All registered participants in this 'live' online auction event will be bound by and do willingly accept all our terms and conditions. Prior to bidding, each registered participant should carefully review them. Likewise, all absentee bidders will be bound and do willingly accept all the terms and conditions, prior to placing their bids. California (CA) Sales Tax, if applicable. All prices listed are in U.S. Dollars. FREE SHIPPING* is only available within the lower 48 U.S.A. States, including Alaska and Hawaii for this event. INTERNATIONAL SHIPPING* (not including custom duties, fees, and taxes) is available at a discounted, flat shipping cost of $59.95 US Dollars, for shipments with a value of $100 - $50,000 US Dollars. In case we are unable to ship to a particular destination for any reason, we will inform the buyer and we reserve the right to cancel the transaction; in case a payment has already been received, it will be fully refunded back to the buyer, in its original form of payment as soon as possible. Invoice will be issued via email within 24-48 hours after the auction event; buyer's full payment must be received within the next 5 days, from the day the invoice was sent to the customer. Customer is responsible to make sure to check his or her email on a timely manner, to make sure that he or she received the emailed invoice. In case the customer did not receive it on time for any reason, the customer needs to contact and inform Fancy Auctions right away. Accepted forms of payment for domestic bidders within the U.S.A. with invoices with a total amount of $3,000 US Dollars or under: Bank wire transfers or credit cards - Visa, MasterCard, Discover, American Express, JCB, or Diners Club International (payments are processed by Authorized.net gateway and Bank of America). For invoice amounts over $3,000 US Dollars, we accept payments through bank wire transfers ONLY; credit card payments will NOT be accepted. Our bank wire transfer information will be noted on the invoice or may be requested by our customers right away in order to make their payments. To secure our customer's credit card payment transaction, we require that the ship-to address be the same as the credit card's billing address or the ship-to address also be on file with the credit card company. Address verification will be done to help successfully secure credit card payment transactions. On the other hand, for international bidders, effective immediately, we can ONLY accept payments via bank wire transfers; credit card payments will NOT be accepted. All purchased lots will be shipped via United Parcel Service (UPS), Federal Express (FedEx), or United States Postal Service (USPS); No on-site pick-up is allowed, for insurance purposes. An Adult Signature Confirmation is required on the shipment's delivery. Although we do our best to ship the packages as soon as possible, shipments will normally be done within 1 to 7 business days from the time the buyer's full payment has been received and cleared by the bank. All items are sold as is; all sales are final; no credits; no exchanges; no express or implied product warranty is given at any time by Fancy Auctions and/or its employees and representatives. In general, there will be no returns nor refunds. Gold jewelries are shipped in a jewelry pouch, box, or case. Gold jewelries are all genuine 14K gold (no appraisal reports included). We recommend and highly encourage interested buyers to fully conduct their own review and due diligence on the lots to come up with their own assessments prior to bidding. In general, all values noted in each lot are only estimates and only opinions of Fancy Auctions. Value estimates do not necessarily represent actual values of items that may be identical, comparable, or similar to the lots. In general, the images online are different from their actual size; many images are larger in order to show the details of the items. In addition, colors may vary depending upon the computer monitor setting. All weights and measurements noted in each jewelry lot are approximate values only. Value estimates do not represent actual values of items that may be identical, comparable, or similar to the lots. Should there be any errors, such as typographical errors, Fancy Auctions reserve the right to correct them as soon as possible. All prospective buyers will take the responsibility to determine any lot's features and value (estimated and/or actual value). Should any prospective buyer require from us absolute certainty regarding any lot's information and description, including absolute certainty on its value, we ask the prospective buyer not to place any bid. In no event shall Fancy Auctions be liable under any circumstances for any incidental or consequential damages relating to a lot's purchase, delivery, non-delivery, or any other acts related to the sale. Fancy Auctions' liability for any breach or omission will in no event exceed the amount paid by the buyer to purchase the item or lot from Fancy Auctions. Fancy Auctions' liability cannot