CONDITION OF SALE All purchases (including buyer's premium) will be subject to a Nevada State sales tax of 7.1% unless (1) the buyer is an out-of-state resident and the merchandises are being shipped out of Nevada State or (2) the buyer has a valid tax-exempt certificate (an actual resale certificate must be presented and on file with Antique Comfort International Auction). All items are sold "AS IS" and all sales are final! We do our best to describe the item's material, age and condition. Written and oral descriptions are our opinions and should in no way be interpreted as a fact nor a guarantee of any kind as to the authenticity, age, condition and materials. Prospective buyers are strongly advised to examine personally any property in which they are interested, before the auction takes place, to determine its condition, size, and whether or not it has been repaired or restored. Shipping and insurance is the responsibility of the buyer. Purchase is not contingent upon shipping costs. International buyers should note that some countries do not allow the importation of item(s) containing materials made from endangered species. These may include, but not limited to, ivory, coral and tortoise shell. Please be sure to check with relevant import and custom regulations prior to bidding. BID PRICE Each buyer must register with www.LiveAuctioneers.com prior to bidding. The highest bidder on a lot shall be the buyer of the lot. The purchase price shall be the sum of 1) the price at which the item is sold, plus 2) A BUYER'S PREMIUM OF 21% ON THE FIRST $10,000 BID PRICE ON ANY LOT, 20% ON THE AMOUNT BETWEEN $10,001 AND $20,000, AND 18% ON ANY AMOUNT OVER $20,000, plus 3) sales tax unless the purchaser is exempt by law from such taxes. ACCEPTANCE The purchaser is legally liable to pay for the item or pay the difference if we must reoffer and sell the item for a lower price. REGULATION OF BID The Auctioneer shall regulate the bidding and shall be the sole arbiter of any disputes. We reserve the right to withdraw the item being auctioned at any time before the sale and reject a bid from any bidder. ONLINE BIDDING Every effort is made by the auctioneer to execute all bids, including floor, absentee and internet bids. Antique Comfort International Auction (Auction Company) is not responsible for any missed bids. We will not be liable for malfunctions, errors or omissions (hardware, software, electronic, human or otherwise), whether or not due to Auction Company's fault or negligence, resulting in the inaccurate transmittal of bids, the failure to execute bids or any other irregularity. PAYMENT AND PICKUP The invoice must be paid in full within seven days of the ending date of the respective auction. The Auction Company will make shipping arrangements after payment has been cleared. Merchandise picked up may be scheduled by notifying the Auction Company. A storage fee of $10.00 per lot per day will be charged if merchandise is left longer than two weeks. Once storage fees have exceeded the actual purchase price of the item(s), the Auction Company may exercise its right to repossess the item and re-auction. If the property is left longer than 3 ½ (three and a half) weeks, it will be considered abandoned. Items won online cannot be picked up from the Auction Company until the following workday. RISK OF LOSS In the event delivery cannot be made because of loss due to fire, theft, or any other reason, the Auction Company shall only be liable for the return of any deposits or payments made by the purchaser. NO WARRANTY ALL ITEMS SOLD "AS IS AND WHERE IS" THE AUCTION COMPANY, ITS AGENTS AND EMPLOYEES, AND THE CONSIGNOR DO NOT WARRANT ANY LOT TO BE MERCHANTABLE OR TO BE SUITED FOR ANY PURPOSE AND THEY DO NOT ASSUME ANY RISK, LIABILITY OR RESPONSIBILITY FOR ANY PERSON AS TO AUTHENTICITY, GENUINENESS, CULTURE, SOURCE, ORIGIN, ATTRIBUTION, PERIOD, PURPOSE OR MEASUREMENTS OF ANY LOT. THESE CONDITIONS MAY NOT BE ALTERED OR MODIFIED EXCEPT BY AN INSTRUMENT IN WRITING, SIGNED BY AUCTIONEER AND BUYER. Any condition statement is given as a courtesy to a client, is only an opinion and should not be treated as a statement of fact. The Auction Company shall have no responsibility for any error or omission. The absence of a condition statement does not imply that the lot is in perfect condition or completely free from wear and tear, imperfections or the effects of aging. RIGHT OF RESCISSION Notwithstanding the preceding conditions, if within 21 days of the date of sale of any lot, the original purchaser (a) gives notice in writing to us alleging that the identification of Authorship (as defined below) of such lot is not substantially correct based on a fair reading of the catalogue (including the terms of glossary contained therein), and (b) with 10 days after such notice returns the lots to us in the same condition as at the time of sale and (c) establishes the allegation in the notice to our satisfaction then the sale of such lot will be rescinded and the original purchase price refunded. Nothing in this paragraph shall be construed as an admission by us of any representation of fact, express or implied, obligation or responsibility with respect to any lot. The purchaser's sole remedy in the event this paragraph is invoked is as provided herein. Consignor agrees to be bound by our judgment as to Authorship and by our determination regarding rescission. The purchaser expressly acknowledges and agrees that in no event shall we liable for any compensatory, incidental or consequential damages. "Authorship" means only the identity of the creator. The right of rescission does not extend to (a) works executed before 1870 unless these works are determined to be counterfeit, as this is a matter of current scholarly opinion in which can change, (b) titles or other identification of the offered lots or descriptions of physical condition and size, quality, rarity, importance, provenance, exhibition and literature of historical relevance. Although our best judgment is used in attributing paintings, drawings and sculpture created prior to 1870 through the appropriate use of the glossary terms, and due care is taken to ensure the correctness of the supplemental material, the right of rescission does not extend to any possible errors or omissions therein. PAYMENT Cash (In-house only), Cashier's check, Money Order, Wire (Bank) Transfer and personal check (items may be held until the check clears), MasterCard, VISA, American Express and Discover accepted for purchases $25 and over but not for vehicles. MasterCard, VISA and Debit card over the phone will be charged a 3 percent convenience fee. America Express and Discover cards will be charged a 5 percent convenience fee. If any legal action is commenced to enforce these Conditions of Sale, the prevailing party shall be entitled to recover its reasonable attorney's fees and costs. Time is of the essence. SHIPPING Buyer is responsible for all shipping related costs including but not limited to packing and handling fees. Antique Comfort International Auction will arrange for shippers. Items won will be shipped out once the funds have been cleared. International buyers may incur additional custom fees. If the buyer resides outside of Nevada and chooses to pick up item(s) in person or has a friend or family member pick up on his or her behalf, s/he will be charged the local sales tax which is an additional 7.1%. DISPUTE RESOLUTION Any dispute resulting from or arising out of any purchase or consignment related to these Terms and Conditions must be resolved through binding arbitration in Douglas County, Nevada. The results of any arbitration are final and non-appeal-able. Antique Comfort International Auction reserves the right to invoke jurisdiction of a competent court to remedy or prevent violation of any provision. These procedures are the exclusive procedures for the resolution of all such disputes between the parties. INDEMNITY Antique Comfort International Auction will not be subject to indemnification for any claim by a third party arising out of your breach of these Terms and Conditions.
