Terms & Conditions
FREE SHIPPING AUCTION — TERMS & CONDITIONS OF SALE
Effective Date: September 8, 2026
1. AGREEMENT TO THESE TERMS
Free Shipping Auctions ("we," "us," "our," or the "Auctioneer") conducts online auctions of antiques, furniture, collectibles, decorative arts, and related property (each item, a "Lot"). We sell either as owner of the Lot or as agent for a consignor.
By registering to bid, placing a bid, or purchasing through LiveAuctioneers or any other platform on which we list, you ("you," "Bidder," or "Buyer") accept these Terms & Conditions of Sale in full. These Terms, together with any Lot-specific notes in a listing and any announcements made during the sale, form the entire agreement between you and us regarding your purchase. They supersede any prior discussion, correspondence, or understanding.
If you do not agree to these Terms, do not bid.
These Terms operate alongside the terms of the platform through which you bid. Where our Terms and the platform's terms both apply, each governs its own subject matter; where they cannot be reconciled, our Terms control as to the sale of the Lot itself.
No one may vary these Terms. No employee, agent, or representative of ours is authorized to make any representation, give any information, or provide any assurance — orally or in writing — that amends these Terms, alters the Limited Authenticity Guarantee in Section 16, or creates any additional warranty regarding any Lot. Any such statement is void and may not be relied upon.
2. ALL LOTS SOLD "AS IS, WHERE IS"
Every Lot is sold "AS IS" and "WITH ALL FAULTS." We are selling used, antique, vintage, and secondhand property. Age-appropriate wear is expected and is not a defect.
Except for the limited warranties in Sections 12.1 and 16, we make no warranties or representations of any kind, express or implied, and we specifically disclaim all implied warranties of merchantability and fitness for a particular purpose, as to any Lot — including as to its condition, size, weight, completeness, quality, rarity, importance, medium, materials, genuineness, attribution, authorship, provenance, period, culture, origin, prior exhibition, published literature, or historical or monetary significance.
Everything we publish about a Lot — in a title, description, condition report, photograph, video, or verbal statement — is a statement of opinion, not a statement of fact, and is offered as a good-faith guide only. Nothing we say or write creates a warranty, a representation, or an assumption of liability.
You are responsible for satisfying yourself as to the condition, authenticity, and suitability of any Lot before you bid.
3. WHAT "AS IS" MEANS FOR ANTIQUES AND COLLECTIBLES
Because of the nature of our inventory, please understand specifically that:
Wear is normal. Scratches, dents, nicks, losses, chips, crazing, staining, fading, oxidation, patina, warping, veneer lifting, joint separation, loose or missing hardware, and similar conditions are typical of age and are generally not itemized.
Repairs and restoration are common. Antique furniture and decorative objects have frequently been repaired, refinished, married, re-veneered, re-upholstered, re-glued, replaced in part, or otherwise altered. We may not be aware of every such alteration, and we do not warrant that any Lot is in original or unrestored condition. Mentioning one repair does not mean there are no others.
Nothing is tested. Clocks, lamps, lighting, radios, phonographs, musical instruments, appliances, motors, watches, tools, and any other mechanical or electrical item are sold as decorative objects only. We do not test them and do not warrant that they function, are safe, or are wired to any current code. Have any electrical item inspected and rewired by a licensed professional before use.
Measurements and weights are approximate and are provided for general guidance. Confirm dimensions independently if fit matters — we will not accept a return because a piece did not fit a space, doorway, or stairwell.
Photographs vary. Color, finish, scale, and tone differ between screens and lighting conditions. Photographs are part of the description but are not a substitute for your own diligence.
Contents, keys, and components shown or implied are not guaranteed unless expressly listed. Sets, services, and multi-piece lots may be incomplete.
Odors, textiles, and prior environments. Upholstery, rugs, textiles, and case pieces may carry odors (smoke, pet, mustiness) or show insect or moisture history. These are not defects for purposes of a return.
Older items may contain hazardous materials, including lead paint, lead solder, asbestos, mercury, radium luminous paint, or arsenical pigments. Keep such items away from children and handle accordingly.
4. CATEGORY-SPECIFIC DISCLAIMERS
These supplement Sections 2 and 3 and apply to the categories named.
