Mount Congreve - The House Sale Day 2

1. Buyers are reminded that there is a 25% V.A.T. inclusive premium payable on the final bid price for each lot. LIVE BIDDING WILL INCUR A SURCHARGE OF 3% 2. The Auctioneers are always pleased to advise clients and to execute bids on their behalf, but if successful, the purchase price payable will be the final bid price and the V.A.T. inclusive premium of 25% chargeable thereon. We encourage all clients to contact us directly to arrange telephone bidding or absentee bidding, which is preferential to live bidding. 3.Currency: Bids are accepted in Euro only, although payment may be accepted in alternative currencies and subject to appropriate charges. 3.INSPECTION: Ample opportunity is given for inspection and each purchaser, by making a bid for a lot acknowledges that she has satisfied herself fully before bidding by inspection and is aware of the physical condition of and description of the lot including (but not restricted to) whether the lot is damaged or has been repaired. Mealy's are not conservation experts, restorers or related professionals. Condition reports may be furnished but are merely the gratuitous opinion of the auctioneer and while every effort is made to supply accurate condition reports, disputes arising from such opinions post sale will not be entertained. 4.PROPERTY & RISK: The property in a lot shall not pass to the buyer until he has paid the purchase price in full. However, each lot is at the sole risk of the purchaser from the fall of the hammer. Each purchaser shall forthwith give his full names and permanent address and if called upon to do so by the Auctioneer shall forthwith pay to Mealy's such proportion of the purchase price as the Auctioneer may require. If the purchaser fails to do so, the lot may at the auctioneer's sole discretion be put up again and re-sold. 5.Removal of goods: (a) No purchase shall be claimed or removed until the sale has been concluded. All lots shall be paid for and removed at the buyer's risk and expense at the end of the Sale, failing which the Auctioneer shall not be responsible if the same are lost, stolen, damaged or destroyed, and all lots not so removed shall remain at risk of the buyer and subject to the minimum warehousing charges outlined below. (b) Storage and warehousing charges: Mealy's recommend Gibbons Removals as designated logistics partner for this sale. All lots must be paid for and removed from Mount Congreve by Friday 13th July. Any lots not paid for and collected by this time will be removed by Gibbons Removals and subject to transfer and storage charges. These charges are payable by the purchaser to and are subject to VAT. (c) If any buyer fails to comply with any of the above conditions, the damage recoverable from the defaulter shall include all loss arising from any re-sale of the lot, together with the warehousing charges and expenses in respect of both sales, and any money deposited in part payment shall be held by the auctioneer against the defaulters liability and may be appropriated in settlement of the liability. If within 30 days after the Sale of any item, the Auctioneer receives a notice in writing from the Buyers by Registered Post that such an item is a deliberate forgery, together with the necessary evidence to satisfy the Auctioneers of such an allegation, then the Sale of that item will be rescinded and the net Purchase monies refunded (less any outlays incurred by the Auctioneers) to the Purchaser. In the event of any dispute arising in relation to any of the foregoing, the matter shall be referred to an Independent Arbitrator to be agreed between the parties. 6.Title: The Title of an item or items purchased will not pass until the Auctioneers receive full payment. Any person purchasing an item or items, whether on behalf of a client or not, is responsible for payment of that item or items. Under no circumstances can the Auctioneers accept Third Party Cheques either in full or Part Payment of any lot. By participating in this Sale, all buyers and bidders agree to be bound by the terms of the conditions of business which appear in the Catalogue for sale. 7.Images: Image dispays are used online and in the auction room during the live auction. This service is merely a reminder to the Customer of items physically viewed previously during Viewing Days by the buyer or his/her agent. Mealy's do not guarantee the accuracy of these images. Disputes arising as a result of image displays will not be entertained. 8.Telephone & Absentee Bidding: Mealy's shall execute absentee bids on behalf of intending buyers, and no charge is made for this service. Lots will be purchased up to the maximum bid price, as permitted by other bids and reserves. Registration for absentee bidding must be completed and submitted to the Commissions Department by 4.30p.m. on day preceding auction. Photo ID and credit card information will be required for first time buyers. With regard to this Service, Mealy's accept no responsibility for items not viewed, whether a condition report has been given or not. Such absentee bids must be confirmed in writing (via email scan or fax), tgoether with identification and credit card details. Such registration must be completed no later than 4.30pm on the Monday preceding the auction. Mealy's accept no responsibility or liability for acts or omissions regarding any bids received after the deadline specified above. 9. General Terms a) The highest bidder to be the buyer, and if any dispute arises between two or more bidders, the lot in dispute shall immediately be put up again and resold. b) n the case of lots upon which there is a reserve, the Auctioneer shall have the right to bid on behalf of the seller. c)The Purchasers to give their names and places of abode. The lots to be taken away and paid for, whether genuine and authentic or not, with all faults and errors of description at the buyers expense and risk, within one day of close of Sale: the Auctioneers not being responsible for the correct description, genuineness or authenticity or any default or defect in any lot, and making no warranty whatever. d)No lot can be removed during the sale N.B. Please note the Auctioneers offer no After Sale Guarantee whatsoever, with regard to mechanical and electrical items, or fire arms. We accept no subsequent liability for any damage, loss or injury arising fro the use of the foregoing.
