Local taxes apply, Missouri 8.631% Terms & Conditions of Sale The lots listed in this catalog will be offered by Waca Auctions, LLC, hereafter referred to as Waca Auctions, as owner and consignor subject to the following terms and conditions. By bidding at auction you agree to be bound by these Conditions of Sale. Purchase Buyer shall pay the Purchase price, and such other fees as may be due, in full, within seven (7) days of the auction sale. Sale is not final and property will not be released to Buyer until good funds for all amounts due, are received by Waca Auctions. No lot shall be transferred by Buyer to another person until the sale is final. In the event of partial payment for any lot or lots we shall apply payments, in our discretion, to the lot or lots we select. The Buyer grants Waca Auctions a security interest in the purchased Property, and we may retain as collateral any property purchased and any funds in our possession, to secure a Buyer's obligations to us, if any. All fees, taxes, premiums or other sums due and not paid pursuant to this paragraph shall bear interest at 1.5 % per month from the 8th day following the sale to the date paid in full. Collection of Property Upon transfer of title, Buyer assumes full responsibility, including risk of loss and damage, for the Property. Purchased property shall be removed at Buyer's expense within fifteen (15) days after the sale becomes final. Property not removed shall be subject to a service fee of $50, and a storage fee, if retained by Waca Auctions, of 1% of the purchase price per month. Waca Auctions may also, in its sole discretion, elect to place the Property in a public storage facility at the Buyer's sole risk, responsibility and expense. If Waca Auctions determines an item needs to be removed from the Live Auctioneers' End of Auction report for any reason, Waca Auctions reserves the right to have the item removed without the Buyer’s approval and be released from any commission charges for said item(s) to Live Auctioneers. In doing so the item will be removed from the Buyer's Live Auctioneers' Dashboard/Shopping Cart. Furthermore, any payments collected for said item(s) will be refunded in full to the Buyer. To be completely clear: Waca Auctions does not need permission from the Buyer to remove an item from the End of Auction report. This will immediately release the Buyer from any financial obligation to Waca Auctions, and also immediately release Waca Auctions from any financial obligation or commission charges to Live Auctioneers on lots/merchandise that are undeliverable to the Buyer. Shipping Shipping will be handled by the Buyer. Our responsibility for damage to or loss of any lot ends once it has been turned over to the Buyer’s shipping enterprise for delivery and/or packing. By bidding, the winning Buyer agrees that any and all claims for loss or damage to the lot will be handled solely through the insurance claims process (if insurance was available) or the carrier and acknowledges that insurance may be subject to deductibles or other limitations which are not the responsibility of Waca Auctions. Waca Auctions is not responsible to any loss resulting from items being shipped to an alternate address or recipient provided by Buyer. Waca Auctions lists UPS as a preferred shipper, but Buyer may choose an alternate service such as FedEx or USPS. Waca Auctions will not entertain shipment using lower classes of mail due to the increased risk of loss. Lots are available for pick-up by the Buyer’s contracted shipper during business hours M-F, 9-5 cst. No items will be shipped to any Buyer for any particular auction until all charges for the auction have been paid in full and all funds have cleared. Even if paid in full, no items will be shipped to any Buyer for any particular auction if the Buyer has any balances with Waca Auctions from other auctions which are not in compliance with the provisions of payment above, until such balances are paid in full and all funds have cleared. High and low estimates are provided solely for comparison purposes and Waca Auctions makes no warranties of any kind relating to them. Waca Auctions believes, to the best of its knowledge that the information presented in any listing has come from reliable sources. Such information is presented solely for the convenience of the Purchaser. Waca Auctions makes no warranties of any kind related to the information presented in any listing. Waca Auctions further makes no warranties, either express or implied, relating to the value, marketability or condition of the lot described in any listing. Prospective Buyers should investigate a lot thoroughly before bidding. By bidding the Buyer acknowledges that Buyer has investigated the lot to his or her satisfaction, or, that Buyer has chosen not to do so, and agrees to accept the lot being bid on with no objections after the sale closes. Photos and other graphic material contained in any listing of generic or duplicate lots may be stock presentations and not necessarily of the specific lot. All property is sold "as is", and the auctioneer makes neither any warranties or representation of any kind or nature with respect to the property, and in no event shall they be responsible for the correctness, nor deems to have made any representation or warranty, or description, genuineness, authorship, attribution, provenance, period, culture, source, origin, or condition of the property and no statement made at the sale, or in the bill of