4.1 Jewelry and gemstones. Colored gemstones are routinely treated to improve appearance — by heating, oiling, irradiation, diffusion, filling, dyeing, or other clarity or color enhancement. These practices are accepted in the trade, but they can make a stone more fragile or require special care. Assume any gemstone has been treated unless a report from a recognized laboratory says otherwise. We do not obtain gemological reports for most Lots and do not warrant carat weight, color, clarity, cut, origin, metal purity, or treatment status. Where a report is quoted, it reflects that laboratory's opinion on its date; laboratories often disagree. Pearls may be natural, cultured, or imitation and are not warranted as any of these.
4.2 Watches and clocks. Nearly every antique or vintage timepiece has been serviced or repaired and may contain replacement, later, or non-original components; we do not warrant any individual part as original or authentic. Movements, dials, hands, crystals, crowns, bezels, and bracelets may be replaced. Bands described as "associated" are not original. Clocks may be sold without pendulums, weights, keys, or finials. We do not warrant that any timepiece runs, keeps time, or is water-resistant — cases are often opened for inspection, which defeats water resistance. Servicing, batteries, and repair are your responsibility and expense.
4.3 Books, manuscripts, and works on paper. Foxing, toning, tanning, offsetting, marginal tears, dampstaining, bumped corners, cracked hinges, loose or shaken bindings, bookplates, inscriptions, and library markings are common and are not itemized. We do not collate. Books are not warranted complete in text, plates, maps, or illustrations, and we do not warrant the absence of blanks, half-titles, tissue guards, or advertisements. Works on paper may be laid down, trimmed, restored, or bleached.
4.4 Prints, paintings, and frames. We do not warrant that a print is from any particular edition, state, or printing, nor that an edition number is accurate. Paintings may be relined, cleaned, overpainted, or restored, and we do not warrant that any such work has been disclosed. Frames are not part of a Lot description, are not warranted, and are not covered by any damage claim.
4.5 Rugs, carpets, and textiles. Expect wear to pile, ends, edges, and fringes; reweaving, repiling, resizing, patching, and color run are common. Origin and age attributions are opinion only. Handmade pieces vary in size across their dimensions.
4.6 Silver, metalware, and objects of vertu. Marks may be worn, obscured, later-applied, transposed, or spurious, and we do not warrant that any mark is genuine or that any item is of the standard, maker, or date its marks suggest. Weighted, filled, plated, or replated items may be described as solid in error. Monograms, erasures, and removed engraving are common.
4.7 Ceramics and glass. Chips, flakes, hairlines, star cracks, frits, crazing, staining, glaze loss, restoration, and overpainting are frequently present and may be difficult to detect without professional examination. Factory marks are widely faked. Assume restoration is possible on any Lot.
4.8 Coins, currency, stamps, and trading cards. Unless a Lot is expressly described as graded and encapsulated by a named third-party grading service, all grades and condition opinions are ours alone and are not warranted. Raw items may be cleaned, altered, repaired, trimmed, or counterfeit. We do not warrant that any item will receive any particular grade if submitted for grading.
4.9 Autographs, signed items, and sports and entertainment memorabilia. Signatures, inscriptions, and provenance in these categories are especially prone to forgery. Unless a Lot is expressly described as authenticated by a named third-party authenticator, we make no representation that any signature is genuine. A certificate of authenticity, letter of authenticity, or hologram accompanying a Lot is the opinion of its issuer, not ours, and we do not warrant its accuracy, the issuer's competence, or its acceptance by any grading service or future buyer. Authenticators frequently disagree, and a later contrary opinion is not, by itself, a basis for a claim.
4.10 Taxidermy, natural history, and organic materials. These Lots may be subject to federal and state wildlife law, may not be shippable, and may deteriorate. See Section 13.9.
4.11 Firearms, weaponry, and militaria. We do not sell firearms, ammunition, or regulated weapons.
4.12 Wine, spirits, perfume, and consumables. Not offered.
5. CONDITION REPORTS AND INSPECTION
We provide condition reports as a free courtesy to serious bidders. A condition report is one non-expert opinion, is not exhaustive, is not a full accounting of condition, and is not a statement of fact. The absence of a condition report — or the absence of any mention of a particular flaw within one — does not mean a Lot is free of wear, damage, repair, or restoration.
