All bidders are required to read and agree to the following Terms and Conditions of Sale. CONDITION OF ITEMS: Beautiful Antique Jewelry LLC may include opinions of the condition of items for sale in the auction listing as courtesy. We are not professional restorers or conservators, and therefore cannot guarantee the content in the written report. Items sold can be of considerable age and therefor, will usually show signs of wear and use. Any lack of any reference to an items condition, does not imply that the item is free from defect, wear and tear, imperfections and/or in perfect condition. Beautiful Antique Jewelry LLC, nor its consignor(s), make any warranties or representations regarding: size, quality, sale ability, correctness of the catalogue, medium andor material, rarity, importance, genuineness, attribution, provenance, period, origin andor exhibitions, age, and historical significance of any item sold, express or implied. Buyer expressly acknowledges and agrees that under no circumstance should the Auctioneer, its officers, agents, or employees be liable for any damages including, without limitation, any compensatory, incidental, or consequential damages. Beautiful Antique Jewelry LLC reserves the right to withdraw any item before, or during the sale and shall have no liability whatsoever for withdrawal of items. No comments, written or oral, made in the bill of sale, catalogue, advertisement, by the auctioneer or employees, shall be deemed to create any warranty, representation, or assumption of liability. Beautiful Antique Jewelry LLC does not warrant that copyright or reproduction rights to any item sold, are available or included. Beautiful Antique Jewelry LLC does not warranty that any item for sale complies with any Governmental rules, ordinances, or regulations, of any kind. Beautiful Antique Jewelry LLC cautions buyers that items containing wood, coral, ivory, shell, animal parts, or any item presently on an endangered species list, regardless of the age or antique nature/status of the item, may have severe importexport restrictions and limitations, including shipping restrictions imposed at the country/state/county/and even city level. Shipping of said items may be subject to fines, and may be subject to confiscation by customs or governmental entities. It is the buyer’s responsibility, before bidding, to determine if the item can be shipped to the buyer’s location, as Beautiful Antique Jewelry LLC cannot possibly keep track of every city, county, state, and country limitation, nor ascertain which bidder will be the successful bidder and advise them of their local rules before bidding. If prior to shipping, Beautiful Antique Jewelry LLC discovers that shipping an item to the buyer’s location would violate any law or regulation, Beautiful Antique Jewelry LLC will rescind the sale of the item. Beautiful Antique Jewelry LLC will not be responsible for seizure of items by any governmental official. Beautiful Antique Jewelry LLC reserves the right to reproduce any images of item sold in the catalogue. Additional photographs for any given item may become available and can be uploaded to the Live Auctioneers page that corresponds to the item at any time. APPRAISALS AND THIRD PARTY OPINIONS OF VALUE: Beautiful Antique Jewelry LLC acquires a third party Retail Replacement Value Appraisal for all jewelry items with a starting bid of $1000 or greater. The appraisals are written for insurance purposes and include cost to remake the jewelry item, with components of equal quality and kind, at the time of appraisal. Please note insurance appraisals do not adjust for antique and vintage items. Appraisals are conducted by an independent 3rd Party, who is a GIA Gemologist. Appraised value should be considered for insurance purposes only, as jewelry prices can vary based on retail seller, item location in the world, and market conditions. Beautiful Antique Jewelry LLC is not responsible for the opinions of any of the third-party. AUCTIONEER RESERVES THE RIGHT TO: The Auctioneer reserves the right to refuse a bidder to participate in any auction, reject any bid, withdraw any item, to cancel the auction, to advance the bidding in any manner he or she may decide, and in the case of error or dispute (during or after the sale), to determine the successful bidder, or to reoffer and resell the item in dispute. Auctioneer has final discretion to determine the successful bidder. If a dispute arises after the auction, the sale record of Beautiful Antique Jewelry LLC shall be conclusive. If the auctioneer determines that an opening bid is not commensurate with the value of the item, he or she may reject the bid and withdraw the item from the auction. If having accepted an opening bid, the auctioneer decides that any advance thereafter is not of sufficient; he or she may reject the advance and withdraw the item from the auction. BIDDING: All bidders are required register with LiveAuctioneers.com and provide a valid name, billing address, phone number, and email address. Beautiful Antique Jewelry may require the bidder to contact our office to verify bidder information and or provide identification before being approved to bid. Bidders agree to be fully liable for any item, including all taxes, shipping, and other applicable charges, that is the subject of a