ESTATE AUCTION SERVICES, LLC TERMS AND CONDITIONS OF SALE By registering to bid at this auction, you agree to the following terms and conditions of sale. NOTE: Any and all announcements made on the day of an auction take precedence over these Terms and Conditions. • Any person wishing to bid at an auction must first register and receive a bidder’s card. • All sales are final and items are sold “As Is” and “Where Is” with no warranty expressed or implied. Written or verbal descriptions by Estate Auction Services or its employees do not constitute any guarantee. • Bidders are responsible for inspection of items prior to bidding to determine condition and value. • Payment for a purchase is required on the day of the sale. No items purchased may be removed from the premises without payment. • Cash, major credit cards, wire transfers, and good checks (personal/business) may be used as payment. However, EAS may, at its own discretion, hold property until checks have cleared its bank. • A buyer’s premium of 15% will be added to the hammer price of all lots and shall be considered part of the purchase price for the purpose of collecting sales tax. No one shall be exempt from the buyer’s premium. • • Unless you hold a valid tax resale number and have it on file with Estate Auction Services’ cashier, you are required to pay sales tax on the total value of your purchase, which 8.5% (4% State Tax & 4.5% Parish Tax) • EAS reserves the right to bid on behalf of its consignors in order to protect certain items with minimum acceptable sales prices. • At EAS’ discretion, phone bids, Internet bids, and absentee bids will be accepted on selected items. A deposit is required for such bidding. • At its’ discretion for any reason, EAS deems appropriate, it reserves the right to refuse admittance to the building or participation in the auction to anyone. • All item(s) purchased must be removed within five business days of the auction at which it was purchased. After this grace period of five days, there will be a charge of $5 per day, per item(s), for a period not to exceed 30 days from the date of the auction, at which time item(s) will be sold for storage fees. • By signing below, you agree to hold EAS, LLC and its’ employees harmless of any accidents that may occur on the premises. ________________________________________ ___________ Customer Signature Date Bidder No. Any reports regarding authenticity are the responsibility of the consignor of the item being sold. Our descriptions of the items are as accurate as the information provided by consignors allows. For more detailed information, call 225.247.4980 no later than the day prior to the auction. No calls regarding condition of merchandise will be accepted on the day of the auction. The buyer is responsible for shipping and any cost associated with it. EAS will assist, but is not responsible for packaging merchandise for shipping. Buyer is responsible for arranging pick-up or delivery of merchandise at buyer's risk and expense. Arrangements must be made through the buyer's own shipper. We do not provide estimates of shipping costs. Items purchased by buyers out of the state must be picked up within 10 business days after auction after which a storage charge of $25 per day will be charged. In-state buyers must remove items immediately after the auction unless prior arrangements are made with EAS staff. EAS reserves the right to reject any and all bids. The auctioneer will decide any disputes regarding the highest bid at the time the gavel falls. If there is a dispute, he will be the final judge. If he so determines, the item in dispute may be re-offered. The auctioneer has the authority to bid on behalf of registered bidders not in attendance. In addition, EAS staff may bid for registered bidders on the telephone or Internet. However, such action is for the convenience of those not present and EAS will not accept responsibility for errors that might occur. A buyer's premium of 21% will be charged for all Sales via the Internet, absentee bids, or bids on the telephone. For the purposes of computing taxes, the Buyer's premium is considered to be part of the sale and taxes shall so reflect. Accepted forms of payment are Visa, Mastercard, Discover, and/or Certified Check or Money Order. Only credit cards are accepted for international buyers. For successful bidders in attendance, full payment is required prior to departing.