Request condition reports no later than 48 hours before the sale closes. We will make reasonable efforts to respond but cannot guarantee a response to late requests.
Preview: We do not offer in-person preview. Additional photographs are available on request.]
If you are not comfortable evaluating a Lot from the description, photographs, and condition report, we recommend you engage a knowledgeable representative or professional adviser before bidding. We have no liability for any error or omission in a condition report, photograph, or description.
6. REGISTRATION AND ELIGIBILITY TO BID
You must be 18 years of age or older and legally able to enter into a binding contract. You must register with accurate, complete information, including your legal name, permanent physical address, telephone number, and a valid payment method. We may require identification, bank references, a credit card authorization hold, a deposit, or other verification before approving you to bid, and we may set or adjust a bidding limit at our discretion. An authorization hold placed to verify a card is temporary and typically releases within 2–7 days.
We reserve the absolute right, at our sole discretion and without stating a reason, to decline a registration, refuse or cancel any bid, refuse to acknowledge any bidder, and bar any person from participating in current or future sales.
Bidding as an agent. If you bid on behalf of another person, that person must be disclosed to us and registered, and you must provide written authorization. You remain personally liable for the purchase price and all other sums due unless we have agreed in writing before the sale to look solely to your disclosed principal.
7. YOUR REPRESENTATIONS TO US
By registering and bidding, you represent and warrant that:
(a) You are not, and are not owned or controlled by, and are not acting on behalf of, any person or entity subject to trade sanctions, embargoes, or export restrictions under the laws of the United States or of the jurisdiction in which you do business, including any person listed by the U.S. Treasury Department's Office of Foreign Assets Control (a "Sanctioned Person");
(b) Where you act as agent, your principal is not a Sanctioned Person and is not owned or controlled by one;
(c) No part of the purchase price will be funded by a Sanctioned Person, and no party involved in the transaction — including any financial institution, freight forwarder, or other agent — is a Sanctioned Person, unless authorized in writing by the government authority with jurisdiction;
(d) The funds you use are not the proceeds of and are not connected to any criminal activity, including tax evasion, and you are not under investigation for, charged with, or convicted of money laundering, terrorist financing, or related offenses; and
(e) Where you bid on behalf of another person, you have conducted appropriate due diligence on the ultimate buyer consistent with applicable anti-money-laundering and sanctions law, you consent to our reliance on that diligence, and you have no reason to suspect the funds are connected to criminal activity.
A breach of any of these representations entitles us to cancel the sale under Section 17.
8. HOW BIDDING WORKS
Bids are binding. A bid is an irrevocable offer to purchase at that amount plus all fees, premiums, and taxes. We do not cancel bids for bidder error. Confirm your bid before submitting it. Placing a bid you cannot honor is a default under Section 15.
The highest bid acknowledged by us at the close of bidding is the winning bid, and that acknowledgment concludes the sale of that Lot.
We may, at our discretion, set and vary bid increments, group or divide Lots, change the order of Lots, move bidding forward or backward, reopen or continue bidding even after a Lot has closed, withdraw a Lot, or re-offer and resell a Lot.
Absentee and maximum bids are executed by the platform at the lowest amount necessary to maintain the high bid, up to your stated maximum. Where two identical absentee bids are received, the earlier one has priority.
Extended / soft-close bidding: a bid placed in the final 30 seconds may extend bidding on that Lot. This repeats until no further bids are received.
Disputes and errors. If you believe a winning bid was accepted in error, you must notify us in writing within 3 business days of the close of the sale. We will consider the claim in good faith and may in our sole discretion confirm the sale, cancel it, or re-offer and resell the Lot. Our decision is final and our records are conclusive.
Technology disclaimer. Online bidding depends on internet connectivity, third-party platforms, and software we do not control. Our bidding services are provided free of charge. We do not guarantee that bidding will be uninterrupted, timely, secure, or error-free, or that any bid will be transmitted, received, or executed. We are not liable for any failed, delayed, lost, or duplicated bid, for platform outages, or for any resulting missed purchase. Bidders using online platforms do so at their own risk.