successful bid submitted by the bidder, in accordance with the Terms and Conditions of Sale, and to pay for the item within 7 days of auction close. All items must be paid for in U.S. dollars. Beautiful Antique Jewelry LLC does not accept telephone bids. Absentee bids may be placed using Live Auctioneer.com. Beautiful Antique Jewelry LLC does not accept liability for equipment failure, software malfunctions, power failures, or inability to access to the internet. All items will be sold in numerical order according to the catalog. The range of estimates provided on each item, should not be relied upon as a determination of the actual sales or resale value. Beautiful Antique Jewelry LLC does not charge currently charge a buyer’s premium. Beautiful Antique Jewelry LLC does not do business with or ship to the following countries: Africa, Belarus, Brazil, Burma, Cambodia, Congo, Cuba, Germany (limited to items 100+ years of age), Gibralter, India, Indonesia, Iran, Iraq, Israel, Italy, Lebanon, Liberia, Lithuania, Myanmar, North Korea (Democratic People's Republic of Korea), Pakistan, Republic of Georgia, Russia, Saudi Arabia, Serbia, Sudan, Syria Turkey, Ukraine, Vietnam, Yugoslavia, or any other US Government prohibited countries. Bids from these countries will be rescinded. These Terms and Conditions of Sale, our respective rights and obligations, and the Buyer's rights and obligations; shall be governed, construed, and enforced in by the laws of the State of Arizona. By bidding at an auction, each bidder agrees to be bound by these Terms and Conditions of Sale. Any dispute, controversy, or claim arising out of, or relating to this agreement, its validity, breach, or termination, brought by or against the Auctioneer, Consignors, or the Buyers shall be resolved by legal action brought in Maricopa County, Arizona as the sole place for jurisdiction and litigation of any issues between the parties. The Buyer's sole and exclusive remedy is the rescission of the sale and the refund of the original purchase price. If any part of the Terms and Conditions of Sale is found by any court to be invalid, illegal or unenforceable, that part shall be discounted and the rest of the conditions shall continue to be valid to the fullest extent of the law. Any and all of conditions, contained herein, may be modified or waived at the sole discretion of Beautiful Antique Jewelry LLC. Please ask any questions before placing a bid and bid responsibly. RESERVES: Some items offered for sale can be subject to a reserve, which is a confidential minimum price, below which the item will not be sold. Reserves are set based on an agreed upon price with consignors, or at the discretion of Beautiful Antique Jewelry LLC. For items that are offered without reserve, the auctioneer, at his or her discretion, will usually open bidding at 60-75% the low estimate for the item, unless there are already competing bids. In the absence of bids, the auctioneer, at his or her discretion, may decrease the bid until a bid is recognized, and then continue up from that amount. For items with a reserve, the auctioneer may open the bidding, below the reserve by placing a bid on behalf of the consigner or seller. On reserve items, the auctioneer may continue to bid up to the amount of the reserve, on behalf of the consigner or seller. PAYMENT: Payments must be made within 7 days of auction close, by bank check, cashier’s check drawn on a U.S. bank, wire transfer (buyer is responsible for senders wire transfer fee), Postal Money Order, or by Paypal. Payments via Paypal, require us to ship to your billing address, (Paypal Confirmed Address). Payments by Paypal are subject to a $5000 maximum. Invoices will be sent via email, within 48 hours of auction close. The invoice will include a link that allows you to pay immediately and securely online. Beautiful Antique Jewelry LLC will hold merchandise purchased by check or Postal Money Order, until the check/money order has cleared the auctioneer’s bank and has been deemed to be authentic. The purchaser agrees to pay Beautiful Antique Jewelry LLC a handling charge of $35 for any returned check. Beautiful Antique Jewelry LLC reserves to right to request certain items are paid for only by Postal Money Order or Bank Wire Transfer. If payments are not received in 14 days or if any of the Terms and Conditions of Sale are not complied with by the buyer, Auctioneer at its' discretion may either (A) cancel the sale, retaining as liquidated damages all payments and deposits made by the Buyer or (B) resell the item either privately, publically, or at public auction without reserve and in either event the Buyer will be liable for any deficiency in the purchase price and all costs and expenses, including attorney fees and incidental damages, (C) to hold the defaulting buyer liable for the total amount due and begin legal proceedings for its recovery together with interest, legal fees and costs to the fullest extent permitted under applicable law, (D) to take other action as we find necessary or appropriate. Beautiful Antique jewelry reserves the right to not allow future bids, at any auction, by or on behalf of the buyer, for any defaulting bidders. If any item cannot be delivered in the same condition as at the time of sale, for any reason, including but not limited to