These include the Terms of Consignment for Sellers, and any other terms referenced herein, displayed at the auction venue, or communicated via announcements. Participation in an auction implies full acceptance of these Terms and Conditions. We act as agents for the Seller. The identity of the Seller is usually not disclosed. Upon a successful bid, the sale contract is formed directly between the Buyer and the Seller. 1. Interpretation 1.1 "Auctioneers" means L'Autographe Ltd 1.2 "Catalogue" means brochures, addenda, and related sale material 1.3 "Conditions" means these terms of sale 1.4 "Hammer Price" means the price a lot is sold for 1.5 "Purchaser" is the buyer of a lot 1.6 "Seller" is the vendor of a lot 1.7 "VAT" means Value Added Tax 2. Bidding 2.1 The highest bidder is the Purchaser. 2.2 Bids may not be withdrawn. We may refuse bids or withdraw lots at our discretion. 2.3 We may set reserve prices (not exceeding the lower estimate). 2.4 We may bid on behalf of the Seller. 2.5 Disputes will be resolved at our discretion. 2.6 Commission bids are accepted without charge. Bids can be submitted via phone or email at the sender's risk. 2.7 Lots are generally not sold below the low estimate. 3. Payment 3.1 Buyers must provide identification and may be required to pay a deposit. 3.2 The Purchaser must pay the Hammer Price plus a Buyer's Premium of 25%. (minimum charge is ?15) VAT at 20% is applied only for items delivered or collected within the UK. International deliveries are VAT-exempt. 3.3 Import VAT: For lots imported into the UK, 5?% of the hammer price is payable by UK buyers. Items shipped outside the UK are VAT exempt. 3.4 Payment is accepted by bank transfer or debit/credit card only. No additional payment charges apply. 3.5 Overseas clients must pay via bank transfer or card. Any shortfall due to charges or exchange rates will be charged to the Purchaser. 3.6 We do not accept PayPal payments. 3.7 Lots will not be released until payment is received in full. 4. Risk 4.1 Risk transfers to the Purchaser upon the fall of the hammer. 4.2 Buyers accept lots "as is" and are responsible for verifying authenticity and condition themselves. 5. Liability 5.1 No representations or warranties are made. 5.2 Catalogue statements are opinions, not factual guarantees. 5.3 Disputes over authenticity must be supported by expert reports and submitted within 21 days. Refunds are discretionary. 5.4 We are not liable for injury or damage, except in cases of negligence that cause death or personal injury. 6. Auctioneer's Role 6.1 We act as agents for both the Buyer and the Seller and are not liable for any defaults. 7. Delivery and Storage 7.1 VAT at 20% applies to UK delivery and packaging charges. 7.2 Customs declarations will be completed; Buyers are liable for any import charges. 7.3 Export Licences, where required, are subject to a ?20 administration fee per invoice. 7.4 Shipping charges are calculated based on the purchased items and are clearly listed on the invoice. 7.5 Insurance will be added to all packages sent from us. 7.6 Uncollected items may be stored at the Buyer's expense and resold if not claimed within three months. 7.7 Delivery is arranged on request. Insurance is available on written request. 8. Remedies 8.1 If the Buyer defaults, we may cancel the sale, retain goods, charge interest, pursue legal action, or resell the lot. 8.2 These remedies are discretionary and not obligatory. 9. Warranties 9.1 The Seller warrants that they own the lot or have the authority to sell it and that it is lawfully exported/imported. 9.2 We are not liable for errors or omissions in descriptions. 9.3 We make no warranties beyond those explicitly stated. 9.4 Liability is limited to the purchase price. 9.5 Nothing excludes liability for fraud or personal injury caused by negligence. 10. Authenticity Guarantee 10.1 All items are sold with a full guarantee of authenticity, unless differently stated. Discrepancies may be refunded in full. 10.2 Requests for formal confirmation can be included with your invoice. 10.3 Items sold in batches or clearly labelled as non-autographed are non-returnable. 11. KYC / KYB New or inactive clients must register 72 hours in advance. ID may be required: ? Individuals: photo ID and proof of address ? Companies: incorporation documents and beneficial ownership ? Deliberate Forgeries 12.1 Items proven to be forgeries can be returned within 21 days. 12.2 Refunds do not apply if the catalogue reflects scholarly opinion or if detection methods were impractical. 12.3 Title must be transferable to claim a refund. 12.4 We may request independent expert reports. 12.5 Liability is limited to the Hammer Price + Buyer's Premium. 13. General 13.1 Terms may be modified at any time. 13.2 Access to our premises and auctions is at our discretion. 13.3 Special terminology is explained in the catalogues. 13.4 We copyright all auction media. 13.5 Waivers do not affect enforceability. 13.6 Terms bind successors. 13.7 The Contracts (Rights of Third Parties) Act 1999 does not apply. 13.8 These terms constitute the entire agreement. 14. Bidding Increments 14.1 Bidding increments are subject to the sole discretion of L'Autographe. To provide illustrative examples: (a) ?0 to ?199 - in increments of ?10 (c) ?200 to ?499 - in increments of ?20 (d) ?5010to ?999 - in increments of ?50 (e) ?1,000 to ?1,999 - in increments of ?100 (f) ?2,000 to ?4,999 - in increments of ?200 (g) ?5,000 to ?9,999 - in increments of ?500 (h) ?10,000 to ?19,999 - in increments of ?1,000 (i) ?20,000 to ?49,999 - in increments of ?2,000 (j) ?50,000 to ?99,999 - in increments of ?5,000 (k) ?100,000 to ?249,999 - in increments of ?10,000 (l) ?250,000 and up - in minimum increments of ?25,000 15. Online Bidding Online purchases via third-party platforms incur fees: ? 5% + VAT via The Saleroom, Invaluable, Live Auctioneers (minimum charge is ?20) ? 3% via Drouot (minimum charge is ?20) ?