9. RESERVES, ESTIMATES, AND WITHDRAWAL
Reserves. Unless a Lot is expressly marked "No Reserve," Lots may be subject to a confidential reserve — the minimum price at which the Lot may be sold. A reserve will not exceed the low estimate. We may open bidding on any reserved Lot on the seller's behalf and may bid on the seller's behalf up to (but not at or above) the reserve, including by placing consecutive bids or bids in response to other bidders. Such bids are not separately identified.
Estimates are our opinion of a probable range of hammer price. They are not appraisals, guarantees of value, or predictions, and may not be relied on as such for any purpose, including insurance or resale. They exclude buyer's premium, taxes, and fees. Actual results frequently fall outside the estimated range.
Withdrawal. We may withdraw any Lot at any time before bidding closes on it, for any reason, with no liability to any bidder.
Our interest in Lots. We may own, or hold a financial interest in, Lots we sell, and may have advanced funds to a consignor. Our employees are permitted to bid and may have access to information not available to the public.
10. BUYER'S PREMIUM, FEES, AND TAXES
Buyer's Premium. A buyer's premium of 23% of the hammer price is added to every winning bid.
Platform surcharge. Purchases made through LiveAuctioneers or other third-party bidding platforms may carry an additional surcharge equal to the fee levied by that platform. This is in addition to the buyer's premium.
Payment processing. A convenience fee applies to credit card payments, where permitted by law.
Sales tax. Applicable state and local sales or use tax is calculated on the hammer price, the buyer's premium, and any other taxable charges, and is added to your invoice. Tax is determined by the delivery destination or pickup location, regardless of your nationality, residence, or place of business. Where the bidding platform is a registered marketplace facilitator, the platform may collect and remit tax on the transaction.
Resale exemption. If you are purchasing for resale, submit a valid, properly completed resale or exemption certificate for the delivery state before payment. We cannot refund tax after an invoice is paid.
Import duties. For any shipment outside the United States, all duties, VAT, customs charges, brokerage fees, and taxes are the Buyer's responsibility and are not included in any shipping offer. See Section 13.
11. PAYMENT
When. Invoices are issued within 24 hours of the close of the sale. Payment is due in full within 3 business days of the invoice date. It is your responsibility to determine whether your bid was successful; we are not responsible for confirming it to you.
How. We accept payment via LivePayments only. All payments must be in U.S. dollars and processed through your LivePayments account. Quote your invoice number with every payment.
Payment from the Buyer only. We accept payment only from the registered bidder named on the invoice. We will not accept payment from a third party, and we cannot change the name on an invoice or reissue it in another name once it has been issued.
Card on file. By registering, you authorize us to charge the payment method on file for the full invoice amount, including premium, fees, taxes, and any charges that later accrue under these Terms, if payment is not otherwise received when due.
Clearance. We are not obliged to release any Lot until we have received the full amount due in cleared funds. Personal and bank checks must clear before release.
Chargebacks. By bidding you agree that a completed auction purchase is a binding contract and you waive any right to initiate a chargeback or payment dispute on the ground of buyer's remorse, condition consistent with an "as is" sale, or dissatisfaction with a description. We will contest such disputes and will pursue you for our costs.
Returned payments. A fee of $35 applies to any check, ACH, or transfer returned or dishonored.
Late payment. Unpaid balances accrue interest at 1.5% per month from the due date.
12. TITLE AND RISK
12.1 Warranty of title. We (where we sell as owner) or the consignor (where we sell as agent) warrant that the seller is the owner of the Lot, or is acting with the authority of the owner or with the legal right to sell it, and has the right to transfer ownership to you free of any undisclosed claim, lien, or restriction. This is the only warranty given by a consignor. Liability for its breach is limited to the purchase price you paid us, and does not extend to lost profits, lost opportunity, diminution in value, interest, costs, or any other damages. We have no liability to you in respect of a consignor's warranty.
12.2 Transfer of title. Title passes to the Buyer upon our receipt of payment in full in cleared funds — even if a Lot has already been shipped or released to you.
12.3 Risk of loss. Risk passes to the Buyer upon delivery of the Lot to the arranged address, upon tender of the Lot to the third-party carrier, or upon your acceptance of the lot when picking it up at our facility. See Section 14 for damage claims and the required claim window.
