PLEASE READ CAREFULLY AND COMPLETELY ALL AUCTIONS ARE DIFFERENT! ************************************************************ Auction Post: October 23, 2014 Auction Day: November 15, 2014 – Beginning at 10:00 AM CT (11: AM PT) Auction Inspection: November 8, 2014 by appointment from 10 AM - 4 PM Auction Removal: November 22, 2014 by appointment from 10 AM - 4 PM 1. Auction Day - Lots begin selling at their highest bid in numerical order at 11:00 AM CT (9:00 AM PT) on November 15, 2014. The Lots will sell at a rate of about 100 Lots per hour. This is a Public Auction. Bidders must provide a valid PayPal, Visa/Master, Discover or American Express Card to register to bid online at LiveAuctioneers.com. 2. Buyer’s Premium – No Buyer’s Premium. 3. State Sales Tax – State Sales Tax will be charged at 8.25% upon payment, unless the Buyer has provided a Sales Tax Resale Certificate or Exemption Certificate or if the item purchased is being shipped out of state via commercial shipper. Prospective Buyers MUST email their resale form at the time of online registration for the auction to auctionscout@gmail.com or otherwise State Sales Tax will be charged. 4. Processing of Payment - Payment will be processed via PayPal immediately after the last lot is sold on November 15, 2014 using the PayPal Card, Visa/Master Card, Discover Card or American Express Card the winning Buyer provided upon registration for the auction, unless Buyer has made alternate payment arrangements with the Auctioneer PRIOR to the end of the auction. If a Buyer’s credit card is declined on payment day, the Buyer will be charged a $30 processing fee to run the payment again NO EXCEPTIONS! An email confirmation and paid invoice will be emailed to Buyer confirming process of payment. **** A paid invoice will be required to remove purchases from where items are located. Buyers are to be available at the end of the auction by cell phone (or other phone number provided upon auction registration). ****** No items may be removed until payment is made in full. 5. Removal - If you cannot remove your purchases within the time frame specified as follows, please do not bid. All purchases must be removed on 22 November, 2014 from 10am - 4pm or by limited appointment strictly scheduled by the Auctioneer. Call for an appointment. The deadline for removal of auction purchases is 4 pm on Saturday, November 22, 2014. No auction item will be removed from the auction site without a corresponding paid receipt for that item. Buyers assume all responsibility for removal, packing, handling & transportation of purchases. Auctioneer does not offer these services. There is no loading equipment available at the location of auction items. ANY PURCHASED AUCTION ITEMS REMAINING AFTER THE REMOVAL DEADLINE SPECIFIED ABOVE WILL BE CONSIDERED ABANDONED. The Auctioneer and Seller will not be responsible for items purchased in the auction that are not removed before the removal time and date deadline. Furthermore, no refunds will be given for purchases that are not removed before the removal deadline. 6. Shipping – If an item purchased in the auction requires shipping, the Buyer is free to use the Shipper of their choice for picking up the item at the auction location and transporting the item to the Shipper’s facility for packaging and shipment to the Buyer. The Auctioneer does not provide shipping services and will not deliver any items to the Buyer’s shipper. No purchased item will be removed from the location of auction items without a corresponding paid receipt for the item. This will be strictly enforced. The following Shipper has offered their services for this auction. The Auctioneer does not endorse this shipper, but the Auctioneer understands that they are reputable and ship worldwide. Their contact information is provided only as convenience to Buyers. In any event, pickup of items at the location of auction items will be required very shortly after the auction ends. High and Low Estimates are provided solely for comparison purposes for Bidders, and Auctioneer and Seller make no warranties of any kind related to them. AUCTIONEER AND SELLER EXPRESSLY DISCLAIM AND EXCLUDE ANY IMPLIED WARRANTIES OF MERCHANTABILITY, PROVENANCE, AND FITNESS FOR A PARTICULAR PURPOSE. For this or any auction, Bidders should rely solely on their own inspection of all items prior to the auction and should satisfy themselves as to the usefulness, authenticity, and value of each item they are interested in purchasing. Indemnification - Seller, Auctioneer, and auction Bidders expressly agree that Buyer is responsible for and agrees to indemnify Seller, Auctioneer, and their respective affiliates for any and all damages (whether based on contract, tort, warranty, negligence, strict liability or any other legal theory, and including special, incidental and consequential damages), losses, expenses, attorneys’ fees, court costs, etc., that arise out of or result from the removal, possession or use of any items purchased at this auction, or any other claim regarding the use or possession of any asset purchased at this auction. 9. Internet Performance - LiveAuctioneers, Auctioneer, and Seller are not responsible for any Internet connection issues (e.g., Internet disconnection, equipment failure, etc.) that may occur during the online auction. Bidders should understand that connection or delay problems can occur. Auction lots will not be re-sold or brought back up for bidding because of Internet issues.
