Antique market owners sue Town of Brimfield, Mass.

BRIMFIELD, Mass. (ACNI) – A lawsuit filed by an antique market operator against the Town of Brimfield over the way the municipality charges for emergency services at Brimfield Antique Show will result in a trial.

The Stonebridge Evening News has reported that voters at a Town Meeting on July 28 rejected changing the way emergency services fees are charged to owners of markets that make up the Brimfield Antiques Show.

May’s Antique Market Inc. filed suit against the town in 2006, claiming that the emergency services fees the town has collected from the 20 show owners every year have been more than $100,000 higher than the cost of police, fire and ambulance protection actually provided at the shows.

In recent months Brimfield’s town counsel, Jonathan M. Silverstein, and May’s lawyer, Edmond A. Neal III, negotiated a proposed change in the town bylaws that based fees on the size of each show owner’s field rather than on the number of vendors that rent space.

The Springfield Republican reported that Neal indicated the May family would drop the suit if the change was approved at the Town Meeting. The newspaper also reported that opposition to the proposed change was led by owners of other antique shows who argued that basing fees on square footage of their fields would require expensive land surveys every time they modified their selling area.

In March, owners of Mahogany Ridge, Shelton Antiques, The Meadows and New England Motel & Antique Market filed a second lawsuit seeking to overturn the emergency services fees.

In addition to the emergency services fees, show owners pay the town a $50 annual license fee and collects a $20 fee for the town from every dealer for each week they are set up at the shows, which are held three times a year.

The week-long Brimfield Antiques Show is held three times a year, in close proximity to the Memorial Day, Independence Day and Labor Day weekends. The final Brimfield Antiques Show session of the 2009 season will take place Sept. 8-13.

The trial will be held in Hampden County Superior Court in Springfield, Mass., but as of Aug. 6, no trial date had been set.

Art lovers look for blockbusters at Clark Cierlak Fine Arts auction Aug. 9

SHERMAN OAKS, Calif. – With a dearth of summer blockbusters at theaters filmgoers may look beyond Hollywood for entertainment. Clark Cierlak Fine Arts has an alternative: classic movie posters. The company will offer about a dozen original movie posters along with paintings, prints and sculpture at its Fine Art Estate Auction on Sunday, Aug. 9.

A gallery preview will be Friday and Saturday 10 a.m. to 5 p.m. Doors open at 10 a.m. and the auction starts at 11 a.m. Pacific. Clark Cierlak Fine Arts is located at 14452 Ventura Blvd. in Sherman Oaks, Calif.

Getting top billing is a gigantic – 81 by 41 inches – three-sheet poster from the 1967 James Bond film You Only Live Twice, starring Sean Connery. The poster, which is linen-backed and framed, is in excellent condition and expected to sell for $1,500-$3,000.

A colorful and graphic one-sheet (41 by 27 inches) poster for the 1953 MGM release The Naked Spur starring Jimmy Stewart and Janet Leigh is expected to roundup $400-$600.

The auction will also feature a collection of vintage photographs by the likes of Scavullo, Philippe Halsman and George Hurrell. The latter’s larger than life (36 by 48 inches) portrait of Rita Hayworth is from an edition of 50. The framed gelatin silver print is estimated at $3,000-$4,000.

The bulk of the auction, however, will be modern and contemporary prints and paintings.

Highly anticipated are six rare paintings by Oskar Fischinger (German/American, 1900-1967), all originally gifted from the artist to a prominent collector.

“Fischinger paintings are hard to find, and to have six in one sale is a rare delight,” noted Clark Cierlak.

The paintings date from 1939 into the 1960s and estimates on them range from $1,000 to $3,000 each.

Carrying the highest estimate ($20,000-$25,000) is a color lithograph titled Mounting the Ebony Horse by Marc Chagall from the 1948 series Arabian Nights. Signed in pencil and inscribed “pl. 12” from a numbered edition of 90, the image measures 14 1/2 by 11 inches. The starting bid is $15,000.

A sugar-lift etching by Wayne Thiebaud (American, 1920) is titled Sugar Cones. The sheet is 13 by 11 1/4 inches and has a $3,000-$5,000 estimate.

“This may be a first for this image ever to come to the auction block, and there is a concurrent Thiebaud exhibition of Food prints at the Norton Simon Museum of Art (Pasadena, Calif.),” said Cierlak, noting it is possibly a rare proof from an unrealized edition.

Also featured is a collection of 1960s pop prints from a granddaughter of Edward G. Robinson, including a Roy Lichtenstein (American, 1923-1997) color lithograph titled Explosion. From a numbered edition of 100, the 22- by 17-inch sheet was printed by Holland Workshop in 1967. It has a $5,000-$6,000 estimate. Other artists from the group include Robert Motherwell, Ellsworth Kelly and Sam Francis.

Asian art takes the spotlight in William Jenack’s Aug. 9 auction

CHESTER, N.Y. – William Jenack Auctioneers will conduct a 395-lot Fine Art & Antiques auction, featuring a special selection of Asian art, on Aug. 9, 2009 at the company’s Kings Highway gallery in Chester. Asian works of art include a fine carved jade figurine of a mountain, estimate $2,000-$3,000; a 63-inch-tall Thai carved dancing figure, late Ayutthaya Period/18th century, $1,000-$1,500; and a Chinese carved limestone head of Buddha, Sui (581-618 A.D.). The latter artwork, which is one of the highlights of the sale, stands 12 inches tall (inclusive of stand) and is estimated at $4,000-$6,000. A Chinese carved nephrite jade scholar’s belt plaque, Ming/Ching Dynasties, was previously sold at Christie’s New York in March 2009. It is expected to make $1,600-$2,000 in Jenack’s sale.

The selection of American and European works of art includes a Jeanne Esposito (American, 20th century) oil on canvas of figures in an artist’s studio. The signed, 50-inch by 40-inch work is estimated at $300-$500. In the same category, five Woody Pantilla metal object sculptures will be offered.

The sale spans many other categories, including American, Eskimo & Meso-American Indian artifacts, costume jewelry, vintage blue pattern glass, vintage Fiesta Ware, and phonographs/music boxes including a Victor oak model VV-VIII and Edison Home Cylinder.