13. DELIVERY AND SHIPPING
Read this Section before you bid. Free delivery is available only for Lots meeting the value and distance conditions below. All other Lots ship at the Buyer's expense. Where a Lot listing states delivery or shipping terms that differ from this Section, the Lot listing controls for that Lot.
13.1 Two methods
Property is transferred to Buyers in one of two ways:
Free Local Delivery — curbside delivery by us, at no charge, for qualifying Lots within our delivery area (Sections 13.2–13.5); or
Shipping at Buyer's expense — for every other Lot, by a carrier or shipper arranged as set out in Section 13.7.
Local pickup is available free of charge to every Buyer regardless of Lot value or location (Section 13.8).
13.2 Free Local Delivery — qualifying conditions
All distances are measured from our premises at 35 Patrick Lane, Poughkeepsie, New York 12603 (the "Origin").
Free Local Delivery – any order within 20 miles of the Origin is free, no minimum
Delivery to Manhattan - any order exceeding $1,000, excluding buyer’s premium, qualifies for free curbside delivery within 80 miles of the Origin.
Delivery nationally – all orders can be shipped nationwide at the buyer’s expense & coordination.
How the qualifying amount is calculated. The minimum is measured against the combined hammer price of all Lots on a single invoice from a single sale, delivered together to one address. It excludes buyer's premium, platform surcharge, fees, and sales tax. Lots won in separate sales, or delivered to separate addresses, are not combined.
How distance is measured. Distance means driving distance from the Origin to the delivery address by the shortest practical route, as determined by Google Maps at the time your invoice is issued. Our determination of distance and zone is final.
Where the zones reach. Free Local Delivery ranges approximately from Kingston to Carmel. The 80 mile Zone extends into Connecticut, New Jersey, Pennsylvania, and Massachusetts. Sales tax is charged based on the delivery address (Section 10), not on our location.
13.3 What curbside delivery includes — and does not
Free Local Delivery is curbside only. It means we transport the Lot to your address and unload it at ground level at the curb, driveway, or nearest accessible point at which our vehicle can safely and lawfully stop.
Curbside delivery does not include:
Carrying the Lot into a building, garage, or yard;
Stair carry, elevator use, or room-of-choice placement;
Unpacking, assembly, installation, mounting, or hanging;
Removal of packaging, crating, or debris;
Removal or disposal of your existing furniture; or
Moving the Lot after it has been set down.
You must be present. An adult aged 18 or over must be present to accept and sign for the delivery. You are responsible for arranging any help you need to move the Lot from the curb, and for confirming in advance that the item will fit through your doors, stairwells, and hallways. Our personnel will not enter your property, and we are not liable for damage to the Lot, to your property, or for any injury occurring after the Lot is set down.
13.4 Scheduling, access, and failed delivery
We will contact you to schedule delivery within 14 business days of cleared payment. Delivery windows are estimates, and we are not liable for delays.
You are responsible for ensuring safe, lawful vehicle access to the delivery address. If our vehicle cannot reach the address — because of road restrictions, weight or height limits, gated or private roads, unplowed or unpaved access, or lack of legal parking — we may deliver to the nearest safely accessible point or reschedule at your expense.
If no one is present at the scheduled time, if access is blocked, or if delivery is refused, a failed delivery fee of $250 applies and redelivery is charged at $250. After 2 failed attempts, the Lot is returned to our premises, free delivery is forfeited, and storage charges under Section 13.8 begin.
13.5 Insurance and risk on local delivery
Free Local Delivery is performed by us or by a carrier we engage. Risk of loss passes as set out in Section 12.3. Claims for damage occurring in transit must be raised at the time of delivery, noted on the delivery receipt, and confirmed in writing under Section 14.
13.6 Courtesy mileage credit (discretionary)
For Buyers located beyond their qualifying zone, we may — entirely at our discretion, on a case-by-case basis — extend a courtesy credit equal to the mileage that would have been free had the address fallen within the qualifying zone, and charge only for the additional distance.
Where we offer this:
The charge will be quoted to you in writing and must be paid in full before delivery is scheduled;
The credit applies only to the invoice for which it is offered;
It creates no right, entitlement, or precedent, and we may decline it for any reason or none, including for Buyers we have accommodated previously.
