example.org. or wait for the paypal invoice that will be sent after the initial invoicing. Personal checks will be honored with a fifteen day waiting period for our local bank to clear your check. New Mexico Sales Tax will be charged on items delivered within New Mexico, unless an NTTC is on file at our office.
*** Buyers Premium: A buyers premium of 15% will be added to the final bid amount on all items purchased. Please note - Invoices will be sent for each auction date with combined shipping if applicable. Please allow 3 days for us to invoice for your winning items.
*** Shipping: We combine shipping for multiple purchases where possible. All shipping is at the buyers expense, and will be determined after each auction, based on actual shipping charges to designated shipping address, supplied by the buyer. Buyer will pay actual shipping costs plus insurance & handling. We require all items to be insured. Return shipping of items to us must be preauthorized and is at the buyers expense.
