1. All bidders must provide identification and a major credit card .In order to protect our/our consignors’ interests, we may ask bidders to provide a deposit and/or provide additional financial references. We reserve the right to reject any registration for unqualified buyers. 2. Payment: cash, personal checks, Master Card, Visa, Union Pay, American Express or Discover (credit card payment accepted up to a maximum amount of $10,000). However, there is a 3% surcharge to use your credit card for payment. 3. We will provide clear and detailed photos with written descriptions as much as possible. All the photos and descriptions are only to help clients realize the condition of the auction goods as a reference. Considering the auction goods age, there will be some acceptable wear, scratches, nicks, missing stitches, etc. Also, because of handmade and the different of process futures in various decades, there will be a little bit measuring and manufacturing differences. These differences are not defects and may not be included in descriptions .Our descriptions and photos are only on behalf of our opinions and should not be considered as a guarantee of the age, authenticity or composition. Also, All lots are sold "AS IS" and we do not accept returns. 4. Flybird, LLC expressly reserves the right to reproduce any image of the lots sold in this catalogue. 5. The highest bidder acknowledged by the auctioneer shall be the purchaser. In the event of any dispute between bidders, the auctioneer shall have absolute discretion either to determine the successful bidder, in which event his determination shall be final or, to re-offer and re-sell the article in dispute. If any dispute arises after the sale, Flybird, LLC sale record shall be conclusive as to who was the purchaser, the amount of the highest bid and in all other respects. 6. No properties purchased during auction may be removed prior to end of session. 7. Some lots offered may be subject to a reserve. The reserve is a confidential minimum price agreed upon by the consignor and Flybird, LLC below which the lot will not be sold. A representative of Flybird, LLC will execute such reserves by bidding for the consignor. Reserves are set at or below the estimated range. Under no circumstances will reserve amounts be disclosed to prospective bidders. 8. We will use reasonable efforts to carry out online bids and do not accept liability for equipment failure, inability to access the internet or software malfunctions related to the execution of online bids. 9. Flybird , LLC does not guarantee clocks, watches, mechanical banks, scientific instruments, electric lamps, and other mechanical or electric items to be complete or in working condition. 10. If no additional requirements are required, 2% of the invoice value will be added to the total price as a shipping insurance. From the date of the end of the auction, all items purchased must be paid by entire amount including the packaging and shipping fees within 7 days. After your payment successful, we will ship the goods within 15 working days. Clients are responsible for the taxes and other expenses related to auction goods. 11. If a buyer fails to make payment within 30 days of the day of sale, Charge the credit card number provided to Flybird , LLC by the buyer for the total due plus any applicable fees (storage, interest, etc.) plus a 3% surcharge. If a deposit was submitted prior to bidding, this amount will not be refunded, but be kept and applied towards any owed amounts. If no credit card is available or if payment has not been received within 30 days, Flybird , LLC will pursue alternate collection avenues starting 30 days from the day of sale in order to collect the balance due plus any storage, administrative, attorney.After 30 Days :File a Civil Complaint against the buyer to recover any balance due plus court fees, interest, storage fees, administrative costs, attorney fees, and any other applicable financial hardship caused to Flybird, LLC and the consignor, or pursue other collection avenues to recover any and all losses. 12. Buyers will be required to pay Texas Sales Tax of 8.25% at the time of payment ,unless: Items are shipped out of Texas or the buyer provides Flybird, LLC with a valid Sales Tax License Number . 13. Please note that full payment for your items must be received by Flybird, LLC before we will turn your item(s) over to the shipper. 14. Flybird , LLC does not provide in-house shipping, but will assist bidders in coordinating shipping with USPS. Packing and handling of purchased lots by us is at the entire risk of the purchaser, and Flybird , LLC will have no liability of any loss or damage to such items. 15. International buyers are responsible for tariffs, taxes, or assessments of shipped items to the buyer's country. 16.