Nothing in this paragraph obliges us to deliver outside our delivery area.
13.7 Shipping outside the delivery area
Lots that do not qualify for Free Local Delivery ship at the Buyer's sole expense.
We do not pack or ship. You must arrange packing and transport with a shipper of your choice. We are not responsible for the acts, omissions, delays, or charges of any shipper, whether or not we recommended them.
Additional conditions:
Buyer-arranged shippers must collect within 10 business days of payment, by appointment;
Oversized, heavy, or fragile Lots — furniture, case goods, large mirrors, stone, statuary, and chandeliers — generally require freight or blanket-wrap transport, which is significantly more expensive than parcel shipping. Obtain a quote before you bid;
We do not ship to P.O. boxes or APO/FPO addresses;
Shipping to Alaska, Hawaii, U.S. territories, and international destinations is quoted individually. All duties, VAT, customs charges, brokerage fees, and taxes are the Buyer's responsibility;
Address changes after payment may not be possible, and any additional cost arising from an incorrect, incomplete, or outdated address you supplied is chargeable to you.
13.8 Local pickup and storage
Pickup at the Origin is free and available to all Buyers by appointment within 10 business days of payment. Lots not collected within that window may incur storage of $10 per Lot per day, and after 30 days may be deemed abandoned and disposed of under Section 15, with no refund. Where state law requires it, sales tax may be charged on a paid Lot left uncollected beyond the statutory period.
13.9 Endangered species, restricted materials, and export
Antique property may contain materials from protected or endangered species — including elephant and other ivory, tortoiseshell, coral, whalebone, rhinoceros horn, crocodile and alligator skin, certain furs and feathers, and rosewood and other Dalbergia species — or other restricted materials. Such materials are regulated under CITES, the Endangered Species Act, the Lacey Act, the Marine Mammal Protection Act, the Migratory Bird Treaty Act, and various state laws. New York State law restricting the sale of ivory and rhinoceros horn is stricter than federal law and applies to sales made from our premises.
These Lots may not be shippable or deliverable at all, may require permits, and may be prohibited from export, from import into another country, or from shipment between U.S. states. It is your responsibility to determine the law applicable to you before bidding and to obtain any required license, permit, certificate, scientific test, or report, at your expense.
We will not cancel your purchase or refund the purchase price if a Lot cannot be exported, imported, or shipped interstate, if a permit is denied or delayed, or if the Lot is seized by any government authority. We do not warrant that we have correctly identified the materials in any Lot, and we assume no liability for identifying or failing to identify restricted materials.
Where a strap, mount, base, or accessory made of restricted material accompanies a Lot for display purposes, we may remove and retain it before shipment.
14. PACKING, DELIVERY, AND DAMAGE CLAIMS
We pack Lots with reasonable care. Packing methods are at our discretion.
Inspect your shipment immediately on arrival.
To make a claim for shipping damage or for a Lot lost in transit, you must:
Notify us in writing at chase@freeshippingauction within 2 business days of delivery (or of the carrier's scheduled delivery date, for a lost shipment);
Provide clear photographs of the damaged item, all packing materials, and the exterior of the carton or crate as received;
Retain all packaging and the item itself until the claim is resolved. Discarding packaging voids the claim; and
Note any visible damage on the carrier's delivery receipt at the time of delivery for freight shipments.
Claims made after the window closes, or without the required documentation, will not be accepted. Frames, glass, and mirror plate are excluded from damage claims. Our liability on any accepted shipping claim is limited as set out in Section 18 and will not exceed the total amount you paid for the affected Lot.
