The auctioneer determines the highest bidder. Sales Tax: All sales are subject to Pennsylvania state and local taxes of 6%, unless you have a PA State Sales Tax Number on file with Live Auctioneers. BIDDING When Absentee bidding, you may accept the current asking bid or enter a maximum bid value. Once a lot has come up, live auctioneers bidding is available on the website and absentee bids can no longer be placed. A deposit may be required at the discretion of Brandywine Valley Auctions. OWNERSHIP Item ownership is conveyed immediately following the fall of the Auctioneer's hammer. While we try to handle and store items with great care,Brandywine Valley Auctions will have no liability for any loss or damage to an item after the hammer has fallen.Brandywine Valley Auctions is not liable for any damages incurred if assistance with loading is requested. Once an item(s) has been paid for, we will place the items in the hands of the packer and shipper who is contracted through Live Auctioneers using their Live Shipping program. STORAGE Unless prior arrangements are made, payment within 5 business days, or a $5 per lot per day storage fee will be charged. ABANDONED PROPERTY Unless prior arrangements have been made, any lot(s) remaining at the Brandywine Valley Auctions more than 90 calendar days after the auction purchase date will be considered abandoned and no refunds will be given. Brandywine Valley Auctions is not obligated to notify the winning bidder of the abandoned lot(s). AGREEMENT REGARDING GOVERNING LAW, VENUE, AND LEGAL RIGHTS Any and all disputes resulting or arising in connection with this auction shall be heard in the County Court of Common Pleas of Chester County, Pennsylvania as the sole and exclusive venue. : I hereby understand and agree that any controversy or claim arising out of or relating toBrandywine Valley Auctions. I hereby irrevocably submit to the personal jurisdiction of the appropriate court in Chester County, Pennsylvania in any action or proceeding arising out of or relating to the claims and their enforcement, and I agree that any and all claims must be adjudicated, heard, determined, and resolved in said court, and I hereby irrevocably waive any objection on the ground that any such action or proceeding in said court has been brought in an inconvenient forum.
