The lots listed in this catalog will be offered by E-pearl Art & Collectables (hereinafter referred to as E-pearl Art) subject to the following terms and conditions. By bidding at auction you agree to be bound by these Terms and Conditions of Sale. CORRECTNESS OF DESCRIPTION - E-pearl Art has tried its best to catalog and describe correctly and accurately to the property to be sold. But E-pearl Art can not warrant the correctness of description, attribution, authenticity, or condition of said property. No statements shall be deemed as such a warranty or representation or an assumption of liability, but are to be construed as our opinions only. It is bidders responsibility to personally examine the property to be sold prior to the auction and to bid based on your own judgment. All the items are sold AS-IS with all faults. All the sales are final with no exceptions. CONDITION OF PROPERTY - The property to be sold are often of considerable age (by being antique) and will exhibit wear, usage, and damages which may not be listed in descriptions. The absence of any reference to the condition of a lot does not imply that the lot is in perfect condition or completely free from wear and tear, imperfections or the effects of aging. Bidders are encouraged to preview property to be sold prior to the auction. All items are sold AS-IS and without recourse, absolutely NO RETURN based on condition. AUCTION HOUSE RIGHTS - E-pearl Art reserves the right to withdraw any lot and reject any bid. RESERVE - Some lots are subject to a reserve which is the confidential minimum price below which such lot will not be sold. The reserve will not exceed the low estimate of the lot. The auctioneer may continue to bid on behalf of the seller up to the reserve. ABSENTEE BID - This is an online auction only. However, auction house will accept absentee bids by email. In email you need to include your name, address, and a phone number that we can reach you. You must also state that you have read and agree to E-pearl Art Terms and Conditions for 10/6/2012 sale. Please Note: If we can not reach you by phone before the auction, your absentee bid will not be executed. E-pearl Art will not be responsible for errors or failure to execute bids. In the event of identical bids, the earliest will take precedence. BUYERS PREMIUM - 22% of the hammer price will be added to final purchase price for online bidding and 19% for absentee bid. The buyer agrees to pay E-pearl Art buyers premium and 7% Indiana sales tax in addition to hammer price. PAYMENT - Success bidder should pay for lots within 8 business days from the date of the sale. We accept payment of cash, cashers check, money order, and wire transfer only. The purchaser agrees to pay E-Pearl Art handling charge of $50 for any check dishonored by the drawee. PACKING AND SHIPPING - Buyer is responsible for all packing and shipping cost. Small items can be packed and shipped in house at your choice. Or you can select your own shipper. E-pearl Art can provide a list of shippers in the area. In case of using in-house shipping, insurance is mandatory. Any large items must be packed and shipped by outside agents/shippers. NON PAYMENT - If we do not receive payment in full, in good cleared funds, within 8 business days following the sale, we are entitled in our absolute discretion to exercise one or more of the following measures: a) to impose a late charge of 2 percent (2%) per thirty (30) days of the total purchase price; b) to hold the defaulting buyer liable for legal fees and costs for us to collect the payment; c) to cancel the sale and resell the property publicly or privately without reserve, and with the purchaser liable for any deficiency, cost, and our commission on both sales. FAILURE TO COLLECT PURCHASES - A property must be picked up within 15 business days following the sale. E-pearl Art shall have no liability for any damage to property left on its premises for more than 14 business days following the sale. Property which is paid for but left on our premises for any reason in excess of sixty (60) calendar days is subject to sale by us with the balance of any funds recovered in excess of storage charges and any other fees being remitted to you.
