BY ACCEPTING THESE TERMS YOU AGREE TO THE FOLLOWING: TRANSACTION OF BUSINESS By Accepting these terms and participating in this auction, you(buyer) and Noreaster House Auctions, it’s employee’s or it’s consignors, if applicable, further to be referred to as "Noreaster House", are entering into a legal and binding contract whereby both parties will execute any involved transactions in a professional and timely manner. By bidding on an item placed up for bid you have indicated that you intend to buy said item unless superseded by a higher bidder or bid. While we stand behind our items with a money back guarantee should an item be described in error, Noreaster House will not be held responsible for any errors or omissions in the listing information for any item up for auction. This includes, but is not limited to title, description, estimates, pictures, size, weights, quality, and quantity. Diamonds and Colored Stones are generally graded only as mounting permits observation. The weight of Diamonds and Colored Stones are estimated by formula and may not be completely accurate. Due to the extremely subjective nature of gemstone analysis, Buyer assumes all risk in purchasing any item(s) auctioned by Noreaster House. Noreaster House shall not be held responsible for any claims or disputes arising from any item described herein and Noreaster House, its employees, members, agents and/or affiliates shall not be liable for any loss, damage or expense for any errors or omissions arising from any information provided herein. Noreaster House has made no representation or warranty in connection with any item(s) described herein. BIDDING Bidding will be considered "open" when the lot is displayed as "open". Advanced Absentee Bidding will be allowed up to one half hour prior to the start of the auction. Bidding will be considered closed after a "Fair Warning" has been issued and the lot has been closed by Noreaster House concluding bidding for that item. Noreaster House will not be held responsible for any attempts to bid outside of this timeframe due to technical difficulties or hesitations from any bidders. NON-PAYING BIDDERS Noreaster House must receive payment within 5(five) business days of the end of auction unless other arrangements have been arranged and approved by Noreaster House. If payment is not received within 10(ten) business days, buyer will automatically be in default and right to the item(s) will automatically be forfeited. Noreaster House will then automatically file a Non-Paying Bidder Alert to eBay, which may result in suspended from eBay indefinitely. Noreaster House will also file negative feedback indicating a non-paying bidder. If any applicable conditions herein are not complied with by the Buyer, the Buyer will be in default and without limitation, Noreaster House at its' discretion shall have the full right to hold the Buyer liable for the total purchase price, including all fees, charges and expenses as described herein. In addition at it’s discretion, Noreaster House may hold the non-paying bidder liable for any deficiency, any and all costs, handling charges, late charges, expenses for re-auctioning the item, Noreaster House Auction’s commissions legal fees and expenses, collection fees and incidental damages. REFUND & RETURN POLICY Noreaster House will honor full or partial refunds on all items returned with the following limitations. If the return is due to an error Noreaster House made on shipment, Noreaster House guarantees a full refund. Buyers must contact Noreaster House via email within 3 days of receipt of item and it should be sent to us insured for their full value and must be received by us in their original condition within 7 business days of product receipts. Noreaster House will guarantee reimbursement of the actual return shipping and insurance fees. Please provide a receipt to expedite the reimbursement. Noreaster House will grant partial returns for any reason within 5(five) days of receipt of item. These Items will be assessed a 15 % restocking fee of the total purchase price. Merchandise must be returned undamaged and in original condition and insured for their full value. Refunds are generally made within 5(five) to 7(seven) business days after receipt of the returned merchandise. DISPUTE RESOLUTION & SATISIFICATION As it is in all our best interests to try and resolve any disputes or complaints resulting from participation in a Noreaster House Auction. In no event shall Noreaster House’s liability for any breach, or act or omission exceed the purchase price actually paid by the Buyer, and in no event shall Noreaster House have any liability under any circumstances for special, indirect, incidental or consequential damages (including for loss of profits or revenue, costs of obtaining alternative property, claims of customers of Buyer or otherwise), whether in contract, tort, negligence, strict liability, or otherwise, arising out of, resulting from or in any way relating to the Property or its purchase, sale, delivery or non-delivery, or the acts or omissions of Noreaster House Auctions, it’s employees or it’s consignors.