15. DEFAULT AND REMEDIES
If you fail to pay in full when due, or breach any of these Terms, we may, in addition to any other remedy available at law, exercise any one or more of the following, at our sole discretion:
a) Charge interest and all costs of collection, including reasonable attorneys' fees, to the fullest extent permitted by law; b) Charge the payment method on file for the full amount due; c) Cancel the sale of that Lot and of any other Lot sold to you at the same or any other sale, retaining any payments made as liquidated damages; d) Resell the Lot publicly or privately, with or without reserve, and hold you liable for any shortfall plus all costs, expenses, losses, damages, and commissions on both sales; e) Hold you liable for the full purchase price, including premium, fees, and taxes, and commence proceedings to recover it; f) Pay the consignor the amount due to them, in which case we succeed to all of the consignor's rights to pursue you; g) Disclose your identity and contact details to the consignor; h) Apply any money we hold for you, in this or any other transaction, against the amount owed; i) Retain as security any property of yours in our possession, in which you grant us a first-priority continuing security interest with all rights of a secured party under the Uniform Commercial Code as adopted in New York; j) Refuse your bids at any future sale, require a deposit before accepting them, ban you from our sales, and report the default to the bidding platform and to other auctioneers; and k) Store the Lot at your expense at $10 per Lot per day, and after 30 days treat it as abandoned.
16. LIMITED AUTHENTICITY GUARANTEE
This is the only warranty we give about a Lot, and it is a limited one.
If, within 21 days of delivery, the original Buyer of record establishes to our reasonable satisfaction that a Lot is a deliberate forgery — that is, an imitation created with intent to deceive as to authorship, origin, date, age, period, or source, which is described as authentic in the Lot title and is materially different in value as a result — we will rescind the sale and refund the hammer price and buyer's premium paid.
Conditions and exclusions:
The claim must be made in writing within the window, which is strict;
The guarantee applies only to the statements in the Lot title, as amended by any listing note or sale announcement — not to the body of the description, the condition report, or any photograph;
The Lot must be returned to us at your expense in the same condition as delivered;
On request, you must supply the written opinions of two recognized independent experts in the field, mutually agreed between us, at your expense. We may obtain further opinions at our own expense;
This guarantee does not apply where the Lot title matched the generally accepted opinion of experts at the time of sale, drew attention to a conflict of opinion, or where scholarship has since changed;
This guarantee does not apply where establishing the point would require a process that was not generally available or accepted at the time of sale, was unreasonably expensive or impractical, or was likely to damage the Lot;
This guarantee does not cover condition, restoration, repair, completeness, dimensions, function, grade, value, or any Qualified description (see the Glossary in Section 22);
The guarantee is personal to the original Buyer, requires that you still own the Lot free of any third-party claim, is not transferable, and expires on resale.
Your sole and exclusive remedy under this guarantee is rescission of the sale and refund of the amount you paid us. We are not liable for interest, shipping, expert fees, appraisal costs, storage, restoration, insurance, lost profit, or any other cost or loss.
Except as set out in this Section, all sales are final. We do not accept returns.
17. OUR RIGHT TO CANCEL A SALE
In addition to any other right of cancellation in these Terms, we may cancel the sale of a Lot, at any time and at our sole discretion, if:
(a) Any representation you gave under Section 7 is or becomes untrue; (b) We are not satisfied with the results of our identification, sanctions, or anti-money-laundering checks; (c) We reasonably believe that completing the transaction is or may be unlawful; or (d) We reasonably believe that completing the transaction may expose us or the consignor to liability to a third party or to reputational harm.
On cancellation under this Section our sole obligation is to refund any amount you have paid us for the Lot.
18. LIMITATION OF LIABILITY
To the fullest extent permitted by law, our total liability to you arising out of or relating to any Lot, any sale, or these Terms — whether in contract, warranty, tort (including negligence), strict liability, or otherwise — shall not exceed the total amount you actually paid us for the Lot in question.
We are not liable for any indirect, incidental, consequential, special, punitive, or exemplary damages, or for lost profits, lost opportunity, diminution in value, or loss of use, even if we have been advised of the possibility of such damages.
Nothing in these Terms excludes liability for our own fraud or fraudulent misrepresentation.
We owe no duty to any person other than the Buyer in connection with the purchase of a Lot. We are not responsible for the acts or omissions of carriers, packers, shippers, freight brokers, restorers, authenticators, graders, or other third parties, whether or not we recommended or engaged them.
We are not liable for delay or failure to perform caused by events beyond our reasonable control, including natural disaster, fire, flood, severe weather, war, terrorism, civil disturbance, labor action, epidemic, government action, carrier failure, or outage of utilities, internet service, or third-party platforms.
