Internet bidders must bid quickly as we sell at a rate of 60-80 items per hour. You may want to post absentee bids on lots of interest in case your Internet service is interrupted during the live auction event or our connection has a failure. Note: Bidder agrees that RHG/HG shall not be held responsible for bidders inability to post a bid on any lot, at any time, for any reason whatsoever. The successful bidder is the highest bidder acknowledged by the auctioneer. In the event of any dispute between bidders, or in the event of doubt on (RHG / HG) 's part as to the validity of any bid, the auctioneer will have the final discretion either to determine the successful bidder or to re-offer and resell the article in dispute. If any dispute arises after the sale, (RHG/ HG) 's sale record is conclusive. 4. The purchaser assumes full responsibility for items at time of sale. The buyer at the conclusion of the auction must immediately insure all items. 5. As a convenience to customers, absentee bids and phone bids will be executed by (RHG / HG) 'S personnel in a competitive and confidential manner. Phone bid arrangements must be made prior to start of the auction. (RHG / HG) will not be responsible for failure to execute absentee or phone bids. Absentee bids and phone bids are subject to the 17% buyers premium, the same as Internet bidders. 6. There will be a premium of 17% for all bidders, added to the hammer price of each lot and it will be considered part of the total purchase price that includes Internet bidders. THE SOLD PRICE DOES NOT INCLUDE SHIPPING AND HANDLING. 7. All purchases will be subject to a 6% Connecticut sales tax unless the purchaser possesses a valid tax-exempt number or the item is being shipped out of state or out of the country. (RHG / HG) must have an exemption certificate filled out with permit number and signature on any tax-exempt sale. No Exceptions! 8. PAYMENT - All items purchased via the Internet must be paid for within one (1) day. For items bought through eBay Live Auctions or live auctioneers, it is the buyer's responsibility to contact The Auctioneer ((RHG / HG). Purchases Must be Picked Up At the Sale location 40 Progress Circle Newington, CT 06111 within one week by 1/22/07 unless other arrangements are made. Appointments are necessary to arrange Pickup. Failure To Arrange Pickup by this date will result in forfeiture of the items and Payment is still required. Please call before you pick up so someone can meet you. 11. (RHG / HG) reserve the right to withdraw any lot at any time. 12. A range of estimates is given on each lot with a low and a high estimate. Estimates should not be relied on as a prediction of the actual selling price. Bidding starts at half the low estimate. 13. If any applicable conditions herein are not complied with by the purchaser, in addition to other remedies available to it by law, including without limitation the right to hold the purchaser liable for the total purchase price, (RHG / HG) at its option may either (a) cancel the sale, retaining as liquidated damages all payments made by the purchaser or (b) resell the property at public auction without reserve or minimum selling price, and the purchaser will be liable for any deficiency and costs, including handling charges, expenses of both sales, the commission on both sales at regular rates, all other charges due hereunder and incidental damages. In the event a buyer initiates litigation against (RHG / HG) for any reason, then buyer agrees to reimburse (RHG / HG) for reasonable attorney's fees and/or costs incurred in any such action. In the event (RHG / HG) is required to initiate litigation and/or collection actions against a buyer, then the buyer agrees to reimburse (RHG / HG) for reasonable attorney fees and/or costs incurred in any such action, and further agrees jurisdiction shall be in Connecticut. 14. ADDITIONS / WITHDRAWALS - The Auctioneer has sole discretion to reject any and all bids and reject a nominal advance and reserves the right to withdraw from sale any items listed or to sell items not listed. The auctioneer reserves the right to group one or more lots into one or more selling lots or to subdivide into more selling lots. Wherever the best interest of the seller will be served, the Auctioneer reserves the right to sell all of the items listed in bulk or individually or subject to confirmation of owner. 15. DISPUTES - if any dispute arises between two or more bidders, the Auctioneer may decide the same or may immediately put the lot up for sale again and resell to the highest bidder. The Auctioneer shall be the final judge in all-bidding disputes and shall determine the top bidder. The decision of the auctioneer shall be final and absolute. RECORDS - The record of sale kept by the auctioneer and bookkeeper will be taken as final in the event of any dispute 16. LOT COUNTS - Where items are sold by estimated count, measure or weight, the purchaser will be billed for and required to pay for the estimated count, measure or weight. If, any shortage exits, the purchaser will receive a refund at the rate of purchase. If there is excess, the purchaser is required to take items and pay for the excess, at the rate of purchase. 17. REMOVAL - Shall be at the expense, liability and risk of the purchaser. No forklift or equipment can be used in the removal of items unless the rigger shows proper insurance. Purchases will be delivered only on presentation of paid bill. Auctioneer shall not be responsible for goods not removed within the time specified and shall have the option of removing and storing at the expense and risk of the purchaser any article purchased but not paid for and removed within the specified time. CLAIMS - No claims will be allowed after goods are removed from premises 18. RESERVES - The Auctioneer reserves the right to reject any and all bids. On lots upon which there is a reserve, the Auctioneers shall have the right to bid on behalf of the seller. 19. AGENT - The Auctioneer is acting as agent only and is not responsible for acts of the principals. 20. . These terms and conditions of sale, as well as the respective rights and obligations of (RHG / HG) and any purchasers or bidder at any sale of (RHG / HG), shall be governed by and construed and enforced in accordance with the laws of the State of Connecticut.
