PLEASE READ THESE TERMS AND CONDITIONS CAREFULLY. THE BELOW TERMS AND CONDITIONS APPLY TO ALL WELTMAN & CO. ONLINE AUCTIONS. By bidding in this auction you acknowledge that you, the Bidder, hereby agreed to be bound by all of the terms and conditions of this auction, as described below. These terms and conditions and the information contained in any lot listing represents the whole agreement between Bidders or Winning Bidder (Buyer) and ("Weltman & Co."). Payment Conditions All items and land parcels must be paid for within 3 working days by the respective purchaser. Commission There is a 0% buyers Commission in all Weltman & Co. Online Auctions Shipping, Handling & Insurance Items will be shipped between 10 - 14 days of payment being cleared. Shipping and handling fees are calculated on a per lot basis and the fee indicated in the lot is the fee that the buyer will be charged. Multiple items will be consolidated for shipping but this will not change the shipping and handling fee. All shipments will be accompanied by a copy of your receipt and will be insured by Weltman & Co. to the full value of the shipment. Buyers are responsible for any restrictions, import duties, taxes and local processing fees. All shipments are quoted for standard shipping. If you would like to expedite your shipment please let us know when receiving your invoice and we will quote you on expedited shipping options. Disclaimer The lot value estimations on Weltman & Co auctions are made using a combination of Recommended Retail Prices, ArtNet and other valuation websites, prior auction estimations for the same or similar lots and third party appraisals from registered appraisers. Please note that whilst we try and give you the best possible estimation, these estimations are for INSURANCE REPLACEMENT VALUES of any lot and thus you must use your own judgment when bidding. Weltman & Co. cannot be held liable for any discrepancies relating to estimations indicated on lots. International Bidders Please be aware that our shipping rates in the items' descriptions are for shipping to United States addresses only. If you wish for your items to be shipped elsewhere, you will need to get a separate custom shipping quote from Weltman & Co. Please email us for more information. Returns All sales are final. There are no cancellations, returns or refunds. Under certain circumstances, we may make an exception and allow a cancellation, return or approve a refund or credit. However, in the case of a return the Buyer's Premium and Shipping Cost will not be refunded. Authenticity Promise: Every item sold by Weltman & Co. carries our authenticity promise! We make every effort to authenticate any inventory we buy or take on consignment and we are very conservative in our description and valuation of items. However, like anyone, our authenticators are fallible and on rare occasions one might slip through. That is why we offer an Authenticity Promise on all our merchandise. If you receive an item that is not authentic, as to its description in our catalog, we will take it back, pay for return shipping and issue you a full refund - even if the item has a no return policy! Authenticity must be checked by an approved retailer or expert and any authenticity return request must be made within 14 days of receipt of the item accompanied with a letter in writing from the aforementioned retailer or expert. After 14 days all sales are final. Cancelling a winning bid If a winning bid is cancelled for any reason and the winning bidder wishes to back out, a 10% fee will be charged to the defaulting buyer (non-performer) to cover the costs associated with listing and the non-performer may be blocked from future bidding. Damaged Goods If a purchase arrives and it is defective or damaged you will not be charged for return shipping and will be offered a replacement item or full refund if the oversight was ours. Prior to returning an item the customer must obtain a Return Authorization number from our Customer Service Department. Re-lists Occasionally you may notice that an item is re-listed. This can be due to a variety of reasons such as a winning bidder in a previous auction not paying for the item, multiple types of the same item or it is one of the few items listed with a reserve and the reserve was not met. Right to refuse bid Auctioneer reserves the right to reject any bid. The highest bidder as determined by the auctioneer shall be the purchaser. In the case of a disputed bid, the auctioneer shall have sole discretion in determining the purchaser and may also, at his or her election, withdraw the lot or reoffer the lot for sale. The auctioneer shall have sole discretion to refuse any bid, or refuse to acknowledge any bidder. The Auctioneer's decision to refuse any bid, advance the bidding in any manner, withdraw a Lot, determine a successful bidder, continue the bidding, to cancel a sale and re-offer and resell an item in dispute, is conclusive, absolute and final. Reserves Some of the lots in this sale are offered subject to a reserve. The reserve is a confidential minimum price, below which the lot will not be sold. In most cases, the reserve will be set below the estimated range, but in no case will it exceed the estimates listed. A representative of Weltman & Co. may execute such reserves by bidding on behalf of the consignor or owner. In any event and whether or not a lot is subject to a reserve, the auctioneer may reject any bid or raise not commensurate with the value of such lot. Breach of Sale If the buyer fails to pay in full with good cleared funds or fails to comply with the Terms and Conditions of the Sale as set forth herein, Weltman & Co. reserves the right to exercise one or more of the following remedies, in addition to any other remedies available to the Weltman & Co. by law: a) Hold the defaulting buyer liable for the full purchase amount due. b) Cancel the sale. c) Resell the property at public auction, or privately under such terms as Weltman & Co. deems appropriate, and the defaulting purchaser will be liable for any difference between the original purchase price and the final sales price. In addition, the defaulting buyer will be responsible for any costs incurred by Weltman & Co. including, but not limited to, handling, storage, commissions, insurance, administration, any and all legal fees, incidental damages and all costs relating to this transaction. d) Forbid the buyer from participating in any future auction. Item & Property Condition All items are sold "as is" and neither the auctioneer nor any consignor makes any warranties or representation of any kind or nature with respect to the property and in no event shall they be responsible for the correctness, nor deemed to have made any representation or warranty of description, genuineness, authorship, attribution, provenance, period, culture, source, origin or condition of the item and no statement made at the sale or in the bill of sale or invoice or elsewhere shall be deemed such a warranty of representation or an assumption of liability. Liability In no event will the liability of Weltman & Co. to any purchaser with respect to any item exceed the purchase price actually paid by such purchaser for such item.