exceed the total invoiced amount of the purchase. Fancy Auctions reserves the right to withdraw any lot listed, at any time before, during and/or after the event, without any liability. Fancy Auctions also reserves the right to relist any lot in its own discretion, in the event of an error on Fancy Auctions' part to mistakenly declare the item as sold. Fancy Auctions reserves the right to adjust the prices of lots pertaining to gold jewelry, at its own discretion at any time, at least 3 hours before the auction event, to reflect any significant change in gold market pricing. On the other hand, Fancy Auctions also reserves the right not to change or not to adjust the prices of lots pertaining to gold jewelry, despite any changes in the gold's market price. Fancy Auctions' sale of record is absolute. The highest bidder acknowledged by Fancy Auctions is the successful bidder. In the event of a dispute on the bid, Fancy Auctions will have the final discretion as to whether the item in dispute will be relisted. In the event of a dispute among bidders, Fancy Auctions will have the final discretion to determine the successful bidder and to reject any bid at any time. Fancy Auctions also reserves the right to exclude any person or bid before, during and/or after the auction event. All bidders assume full responsibility on their respective accounts. Any bid made on a bidder's account during our auction event will bind the bidder to our terms and conditions. At the fall of the hammer, the bidder assumes full responsibility on his entered bid. Moreover, bidder takes full responsibility on any bid placed by mistake or error, since bids cannot be cancelled. All bids are binding and irrevocable. The following will be added to 'successfully placed bids' on the sale of each lot and will be invoiced accordingly: buyer's premium of 15%, shipping cost with full shipping insurance coverage based on the hammer price won, and any local sales tax that is applicable. CA Sales Tax will be added to the invoice, if applicable (a valid resale certificate will need to be provided for any request for the removal of the CA Sales Tax, for as long the State of CA allows such application). All shipments upon delivery will require an adult's signature confirmation; no signature waivers from the buyer can be applied. At all times, Fancy Auctions reserves the right to determine and keep confidential a reserve price for each lot in its catalog. At any time during the auction event, Fancy Auctions also reserves the right to reduce its reserve prices with or without any notice to its bidders. At its own discretion, Fancy Auctions may choose to accept a bid below the reserve price, should all bids placed be below the reserve price. There may also be times when the lots are deemed passed or unsold, when their respective reserve price has not been met. The auction details pertaining to each lot in regards to its starting bid price, estimates and the bid increments are noted within each lot's listing. Please review them prior to bidding and conduct your own due diligence to come up with your own price assessments and/or value estimates. Should you disagree with any of the price and descriptive details noted for each lot, we would recommend for you not to place any bid. Lots may be relisted by Fancy Auctions for the following possible reasons: reserve price not met, lot not sold, non-payment of winning bid, incomplete payment of winning bid, any type of listing error, or there are multiples of the same item. Fancy Auctions reserves the right to cancel the remainder of the auction event, should there be any concern regarding internet connection. Fancy Auctions will not be liable in any way, in an unlikely event that the internet connection be lost or terminated for any reason. For bidders within the U.S.A., accepted payment forms for invoice amounts of $3,000 US Dollars or less: Bank wire transfers or credit cards (Visa, MasterCard, Discover, American Express, JCB, and Diners Club International); payments are processed by Authorized.net gateway and Bank of America. For payments over $3,000 US Dollars, we accept payments through bank wire transfers ONLY (credit card payments will not be accepted). For international bidders, we can ONLY accept bank wire transfer payment regardless of the total invoice amount; no credit card payment will be accepted. Normally, within 24-48 hours after the auction, buyer should receive via email from Fancy Auctions with an invoice noting the total amount due for payment. Upon receipt of the invoice, buyer's full payment of the total amount noted on the invoice, must be received within the next 5 business days. Fancy Auctions reserves the right to hold any shipment until full payment has been received and cleared to the satisfaction of Fancy Auctions and Bank of America. To secure our customer's credit card payments, we require that the ship-to address be the same as the credit card's billing address or the ship-to address also be on file with the credit card company. In case, we do not