Mussallem Galleries: ALL INTERNET BIDDERS ARE REQUIRED TO READ AND AGREE TO THE FOLLOWING CONDITIONS OF SALE. 1. You must be registered at least 24 hours in advance of the start of the sale in order to participate. 2. There is ZERO Buyers Premium for all internet purchases. 3. All property must be paid for within Five (5) business days after receiving your invoice. Invoices will be sent via email the week following the auction. 4. Buyer is responsible for making all arrangements for the packing and shipping of purchases within 30 days of the auction either through Mussallem Galleries or an 3rd party shipper. 5. Any condition statement is given as a courtesy to a client, is only an opinion and should not be treated as a statement of fact. Mussallem Galleries shall have no responsibility for any error or omission. The absence of a condition statement does not imply that the lot is in perfect condition or completely free from wear and tear, imperfections or the effects of aging. Prospective buyers are in ALL CASES responsible for determining the physical condition of lots. All items are sold AS IS and there will be no returns based on condition. 6. Registered bidders accept all personal liability to pay the purchase price, including all applicable taxes, plus all other applicable charges and shipping. Payment We accept VISA, MasterCard and American Express. Other payment methods accepted are bank wire transfer and cash, money order or cashier’s check may be sent using overnight mail. There will be No Buyers Premium added to the hammer price of each item sold on the internet live auctions. ALL PAYMENTS ARE DUE IMMEDIATELY FOLLOWING THE AUCTION WHICH IS WITHIN Five(5)BUSINESS DAYS AFTER RECEIVING YOUR INVOICE. Shipping Buyer pays all shipping, insurance and packing costs. We will attempt to ship and package most items in house at an affordable rate. If your item cannot be shipped in house it will be referred to a 3rd party shipper where it is the buyer's responsibility to make arrangements. If you would like a pre-auction estimate for shipping, please email us. This shipping estimate quote includes the cost of standard shipping as well as charges for materials and labor. Please allow 2 to 3 weeks for shipping after payment is received. Items will be shipped on a first-pay, first-ship basis. We strive to get everyone's purchases to them as soon as possible, but we cannot guarantee that your items will be shipped immediately upon receiving payment. Mussallem Galleries will have no liability for any loss or damage to shipped items. Our responsibility for damage to or loss of any lot ends once it has been turned over to UPS, or other shipping enterprise for delivery and/or packing. By bidding, the winning Bidder agrees that any and all claims for loss or damage to the lot will be handled solely through the insurance claims process (if insurance was purchased) with the carrier, and acknowledges that insurance may be subject to deductibles or other limitations which are not the responsibility of Mussallem Galleries. Mussallem Galleries is not responsible for any loss resulting from items being shipped to an alternate address or recipient provided by Bidder. Mussallem Galleries, or its employees, are not responsible for errors of description, genuineness or authenticity, and fault or defect in any merchandise purchased. No warranties or representations whatsoever are given by Mussallem Galleries, or its employees, to any buyer in respect to any item. 2. We do not give refunds. Mussallem Galleries sells its own property as well as represents and sells consigned property on behalf of other sellers. Mussallem Galleries recommends prospective bidders examine all items in which they have an interest. All lots offered are available for your examination prior to auction date. Registering for a sale and placing bids on any lot signifies that you or your agent have examined the property as fully as you desire. Written and oral descriptions are our opinions and to the best of our knowledge, and should in no way be construed as a guarantee of any kind as to age, condition, materials or any other feature of any lot being sold. If you require absolute certainty in all areas of authenticity, and the results of your evaluation leave uncertainty in your mind, we recommend you not bid on the lot in question. All sales are final, and no refunds will be given. No statement written or oral made by the auctioneer or by any other seller shall be deemed a warranty, guarantee, or assumption of liability by Mussallem Galleries. 3. The highest bidder acknowledged by the auctioneer will be the buyer of that lot. In the event of any dispute, the auctioneer shall have sole discretion to either determine the successful bidder or to re-offer for bidding, the lot in dispute. Mussallem Galleries has sole discretion to refuse any bid, to divide any lot, to combine any two or more lots, and to withdraw any lot or lots from the sale. 4. Some lots may be offered subject to a reserve, which is a minimum price below which such lot will not be sold. Mussallem Galleries may implement such reserves by bidding on behalf of the seller. Mussallem Galleries also reserves the right to allow its employees to bid competitively at all auctions. 5. All purchases that are shipped in the state of Florida are subject to the collection of Florida sales tax which is due at the time of payment unless the registered buyer provides Mussallem Galleries with a valid Florida Resale or sales tax exemption certificate. 6. CONDITION REPORTS: Mussallem Galleries and its employees will provide, upon request, condition reports and additional photographs for items contained within the current auction catalog. This service is provided as a courtesy only and requesting a condition report in no way changes the above article #1 of Conditions of Sale for Mussallem Galleries Auction. Since we are not professional conservators or restorers, we urge you to inspect each lot yourself or have an agent do so on your behalf. Prospective buyers should satisfy themselves in all areas of authenticity, originality and imperfections as to condition of the lot and must understand that any statement made by Mussallem Galleries, or its employees is merely a subjective qualified opinion, notwithstanding written reports or any discussion concerning condition in this catalog. Condition reports are provided by request on a "first come, first served" basis, making it imperative that requests are submitted early. Requests submitted close to auction date may not be completed. If a bidder is uncertain about any of these issues, we would recommend that they not bid on lots in question. 7. These Conditions of Sale and the purchaser's and our respective rights and obligations hereunder are governed by the laws of the State of Florida. By bidding at an auction, each purchaser and bidder agrees to be bound by these Conditions of Sale which will take precedence over any other conditions, whether printed or posted on other internet websites. 8. Your bid is a legally binding contract. If you are the successful bidder, you have entered into a contract to purchase the property which you bid from the seller.
