History of German and Roman Law by Heinecke, where he traces back in the classical sources the origin of both laws, the convergences of customs, and the uses of these jurisprudence in the present and in the past.

The work reports many quotes from Latin and Greek authors, (in original language) and provides the etymology of many terms later entered in the common juridical lexicon.

Johann Gottlieb Heinecke, (Eisenberg, 1681-Halle, 1741; Latinized Eineccius), teacher of philosophy and law at Halle and Frankfurt , was a renown German jurist, follower of the juristic current named «philosophical», connected to the thought of Thomasius and Pufendorf. As opposed to the jurists that believed that jurisprudence was formed by a series of rules, derived from customs, Heinecke considered it as rational science, ascribable to series of principles to be considered during the activities of making laws.

Scarce edition of Heinecke's treatise on ancient and modern Germanic Civil Law . Germanic jurisprudence is considered to have been originated by written and unwritten customs of the barbarian tribes living north of Alps at Roman times. Germanic Laws were described in Germania by Tacito, but also by Julius Caesar, Pomponius Mela and Strabo, that highlighted differences and similarity with the roman customs. Heinecke starts from ancient times, to track back the origins of the national law, following all the evolutions up to his age.
