Knox Auction Co. auctions are conducted in compliance with section 2328 of the Commercial Code, section 535 of the Penal Code and the provisions of the California Civil Code. The terms and conditions outlined here apply to any and all sales made by Knox Auction Co. By participating in the auction you agree to be bound by these terms. With the exception of property owned and offered for auction by Knox Auction Co. the majority of items offered are consignments. Knox Auction Co. acts as an agent for the consignor (seller). The contract for sale is made between the buyer and the seller. Prior to auction all prospective buyers or their agents are advised to carefully inspect the items in which they are interested. A preview period will precede each auction. All items are sold AS IS. It is the prospective buyer's responsibility to thoroughly examine each item and to be aware of its condition etc. prior to bidding. Further information and additional digital photographs will be provided for lots upon request. Every effort will be made by Knox Auction Co. to accurately describe and report the condition of the items offered for sale. However, no guarantee or warranty is offered with respect to size, condition, rarity, importance, medium, provenance, materials or age. Any reported measurements are approximate and may not be precise. If a sold auction item is offered and described as being created by a certain artists, author or company and it is later determined to be a counterfeit, forgery or copy, then the Knox Auction Co. will offer a conditional guarantee for 30 days. To qualify for this guarantee the buyer must provide documentation from a qualified impartial authority, expert or appraiser. This guarantee is non-transferable. Registration before bidding: All prospective buyers must register prior to bidding. All prospective buyers must provide a credit card or check and identification prior to bidding. The Knox Auction Co. auctioneer has the right and discretion to refuse any bid, to advance the bidding in any manner as he may decide. The auctioneer may reject bids below reserve, insufficient advances, or bids from questionable bidders. In the case of any error or dispute the auctioneer will determine the successful bidder or withdraw the item and re-offer it. All sales are final. Absentee bidding and telephone bidding is available if prearranged at least 24 hours before auction day. A pre-approved payment method must be provided. A buyer's premium of 14% will be added to the final bid price of each item. Online bidders using liveauctioneers.com must pay an additional 3% buyer's premium. All successful bidders must pay all applicable sales taxes. We reserve the right to withdraw any lot at anytime. Reserve Price: All lots offered are subject to a reserve. The reserve is the confidential minimum selling price which the item will be sold. The reserve price will not be below the low auction estimate. The auctioneer may open the bidding with a bid below the reserve price on behalf of the seller. The auctioneer may continue to bid on behalf of the seller up to the reserve price, either by bidding in response to other bidders or by bidding consecutively. In the event that the Knox Auction Co. has interest or ownership of an item the auctioneer may bid up to the reserve price to protect interest. In the event of any bidding dispute the auctioneer has discretion to settle the dispute or to reject all bids on an item and to re-offer or withdraw an item. Subject to the auctioneers discretion, the highest bidder accepted by the auctioneer will be the buyer and the striking of the hammer marks the acceptance of the highest bid and the conclusion of a contract for sale between the seller and the buyer. Payment Options: On site bids: Full payment must be made the day of sale. Accepted methods of payment are cash, debit and credit cards and approved checks. Check must be drawn from a U.S. Bank Absentee and Phone Bids: Full payment must be made within 7 days of sale. Accepted forms of payment are, check, credit card, debit card, wire transfer, money order or cashier's check. Knox Auction Co. reserves the right to hold sold items until checks clear the bank. Buyers are responsible for shipment of merchandise including all packing, insurance and applicable fees. Knox Auction Co. will only pack and ship under special circumstances. Knox Auction Co. can provide contact information for recommended independent shippers upon request. Preferred shipper is the Carlsbad UPS Store #4460. Laws and Jurisdiction: The above terms and conditions of sale and terms of guarantee, as well as the bidders', the purchasers and our respective rights and obligations, shall be governed by and interpreted and enforced by the laws of the State of California. By bidding at an auction or agreeing to purchase, whether in person, or by agent, absentee bid, online, telephone or other means, the buyer shall be deemed to have consented to the exclusive jurisdiction of the state court of and the federal courts sitting in the State of California.
