South Dakota auctioneer sentenced to 90 days

YANKTON, S.D. (AP) – A Yankton auctioneer has been sentenced to 90 days in jail for failing to pay proceeds to his clients and not paying sales tax.

The Press & Dakotan newspaper reports that James Payne pleaded guilty in July to grand theft and failure to pay sales tax. He began serving jail time last week.

Judge Steven Jensen ordered Payne to pay nearly $14,000 in restitution. Seventy-five percent of that amount will go toward paying the grand theft victims, while the remainder will go toward the unpaid sales taxes.