receive the full payment of the buyer on time, Fancy Auctions reserves the right to cancel the transaction and refund the partial payment received from the buyer back to its original form of payment, deducting any bank transaction fees or charges associated in the transaction, after the deadline of 5 business days have passed (from the time the invoice was sent to the buyer). In reference to wire transfer refunds due to incomplete payment, the buyer who sent the incomplete payment will be charged any applicable bank transaction fees for Fancy Auctions to wire the partial payment back to the buyer's bank account; the bank transaction fees will be deducted to the refund accordingly. And, in regards to refunds to be issued back to the customer's credit card due to incomplete payment, should there be any credit card transaction fees, they will be deducted from the amount of refund, accordingly. Although we do our best to ship the package as soon as possible, normally, shipments are done within 1 to 7 business days from the time the buyer's full payment has been received and cleared by the bank. Buyers will be informed by Fancy Auctions via email, in regards to the shipping company who has been assigned to deliver the item (e.g., USPS, Federal Express, or USPS), the date of shipment and the expected date of delivery to the recipient's address. Fancy Auctions reserves the right to choose the manner of shipment and buyer agrees to be responsible for the payment of the shipping cost (if free shipping offer does not apply). All purchased lots will be shipped; no on-site pick-up is allowed, for insurance purposes. In any event that Fancy Auctions is unable to make the shipment or deliver, Fancy Auctions reserves the right to cancel the sale and its liability will always be limited to the sum actually paid by the buyer and as such, Fancy Auctions will inform the buyer and refund the full amount received from the buyer, back to its original form of payment, as soon as possible. International bidders will always be fully responsible to comply with all custom requirements, duties and taxes on their purchased lots for delivery to their country of destination. At Fancy Auctions' discretion, Fancy Auctions may choose to make an exception and choose to accept a return from the buyer and issue a refund to the buyer of the amount paid excluding the buyer's premium, excluding shipping charges, and at the same time deducting from the refund a 20% restocking fee based on the hammer price; buyer will be responsible for the cost of the return shipment (with full shipping insurance coverage based on the hammer price); refunds will only be issued after Fancy Auctions receives and completes its inspection of the item returned. Item returned should be in its original condition, as previously received by the buyer. No C.O.D. return shipments from the buyer will be accepted by Fancy Auctions. All unauthorized returns will be rejected or refused by Fancy Auctions. Free shipping offers from Fancy Auctions do not apply to customer's return shipments. ALL CLAIMS AND DISPUTES ARISING OUT OF ANY AUCTION EVENT INVOLVING FANCY AUCTIONS AND A REGISTERED BIDDER ARE TO BE SETTLED BY BINDING ARBITRATION IN THE STATE OF CALIFORNIA, COUNTY OF LOS ANGELES. THE ARBITRATION SHALL BE CONDUCTED ON A CONFIDENTIAL BASIS PURSUANT TO THE COMMERCIAL ARBITRATION RULES OF THE AMERICAN ARBITRATION ASSOCIATION. ANY DECISION OR AWARD AS A RESULT OF ANY SUCH ARBITRATION SHALL BE IN WRITING AND SHALL PROVIDE AN EXPLANATION FOR ALL FACTS AND CONCLUSIONS OF LAW AND SHALL INCLUDE THE ASSESSMENT OF COSTS, EXPENSES, AND REASONABLE ATTORNEYS FEES. ANY SUCH ARBITRATION SHALL BE CONDUCTED BY AN ARBITRATOR EXPERIENCED IN THE JEWELRY INDUSTRY OR HAVING SUFFICIENT LEGAL EXPERIENCE REQUIRED FOR ARBITRATION. THE PARTIES RESERVE THE RIGHT TO OBJECT TO ANY INDIVIDUAL EMPLOYED BY OR AFFILIATED WITH A COMPETING ORGANIZATION OR ENTITY. ANY ARBITRATION AWARD SHALL BE CONFIRMED BY A COURT OF COMPETENT JURISDICTION WITHIN LOS ANGELES COUNTY. Should any of the terms and conditions be void or unenforceable under applicable law, they will be modified to comply with applicable law, without affecting the enforce-ability of the remaining terms and conditions that are valid. Once again, should any registered participant disagree with any of our terms and conditions, we ask the registered participant NOT to bid on any of our lots. Should any registered participant have any questions or need any clarification regarding our terms and conditions and/or any of our listing, we encourage the registered participant to contact us at least three (3) hours before the scheduled auction; we'll do our best to give them an answer as soon as possible, hopefully before the auction event. But if, for any reason, we were not able to reply to the registered participant's inquiry on a lot before the auction, or if the participant still has questions or still needs clarification regarding any of our terms and conditions and/or lot during the auction, we ask that participant NOT to bid.