19. INTELLECTUAL PROPERTY
All catalogue text, descriptions, photographs, video, and other content we produce is our property and is protected by copyright. You may not copy, reproduce, or redistribute it without our prior written consent. We reserve the right to reproduce images of Lots we have sold for any purpose, including advertising and archival records.
Purchase of a Lot conveys no copyright, trademark, publicity, or reproduction right in or to the Lot or its design.
20. PRIVACY AND RECORDING
Information you provide is used to process registrations, sales, shipping, and payments, to meet legal and tax obligations, and to communicate with you about our sales. We may share it with payment processors, shippers, and the bidding platform as necessary.
We may record telephone communications and sale proceedings for training, security, and record-keeping. You may not record our sales without our written consent.
21. GENERAL PROVISIONS
Governing law. These Terms, and any non-contractual obligations arising from them or from any sale, are governed by the laws of the State of NEW YORK, without regard to conflict-of-laws principles.
Venue / dispute resolution. You submit to the exclusive jurisdiction of the state and federal courts located in Dutchess County, New York, and waive any objection to venue there.
Prevailing party. In any action to enforce these Terms, the prevailing party is entitled to recover reasonable attorneys' fees and costs.
Amendment. We may amend these Terms at any time; the version posted at the time you bid governs your purchase.
Waiver. No failure or delay in exercising any right or remedy operates as a waiver of it or of any other right or remedy, and no single or partial exercise prevents further exercise. A waiver granted in one case does not waive the provision generally or in any other case.
Severability. If any provision is found invalid, illegal, or unenforceable, it is treated as deleted or limited to the minimum extent necessary, and the remainder stays in full effect.
Assignment. You may not assign, or grant a security interest over, your rights or obligations without our written consent. We may assign ours freely. These Terms bind your successors and estate.
Entire agreement. These Terms, plus any Lot-specific listing notes and sale announcements, are the entire agreement between us on this subject.
Notices. Written notice to us must be sent to chase@freeshippingauction.com and 35 Patrick Ln. Ste. 3, Poughkeepsie, NY 12603.
22. GLOSSARY
Terms used in these Terms and in our Lot descriptions have the following meanings.
As Is — sold in its present condition, with all faults and defects, whether or not disclosed.
Buyer's Premium — the percentage of the hammer price payable to us by the Buyer in addition to the hammer price.
Estimate — our opinion of the range within which a Lot may sell. Low estimate is the lower figure, high estimate the higher.
Hammer Price — the amount of the highest bid we accept for a Lot, excluding premium, fees, and taxes.
Lot — an item or group of items offered for sale as a single unit.
Purchase Price — the hammer price plus buyer's premium, plus any platform surcharge, fees, duties, and applicable taxes.
Provenance — the ownership history of a Lot, as reported to us. We do not independently verify provenance and do not warrant it.
Reserve — the confidential minimum price below which a Lot will not be sold.
Qualified — a description limited by a clarification or by any of the terms below. Qualified descriptions are excluded entirely from the Limited Authenticity Guarantee in Section 16. In each case the phrase expresses our opinion only:
"Attributed to [maker]" — probably a work of that maker, in whole or in part.
"Ascribed to [maker]" — traditionally regarded as the work of that maker.
"Studio of" / "Workshop of" — probably executed under the maker's supervision.
"Circle of" — a work of the period, showing the maker's influence.
"School of" / "Follower of" — a work in the maker's style, by a pupil or imitator, not necessarily of the period.
"In the manner of" / "In the style of" — a work in that style, likely of a later date.
"After [maker]" — a copy or later cast of a known work.
"Cast from a model by" — from the maker's model, cast during their lifetime or shortly after.
"Bears signature" / "Bears label" / "Bears mark" / "Signed" — a signature, label, or mark is present; we do not warrant that it is genuine or contemporary with the object.
"Circa [date]" / "c. [date]" — approximately that date, typically within a range of [10–20] years.
"Period" — believed made in the period stated. "[Period] style" — made in the manner of that period, at a later date.
"Associated" — a component that did not originate with the object.
"Married" / "Marriage" — an object assembled from parts of two or more objects.
"Possibly" / "Perhaps" — a tentative suggestion carrying no assurance whatever.
