Auction Art San Francisco - Terms and conditions
The following conditions of sale, as supplemented in writing or otherwise by us at any time prior to the sale are the complete terms and conditions on witch all property is offered for sale . Bidding on any articles in our auctions indicates your acceptance of our terms of sale. As used herein, Art Auction, we, us, our or similar terms refer to Auction Art San Francisco .
INSPECTION OF PROPERTY All property is sold "as is". Buyers are advised to personally examine any property on which they intend to bid prior to the auction. The absence of any reference to the condition of a lot does not means that the lot is in perfect condition
BID PRICE In addition to the hammer price, the buyer will pay to Auction Art San Francisco a premium of 20% from 0 to 70 000, 16% from 70 000 to 1 000 000 and 12% over 1 000 000 and also, unless the purchaser is exempt by law, the state and local states tax applicable in San Francisco. Unless otherwise agreed, the buyer must pay the full purchase price no later than 7 business days following the sale. We reserve the right to hold the merchandise paid by check until the check has cleared the bank. Title passes upon the fall of the auctioneer's hammer. Payment is due upon receipt of your invoice. A late charge will be added on all balances not paid at the rate of 15% A.P.R. commencing 15 days after the auction. We reserve the right to cancel the sale of all property not paid in full 30 days after the auction. We will, then, be entitled to keep as a liquidated damages all payments already made, resell the lot(s), either publicly or privately.
ABSENTEE BIDS We will use reasonable efforts to execute written absentee bids left with us prior to the sale. We do not accept liability for failing to execute a written bid or for errors in connection with the written bid
TELEPHONE BIDS We will use reasonable efforts to accommodates telephone bids on lots with a low estimate of $ 300 and above. We do not accept liability for failure to do so or for errors in connection with telephone bidding.
RESERVES Some lots might be subject to a reserve. We may continue to bid on behalf of the seller up to the amount of the reserve.
WITHDRAWAL We reserve the right to withdraw any property before the sale and shall have no liability whatsoever for such withdrawal. We reserve the right, to determine the conduct of the sale, reject any bid offered
PAYMENT AND PICK UP. We can provide you with a list of shippers. We will not be responsible for any act or omission of any party in connection with such reference. All property shall be removed from Auction Art San Francisco by the purchaser at his own expense no later than 5 days following its sale. Property will not be released to the shipper without the buyer's written consent and until payment has been made in full
RISK OF LOSS. If for any reason( fire, theft...) we are not able to deliver a lot to a purchaser, we shall not be liable for any amount in excess of that paid by the purchaser.
WARRANTY In the event that a buyer claims that an item is not authentic, Auction Art San Francisco have no obligation to cancel the sale unless the buyer has obtained, at his expenses the opinion of two recognized experts in the field, who are mutually agreeable to Auction Art San Francisco and the buyer, that a lot is not authentic. Any action must be made within 7 days of the sale. Please note that if you pay late you will not be eligible for this guarantee
LEGAL DISPUTE These terms of sale are governed by the laws of the state of California
PRIVATE SALES These terms of sale shall govern any private sale of property by us not made through auction