theft, fire, damage, or loss prior to delivery, Beautiful Antique Jewelry LLC will only be liable for the amount paid by the purchaser. International Customers: Rules regarding duty vary by country. Quite a few countries do not charge duty on antiques that are 100 years or older. Your countries custom office would know if any duty or import tax exists for your specific country. The customer is responsible for payment of any duty or import tax. We will not mark a package as a gift on the customs form. We will declare full value. We require a phone number on international shipments, so that your customs office can contact you if they need to. Please be advised that clearing customs and international shipping can have delays that are completely out of our control and we cannot guarantee international packages will arrive by a specific date. TAX: Unless exempted by law from the payment thereof, by providing a valid U.S. tax resale certificate, the buyer will be required to pay retail sales taxes at the rate of 8.8% for any purchases being shipped to an address within the State of Arizona. Deliveries outside the State of Arizona may be subject to Use Tax, Federal Luxury Tax, and/or any other taxes imposed by the buyer’s state, county, and/or Municipality / City are the responsibility of the buyer. Any customs import tax, VAT, or import duties are the responsibility of the buyer. RETURNS – RIGHT OF RESCISSION: If within 30 days of the auction, the buyer gives written notice to Beautiful Antique Jewelry LLC, claiming that the item’s creator, period, origin, or composition varies significantly from the item’s title andor description appearing in the auction catalog (at the time of auction), and within 7 days of written notice, the buyer returns the item to Beautiful Antique Jewelry LLC in the same condition as when the item was sold, the sale will be rescinded and the buyer will be issued a refund of all monies paid, less original shipping. It is STRONLY recommended all items be returned with insurance and tracking. It is also STRONGLY recommended that shipments never be placed in a shipping receptacle drop box. Instead, we recommend handing the shipment to the shipper, watching them scan the item in, and if possible obtaining a receipt. Some shipping insurers’ coverage will not go into effect until the item is scanned into the shippers system. Beautiful Antique Jewelry LLC reserves the right to require the buyer obtain, at the buyers expense, a written report by recognized expert in the field, detailing how the item varies significantly from the items description in the catalog at the time of sale. Beautiful Antique Jewelry LLC STRONGLY recommends that buyers NEVER allow anyone to place precious metal testing acids directly on any item. Doing so can severely and permanently damage an item. Items damaged in this manner cannot be returned. Items that have been altered or used may also not be returned. After 30 days, from the date of the auction, all sales are final. SHIPPING: All items will be available for shipping after payment has been received in full. Shipping and handling costs are the responsibility of the buyer and shipments require tracking. All items must be shipped within 5 days of payment. Shipping is available through: BeautifulAntiqueJewelry LLC, as a convenience to our bidders, provides shipping services to both domestic and international locations. We ship all items with tracking and REQUIRE an adult signature on purchases of $250 or more. If paying by Paypal, we will only ship to the Paypal Confirmed Address. Will call pickup of items is not allowed. Prices are as follows: Shipping Insurance: $1 for every $100, on all items $200 or greater. Insurance on items $200 and greater is required. Small Items including: Jewelry, Coins, Gems, and items small enough to fit in a Small Sized Priority Mail Box - $12. If paying by check, postal money order, or bank wire we will combine items to save on shipping. Items purchased by Paypal, can only be combined if appearing on the same invoice. Combining items in the same shipment may require the next size up of box, in order to provide enough room for the items and padding. Medium Sized Items including: small pictures, books, and other mid-sized collectables - $22. Large Sized Items or Odd Shaped Items including: paintings, furniture, lamps – Quote on Request. International Shipping: Based on Location, prior shipments have typically ranged from $20-$45. Expedited Shipping: Quote on Request. Packing and handling of items, by Beautiful Antique Jewelry LLC, is at the risk of the purchaser, and Beautiful Antique Jewelry LLC assumes no liability of any loss or damage to items. FAILURE TO SHIP PURCHASES: Items not shipped within 12 days following the auction, may incur, at Beautiful Antique Jewelry LLC’s discretion, a charge of $5 per item, per day, for storage, payable by the buyer. Beautiful Antique Jewelry LLC assumes no responsibility for damage to items left on premises for more than 7 days after the auction. Items that removed from premises after 30 calendar days will be charged an administration fee of $50. Items that have been paid for, but not removed from the premises for more than 60 calendar days, will be sold. Any funds recovered in excess of storage and administration fees will be returned to the original buyer.