sale, or invoice or elsewhere shall be deemed such a warranty of representation or an assumption of liability. The auctioneer has the right at his or her absolute and sole discretion to refuse any bid, to advance the bidding in such a manner as he or she may decide to withdraw any lot, and in the case of error or dispute, and whether during or after the sale, to determine the successful Buyer, to continue the bidding, to cancel the sale or to re-offer and resell the item in dispute. If any dispute arises after the sale, our sale record is conclusive. We reserve the right to withdraw any property before and during the sale, as well as reserve the right to group one or more lots into one or more selling lots, or to subdivide into two or more selling lots. Waca Auctions shall have no liability whatsoever for such withdrawal, addition or amendment. We will use reasonable efforts to carry out online bids and do not accept liability for equipment failure, inability to access the internet or software malfunctions related to the execution of online bids. Waca Auctions is in the business of locating items for sale, listing them for sale and selling them. Waca Auctions is not in the business of collecting delinquent accounts receivable. Therefore, in fairness to Waca Auctions and the many Buyers who do follow the agreed upon terms and conditions, violating Buyers are required to pay any charges incurred by Waca Auctions, including but not limited to company time and services utilized to collect on the delinquent Buyer's account. Waca Auctions relationship with Buyers is simple and straight-forward: Waca Auctions finds, Waca Auctions lists, Waca Auctions sells, Buyer signs up, Buyer bids, Buyer wins, Buyer pays, Buyer arranges for shippings. Waca Auctions does not wish to collect any of the fees listed in these terms. However, when a Buyer unilaterally violates the terms and conditions by not paying as agreed, and forces Waca Auctions outside of the simple equation stated above, the following charges shall be vigorously applied and collected. By signing up to bid and by bidding, Buyer agrees not to violate the payment provisions of these General Terms and Conditions. Payments Include Wire Transfer, PayPal, and All Major Credit Cards. 20% Restocking fee applies to merchandise rejected by the buyer due to reasons other than misrepresentation by Waca Auctions. A 3% Credit Card / PayPal processing fee will be added to all items. All residents of Missouri are subject to a Missouri State Sales Tax rate of 8.631% unless a valid MO State sales tax exemption certificate is presented before payment. There will be a 3% fee added on as a payment-processing fee. All sales are final. No lots are sold on approval. Placing a bid is a legally binding obligation. There are no returns or exchanges. All lots are sold as is, where is, with all the faults, imperfections, omissions and errors in the written description, estimates, appraisals, graphics and photography. Waca Auctions is not responsible for any errors or omissions in the description, graphics or photography provided or in the bidding software. Due diligence to verify the condition and description of a lot is the sole responsibility of the Buyer and this shall happen prior to placing any bid. Returns may only be made with the advance written authorization of Waca Auctions and are in Waca Auctions' sole discretion to approve. To request a return you must provide a written request fully explaining the basis for the return no later than 3 days after your receipt of the lot. Under no circumstances will any amounts other than the winning bid amount be refunded. A restocking charge of 20% of the full invoice amount may apply in Waca Auctions' sole discretion. Any allowed returns must be received in exactly the same condition as when originally shipped to Buyer, or they will be returned to buyer at Buyer's cost. Any unauthorized returns will be refused. Delivery refusal of items shipped by Waca Auctions to the Buyer constitutes an unauthorized return in direct violation of these general terms and conditions. If for any reason a purchased lot cannot be delivered in the same condition as at the time of sale, or should any purchased lot be stolen, mis-delivered or lost prior to delivery, Waca Auctions shall not be liable for any amount in excess of that paid by the purchaser. In the event that a Buyer does not respond to Waca Auctions' request for payment or does not fulfill complete payment within three business days, a second attempt for payment will be sent. A final invoice will be sent soon thereafter and if payment in full is not received the account will be reported to Live Auctioneers as a non-responsive Bidder and the Bidder will not be able to participate in any further auctions. In consideration of Waca Auctions' approval of a Bidder to bid in any sale, Bidder permits Waca Auctions to add Bidder to Waca Auction mailing list. Waca Auctions will send information to Bidder relating to Waca Auctions' activities and will not provide Bidder’s mailing information to third parties except as necessary to provide information to Bidder relating to Waca Auctions' activities. Bidder may freely opt out of mailings at any time by following the instructions in any mailing and Bidder agrees that any mailings from Waca Auctions or third parties providing information relating to Waca Auctions are not spam. Any and all of the conditions may be waived or modified in the sole discretion of Waca Auctions.
