The following defined terms are used in these conditions:
“ECA” means Ely Cathedral Auctions.
The buyer's premium is 10% (VAT inclusive) on the first £10,000 of any individual lot, thereafter it’s 8%.
It is the responsibility of the buyer to ensure that import of any lot is allowed into his country and to manage all the relevant customs duties.
No part of the auction may be reproduced or stored in any other website or included in any public or private electronic retrieval system or service without ECA’s prior written permission.
Any rights not expressly granted in these conditions are reserved.
Any representation or statement by ECA (including in any catalogue) as to authorship, genuineness, origin, date, age, provenance, condition or estimated selling price is a statement of opinion only. Prospective buyers must satisfy themselves as to all such matters. Neither ECA or its employees or agents nor the vendor accept liability for the correctness of such opinions and all conditions and warranties, express, implied or statutory are hereby excluded.
The ownership of any lot purchased shall not pass to the relevant buyer until they have made payment in full to ECA of the total amount due.
If any lot is not paid for in full, or if there is any other breach of these conditions, ECA as agent for the vendor shall be entitled to exercise all or any of the following rights and remedies:
(a) to proceed against the buyer for an action for debt or damages for breach of contract;
(b) to rescind the sale of that lot and/or any other lots sold by ECA to the defaulting buyer;
(c) to retain that or any other lot sold to the defaulting buyer until that buyer pays the total amount due;
(d) to reject or ignore bids from the defaulting buyer at future auctions or to impose conditions before any such bids shall be accepted.
Any lot which proves to be a deliberate forgery may be returned to ECA by the buyer within 21 days of the auction provided it is in the same condition as when bought, and is accompanied by particulars identifying it from the relevant catalogue description and a written statement of defects. If ECA is satisfied from the evidence presented that the lot is a deliberate forgery ECA shall refund the money paid by the buyer for the lot (but not the amount of any consequential loss, damages, expenses or interest).
ECA offers a tracked and insured shipping service; the price is outlined for each lot, and postage will be combined on request. The buyer may use their own shipping company, and ECA will provide details of shipping agents on request. ECA disclaims any liability for the actions of third-party shipping agents.
