TERMS OF SALE Your submission of bids in this auction constitutes your acceptance of the "Terms of Sale." Please do not bid in this auction if you do not agree to all of the terms listed as follows: 1. This is an Auction Sale, not an Approval Sale. Upon the auctioneer's call of "Sold" all sales are deemed final and complete. 2. The absence of a Condition Statement does not imply that the lot is in perfect condition or completely free from wear and tear and/or imperfections, or the effects of ageing. 3. Interested bidders are strongly encouraged to request a Condition Report or more images for any lots on which they intend to bid, a minimum of 48 hours before the Auction Sale begins. 4. All transactions are governed by Heritage of Civilization Inc. 5. Please note: goods cannot be reserved in advance of the auction. 6. All items are non returnable once purchased. PAYMENT 1. Payments must be completed and paid in full for the total price of the goods within five business working days. No lots will be released or considered SOLD until payment has been received. 2. Heritage of Civilization Inc accepts MasterCard, Visa, or American Express, Visa Debit. We also accept PayPal and Bank Transfers, cash and checks. 3. Personal checks will be acceptable only if credit has previously been established with Heritage of Civilization, or if a bank authorization has been received guaranteeing a personal check. Heritage of Civilization Auction reserves the right to hold merchandise purchased by personal check until the check has cleared the bank. 4. The purchaser agrees to pay Heritage of Civilization Auctions a handling charge of $25.00 for any check that is not honoured by the drawer. PACKAGING, SHIPMENT AND DELIVERY 1. We can provide a quote for the packaging, shipment and delivery of items from the USA and from the UK to destinations worldwide. 2. Payment for this service must to be completed and paid in advance and in full - plus any additional insurance/purchase duties/taxes that are due - before we undertake this service. 3. It is the customers responsibility to give correct delivery details including address, zip code (post code for the UK), contact numbers and any change of address to Heritage of Civilization Inc. in advance of any delivery being arranged or actioned. 4. Any items shipped from the US to an address within the US, do not incur any additional duties or taxes. 5. Any items shipped from the UK to an address within the UK do not incur any additional duties or taxes. ADDITIONAL PURCHASE DUTIES AND TAXES * Delivery of remotely purchased goods dispatched and shipped to worldwide destinations usually arrive within 10-20 working days. * You are solely responsible and liable for observing and complying with any applicable regulations, legislation, custom duties, levies or additional taxes that may affect your purchase or are payable at any foreign port as a result of delivery of goods; or for any charges that are due in your country outside of the US or the UK. * You shall not be entitled to cancel your order on the basis of any unforeseen duties or levies. Certain national laws may prohibit the importation or exportation of certain of our goods to you. We make no representation and accept no liability in respect of the export or import of the goods you purchase. To the fullest extent permitted by applicable law, we exclude all our liability to you for any direct, indirect or consequential loss, damage or expenses (including loss of profits, business or goodwill) arising out of any problem relating to the goods that you buy from us. DISCLAIMER All property is sold as is, and neither the auctioneer nor any consignor makes no warranties or representation of any kind or nature with respect to the property, and in no event shall they be responsible for the correctness, nor deemed to have made any representation or warranty, of description, genuineness, authorship, attribution, provenance, period, culture, source, origin, or condition of the property and no statement made at the sale, or in the bill of sale, or invoice or elsewhere shall be deemed such a warranty of representation or an assumption of liability. ITEM DESCRIPTION While every effort is made to accurately display the colours and textures of items on our website, we cannot guarantee that your computer display will accurately portray the softness and suppleness of for example the wool and/or silk of the weavings, the overall hand-woven finish and fineness, or the beauty and accuracy of the colours of any items. We do not accept any responsibility if there is a misrepresentation of colour and our items cannot be construed as faulty should they vary from the colour, brightness and contrast settings displayed by your individual computer screen. Should you still wish to return your item for a refund, however, it will not be deemed 'faulty' and you will be responsible for the return delivery costs. The handmade nature of some of our goods means that each item you buy is unique, where no two pieces can be exactly the same. We do, however, make every effort to ensure that all our items sizes, measurements and details are as accurate as possible. FORCE MAJEURE Our performance of any part of a contract with you is subject to variation or cancellation and the grant of an extension of time from any cause arising from an act of God, war, strikes, lock-outs, flood, drought or other cause of any nature whatsoever beyond our control or owing to inability and time to procure materials, labour or any articles at all and you agree to accept increased prices for the products due to any of the aforesaid reasons. In all circumstances time is not of the essence of the contract.
