Auctioneer LLC may continue to bid on behalf of Auctioneer LLC as owner or as agent for the Consignor(s) up to the amount of the reserve, either by placing consecutive bids or by placing bids in response to other Bidders. With respect to lots that are offered without reserve, Auctioneer LLC may bid on behalf of Auctioneer LLC as owner or as agent for the Consignor(s) either by placing consecutive bids or by placing bids in response to other Bidders. AUCTIONEER AND LIVEAUCTIONEERS DISCRETION Auctioneer LLC and LiveAuctioneers have the right at their absolute and sole discretion to refuse any bid, to advance the bidding in such a manner as they may decide, to withdraw any lot, and in the case of error or dispute, and whether during or after the sale, to determine the successful Bidder, to continue the bidding, to cancel the sale or to reoffer and resell the item in dispute. If any dispute arises after the sale, the Auctioneer LLC and LiveAuctioneers sale record is conclusive. SUCCESSFUL BID The highest bidder acknowledged by Auctioneer LLC and LiveAuctioneers will be the Buyer. In the event of a dispute between Bidders, Auctioneer LLC and LiveAuctioneers have final discretion to determine the successful Bidder or to reoffer the lot in dispute. Payment is due within 3 business days. All payments and invoicing are handled by LiveAuctioneers via LivePayments. The pickup days are the 7th and 8th days following the sale. The hours of pickup are always 10:00AM-5:00PM local time of the pickup address. This allows shippers 5 business days to get pickups put on their schedule. This allows flexibility for people who work on Friday that prefer to pickup their items on Saturday. This also allows flexibility for shippers who only want to pickup items on Friday, which is a business day. Please note that all items must be removed on the scheduled pickup days or they will be forfeited and you will not be refunded. There will be no one to help you load items, so please bring personnel with you. Please also bring your paid in full invoice with you either digitally on your device or a print-out. No items can be removed from the pickup location unless a paid in full invoice is provided. After leaving the pickup location, the item is your responsibility or the responsibility of the shipping company or person that you hired. If you purchased a lot specified as INDIANA RESIDENTS ONLY, you will be required to show a valid Indiana Drivers License at the time of pickup, and we are allowed to make a copy. If you are using a shipper, you will need to email a color copy of the front and back of your valid Indiana Drivers License to AuctioneerLLC@gmail.com prior to your shipper picking up the item(s). You are only allowed on the premises on the 7th and 8th day following the sale between the hours of pickup, which are 10:00AM-5:00PM local time of the pickup address. Loitering in any manner at the premises without conducting legitimate business shall be deemed as trespassing. Please promptly remove your items from the premises and then leave. If you are found to be on the premises during a day or at a time other than what is specified, you will be trespassing. Trespassers will be prosecuted to the fullest extent of the law in the local jurisdiction, which could include a fine or imprisonment or both. Guard dog(s) may be freely roaming the premises on a day or time other than what is specified for pickup. Buyer does hereby indemnify and hold harmless Auctioneer LLC and Seller (Auctioneer LLC as owner or Consignor(s)) from any and all damages, claims or liabilities from injuries or death. Vehicles and trailers in close proximity to one another could get damaged on the pickup days. Please have adequate insurance for all vehicles and trailers. NON-PAYMENT If LiveAuctioneers does not receive payment in full, in good cleared funds, within five (5) business days following the sale, we are entitled in our absolute discretion to exercise one or more of the following measures, in addition to any additional actions available to us by law: a.) to hold the defaulting Buyer liable for the total amount due and to begin legal proceedings for its recovery together with interest, legal fees and costs to the fullest extent permitted under applicable law b.) to cancel the sale c.) to resell the property publicly or privately with such terms as we find appropriate, to resell the property at public auction without reserve, and with the Buyer liable for any deficiency, cost, including handling charges, the expenses of both sales, our commission on both sales at our regular rate, all other charges due hereunder and incidental damages. In addition, a defaulting Buyer will be deemed to have granted us a security interest in, and we may retain as collateral security for such Buyers obligations to us, any property in our possession owned by such Buyer. PURCHASED LOTS If for any reason a purchased lot cannot be delivered in the same condition as at the time of sale, or should any purchased lot be stolen, mis-delivered or lost prior to delivery, Auctioneer LLC shall not be liable. LEGAL RAMIFICATIONS The rights and obligations of the parties with respect to these Conditions of Sale, the conduct of the auction and any matters connected with any of the foregoing shall be governed and interpreted by the laws of the jurisdiction in Indiana. If any part of these Conditions of Sale is found by any court to be invalid, illegal or unenforceable, that part shall be discounted and the rest of the conditions shall continue to be valid to the fullest extent permitted by law. CLAIMS OR LIABILITIES TO PERSONS OR PROPERTY Buyer does hereby indemnify and hold harmless Auctioneer LLC and Seller (Auctioneer LLC as owner or Consignor(s)) from any and all damages, claims or liabilities from injuries or death to persons or property of any type whatsoever caused during the removal of items purchased. To reduce the possibility of injury or death, Buyer is strongly encouraged to hire LiveShipping to remove all items, pack all items, insurance all items, and ship all items.
