All bidders understand that GWS Auctions is the managing and expert consultant auction firm for this sale.
1- Postage, shipping insurance & signature confirmation will be manually calculated after the sale for the entire group of purchases. If you have important questions, please feel free to call us at (760)610-4175.
2- This is a public auction and is conducted by a licensed auction company. There will be a 23% Buyer's premium added to all invoices, unless otherwise stated on catalog page. The auctioneer will open bidding at a reasonable price or the pre-bid amount on each lot,and may set bidding increments as he/she deems necessary. The auctioneer's decisions are final. No lots will be broken, please do not ask.
3- Lots will be sold to the highest bidder.Absentee bids will be treated as limits, if applicable. GWS Auctions, LLC reserves the right to refuse any bid. We reserve the right to pull any items at anytime from our auction. We reserve the right to retract bids as we feel fit.
4- Wording, which is subjective, and other adjectival descriptions are the opinion of the Auction House. No warranty is expressed, implied or provided, since these opinions can and do vary among individuals. No lots may be returned by bidders.
4a- All "Estimated Values" provided are based on retail prices on comparable items in our local market (Beverly Hills, CA).
5- All Sales Are Final.
6- All sales are strictly in U.S. dollars. Anyone wishing to purchase lots in TX will also be charged sales tax of 8.25%. All winning bidders pay postage and handling, shipping insurance and delivery confirmation fee.
7-Please call us to make a payment within 48 hours from the auction end, otherwise there will be an additional 3.5% charge for late fees.
8- All payments are to be made in full as soon as the hammer falls. NO EXCEPTIONS. If we have not received payment in 48 hours of the auction, a 35% reselling fee will be charged to your card on file.
9- Postage arrangements are the sole responsibility of the buyer. The auction house will assist with allowing a professional shipper pick up the bidders winnings, and the shipper will collect payment for the shipping directly from the buyer.
9A- ALL SHIPPERS MUST USE NEW PACKING MATERIAL & NEW BOXES TO MAKE SURE THEY ARE SHIPPING ITEMS IN ACCORDANCE WITH USPS or FEDEX PROCEDURE, SO IN THE EVENT YOU HAVE TO MAKE A CLAIM FOR A DAMAGED ITEM-THE CLAIM WILL NOT BE DENIED. All items shall be shipped and insured with delivery/signature confirmation at buyer's expense.
PLEASE NOTE: (I) WE ARE NOT RESPONSIBLE FOR LOST, STOLEN OR DAMAGED ITEMS.
10- Bids on behalf of corporations must be personally guaranteed by one or more of it's officers. Any credit card payment made by a corporation is subject to a 4.25% charge. Each bidder is responsible for his/her bids, and cannot act for a third party.
11-The buyer is responsible for attorney, other judicial fees, and expenses involved in collection of outstanding invoices.
12- If you are the winning bidder, you must pay for the item, no exceptions. If you need immediate assistance please call our auction house at: 760-610-4175, if you wait until the auction is over to report a problem with a bid that resulted in a win, and do not pay, you will be charged a 35% reselling fee, subject to the 23% buyer's premium. NO EXCEPTIONS.
13- Please note: Bidding in this auction, whether in person or on the internet, constitutes full acceptance by the bidder of the foregoing terms of sale.
14- All items will be sent within 4-6 (BUSINESS) days of the auction, after payment in full is received.
15- All terms and conditions are strictly enforced, with no exceptions. We have a "you win, you buy" policy. Please be advised that there is a 20% BUYER'S premium.
16-By accepting these terms and conditions, and bidding in our auction, you automatically agree to our "NO CHARGEBACK" Policy. Which states-That all bidders agree to NEVER initiate a chargeback for any reason unless we have misrepresented an item, and in that case we ask you to please contact our auction house to give us an opportunity to right the situation prior to you doing a chargeback. 760-610-4175
17- All purchases over $1500 require a wire transfer, and all international purchases must also be paid via wire transfer, NO EXCEPTIONS.
18- In the event that the bidder has a dispute he/she agrees to enter arbitration in Harris County, TX.
19- If you are successful in arbitration, your sole and only recourse would be a full refund of the hammer price only. You will not be entitled to a refund of any taxes, VATs, buyer's premium, shipping charges or any other fees or damages sustained as a result of the transaction. This refund would only be issued if the item is returned in its original condition at the time of the sale (per photographs).
20- All auctioneers, auction houses, its employees or independent contractors are acting as agents on behalf of the seller only, and all due diligence is the sole responsibility of the buyer.
21- All provenance, titles, descriptions and all lot information were provided by the seller, and the auction companies are not responsible for content. The auctioneers urge all bidders to perform their own due diligence.
22-The buyer's premium does not include VAT, sales tax or any other import/export fees, or any other fees associated with this sale.
23- All items are being sold AS-IS, WHERE-IS, WITH ALL FAULTS, NO CONTINGENCIES AND NO WARRANTY IS EXPRESSED OR IMPLIED.

Everything MUST be paid for in full with in 48 hours of the end of the auction. Bidder further agrees that under no circumstances will he/she initiate a charge-back on his/her credit card.
ALL INTERNATIONAL BIDDERS MUST PAY VIA WIRE TRANSFER, NO EXCEPTIONS.
A 35% reselling fee will be applied to items not paid in full by the Tuesday following auction NO EXCEPTIONS. Wire transfer will be required on all purchases over $1500.00. We will also provide a 3% "cash discount" on all transactions if you choose to do a wire transfer. We will also provide this cash discount if you mail in a cashier's check (no personal checks please). All cashier's checks must be received by the Tuesday following the auction.
Payment in full must clear prior to shipment of items.
BUYER PAYS ALL SHIPPING & PACKAGING MATERIAL COSTS--We will combine shipping on multiple lots for our winning bidders. Shipping insurance and signature confirmation is required on each package at buyer's expense.
All items will be shipped within 4-6 (BUSINESS) days of the auction, or once payment in full is received. ALL SHIPPING MUST BE PAID FOR BY THE BUYER, AND SHIPPING WILL BE DONE BY A PROFESSIONAL, LICENSED AND INSURED SHIPPING COMPANY AT THE BUYERS EXPENSE.
In the event that you need to make a claim with your shipper, you will need to complete the following:
1) KEEP THE BOX, ALL PACKING MATERIAL & THE DAMAGED ITEM (INCLUDING ALL BROKEN OR DAMAGED PIECES).**IF YOU THROW AWAY THE BOX AND PACKAGING SHIPPER WILL DENY YOUR CLAIM.
We do in-house shipping. All packages will require signature confirmation, tracking & insurance.
