CONDITIONS OF SALE These Conditions of Sale represent the entire agreement between Stair Galleries & Restoration, Inc. (STAIR), the consignor, and any purchaser or bidder. They may be changed by posted notices or announcements made during the auction. By bidding, you agree to these terms. 1. AS IS All property is sold “AS IS,?? with no guarantees from STAIR or the consignor about its condition or characteristics. There are no warranties of any kind—express or implied—about the item’s value, history, or description accuracy. Prospective bidders should inspect items before bidding. STAIR provides some condition reports online but makes no guarantee about their accuracy. Bidders are encouraged to contact STAIR for further information. The absence of a condition report doesn’t mean the item is in perfect shape. STAIR and the consignor do not guarantee any rights to reproduce or copyright any item. They are not responsible for catalog or supplemental material errors. 2. RESERVES Some lots have a minimum price (reserve) below which they won’t be sold. STAIR staff may bid to meet that reserve. 3. WITHDRAWAL STAIR can withdraw, combine, or split lots before bidding begins, without any liability. 4. BUYER’S PREMIUM A 31% buyer’s premium applies to the hammer price up to $50,000. Any amount above $50,000 is charged at 25%. If bidding through a third-party platform, their additional fees are also added to the STAIR premium. 5. BIDDING The auctioneer decides the winning bidder and may reject any bid. The auctioneer has sole discretion in resolving disputes. Online, absentee, and telephone bids may be accepted, but STAIR isn’t responsible for errors with these. Bidders must register with ID and may need to provide further information or a deposit. Bidders confirm their bids are not collusive or unlawful. 6. LIVE ONLINE BIDDING Bidders using third-party platforms agree to both STAIR’s and the platform’s terms. Premiums from third-party platforms are added to the STAIR buyer’s premium. Refer to Live Auctioneer’s terms for full payment and shipping policies. STAIR isn’t responsible for third-party platform policies. 7. FALL OF THE HAMMER When the auctioneer’s hammer falls, the contract is finalized. Title passes only once STAIR receives full payment. Sales tax is added unless exempt. 8. PAYMENT STAIR accepts checks (U.S. bank only), wire/ACH transfers, major credit cards, and cash (under $10,000). Credit cards are accepted for purchases under $40,000. Payment is due immediately, including hammer price, premium, and taxes. STAIR may charge for bounced checks. Refer to Live Auctioneer’s terms for third-party payment rules. 9. TOTAL PURCHASE PRICE This includes the hammer price, buyer’s premium, and any applicable sales tax. 10. REMOVAL Property is only released after full payment. Late payments may incur a 1.5% monthly fee. Buyers must pick up items the day after the auction by 1:00 PM. After 10 days, STAIR may charge $50 per day per lot for storage. Items may be moved to a warehouse at the buyer’s cost. Buyers are responsible for arranging shipping and obtaining any permits. STAIR isn’t liable for loss or damage after 10 days from the auction. 11. EXPORT, IMPORT, ENDANGERED SPECIES AND PERMITS The buyer is solely responsible for any export/import or endangered species regulations. Laws may prohibit importation of materials like ivory, coral, or rosewood. It’s the buyer’s duty to research and obtain permits. Sales cannot be canceled due to permit issues. STAIR isn’t liable for seizures by authorities and cannot guarantee which lots are restricted. 12. REMEDIES If a buyer fails to meet obligations, STAIR may cancel the sale, resell the property, charge storage, or take other legal actions. Buyers may be held liable for resale costs and legal fees. STAIR may also secure the buyer’s funds or property as collateral. They can file liens or financing statements as permitted by law. 13. LIMITATION OF LIABILITY STAIR’s liability is limited to the actual purchase price paid for the item. 14. NEW YORK LAW; JURISDICTION All disputes will be governed by New York law, and any legal action must be in a New York state or federal court. 15. COPYRIGHT All images, text, and materials produced by STAIR remain their property and are protected by copyright.

If you have not contacted STAIR to arrange payment within 3 days of the time that invoice is sent, we will charge the credit card you used to register for the auction for the amount of your invoice.
