ONLINE BIDDING TERMS AND CONDITIONS These Online Bidding Terms and Conditions generally describe the terms and conditions on which Property are to be offered for sale at an online auction conducted by Kaylah Designs, Inc. (also known as KD Auctions) by taking auction bids from individuals and/or entities who place bids for the Properties via the Internet. “Kaylah Designs Inc.,” as used in these Online Bidding Terms and Conditions, shall include KD Auctions, and all of its Agents, employees, representatives, officers and directors. Terms and conditions may from time to time be modified and vary among the Properties in each Auction, and each prospective bidder is expected to review carefully for each Property the terms and conditions as in effect immediately prior to placing any bid. Prospective bidders who register in accordance with these Online Bidding Terms and conditions will be deemed “Online Bidders” (individually an “Online Bidder”) during the auction. KAYLAH DESIGNS, INC. IS IN NO WAY RESPOSIBLE FOR TECHNICAL ISSUES WHICH COULD IMPEDE OR PREVENT AN ONLINE BIDDER’S ABILITY TO BID ON ANY PROPERTIES. KAYLAH DESIGNS, INC. DOES NOT WARRANT THAT THE ONLINE PORTAL OR THE SERVICES PROVIDED THEREIN INCLUDING, WITHOUT LIMITATION, ANY THIRD-PARTY SOFTWARE, PRODUCTS OR OTHER MATERIALS USED IN CONNECTION WITH THE ONLINE PORTAL, WILL BE OPERABLE, ACCESSIBLE, TIMELY, SECURE, UNINTERRUPTED OR ERROR FREE, OR THAT DEFECTS WILL BE CORRECTED. KAYLAH DESIGNS INC. SHALL NOT BE LIABLE FOR ANY DAMAGES OF ANY TYPE, CONSEQUENTIAL OR OTHERWISE, ARISING FROM THE CONDITION, CONNECTIVITY, RESPONSIVENESS OR ACCESSIBILITY OF THE ONLINE PORTAL. These Online Bidding Terms and Conditions are legally binding between an Online Bidder and Kaylah Designs Inc., and describe an Online Bidder’s responsibilities in connection with the Online Bidder. By registering to bid and/or submitting any bid, you acknowledge and accept these Terms and Conditions of Sale. We thank you for your interest and participation. MERCHANDISE OFFERED - All items offered for auction will be sold AS IS, WHERE IS, and WITHOUT GUARANTEE. - Although we strive to represent the product accurate, and in most listings even create a video, Listings are for descriptive purposes only. - Bidders are responsible for examining all items and/or requesting condition reports and/or additional photos, and bidding according to their own expertise. - Condition details are offered as a courtesy to bidders, and are opinions only, not statements of fact, and do not imply any warranty concerning condition, or any assumption of liability. The absence of a condition report does not imply that the lot is perfect or free from wear, flaws, or characteristics of age. KD Auctions (Kaylah Designs Inc) is not responsible for errors and/or omissions of condition, although will strive to not omit any details. - All announcements made on the day/evening of the auction supersede any other previously announced or published materials. REGISTRATION and BIDDING - To bid on-line, you must register with Live Auctioneers. - ALL BIDDERS MUST BE REGISTERED AND APPROVED BY 12PM EASTERN STANDARD TIME, SUNDAY, MARCH 8, 2015. - In order to be approved, bidders may be asked to supply KD AUCTIONS (Kaylah Designs Inc.) with valid VISA/MasterCard or American Express information, which includes approval for a $1 authorization on the card for U.S. residents, or a $1,000 authorization for bidders outside the U.S. - Credit card information may be submitted using the secured form can be faxed or emailed to you upon request. - Successful on-line bidders will be notified following the auction and will be provided an invoice and payment details. SALES TAX - MD Residents and buyers who pick up merchandise in person are required to pay MD State Sales Tax (6%) on each sale, unless exempted by law. - If sales tax exempt, you must present us with a valid exemption number. PAYMENT - For successful On-line Bids, full payment via Cash, Approved Check, Credit Card, Wire Transfer, or PayPal is required within two (2) weeks following the auction. - A $20 fee will be assessed on all returned checks. - No item may be removed or will be shipped until full payment has been made.
