PLEASE NOTE THAT all bidders at Eastern Yunge Auction acknowledge that they have read and agree these terms and conditions of sale and agree to be bound thereby.
1.Condition of sale
In publishing this catalog, Eastern Yunge Auction has endeavored to accurately described all items being sold but all item being offered is to be sold ?as is?. No statement in this catalog, bill of sale, invoice or elsewhere by any representative of, or person in the employ of Eastern Yunge Auction shall be deemed to be a warranty, representation, or assumption of liability with respect to age, condition, size,quality,variety,provenance,historical relevance of any these items. All measurements and sizes are approximate. Please note that photographs may have size modifications for display purpose, or been trimmed to exclude framing, matting.Variations in color may occur due to digital processing. Any condition statement, written or verbal is given as a courtesy to the client, and these only opinion. It not be treated as a statement of fact. Eastern Yunge Auction shall have no responsibility for any error or omission. The absence of a condition statement is not imply the lot is in perfect conditions or completely free from wear, imperfection and age.
2.Add or withdrawal from sale
The auction house reserves the right to withdraw from sale any of the items listed or to sell at this auction items not listed, and also reserves the right to group one or more lots or to sell at this auction not listed, and also reserves the right to group one or more lots into one or more selling lots. Whenever the best interest of the seller will be served, the auction house reserves the right to sell all of the item listed in bulk.
3.Dispute
The auction house will be final judge as who is the successful bidder. In the event of any dispute, the auction house shall, at our discretion, decide whether or not to reopen the bidding. The auction house has the right at our absolute discretion to refuse any bid.
4.Manner of payment
All lots are to be paid in full by cash in US dollar, Visa,Mastercard, Debit Card, wire transfer, Paypal, certified check or other payment method approved by the auction house, all accounts need to be settled by the end of sale.
5.Buyer?s premium
25% Buyer premium will be charged on purchase price less than $20,000.00;
20% Buyer premium will be charged on purchase price over $20,000.00 but less than $50,000.00;
15% Buyer premium will be charged on purchase price over $50,000.00.
Please note, all payments made by credit card or master card are subject to an additional 3% processing fee.
6.Sales tax
Pursuant to the laws of the Commonwealth of Virginia, all sales, including buyer?s premiums are subject to the collection of a 5.3% sales tax.
7.Shipping
Delivery and storage shall be available at purchaser?s own expense and risk. Eastern Yunge Auction does not provide any shipping. If you need a shipper for shipping, we could provide a recommendation list of local shippers. Please feel free to contact them or make you own arrangements.
8.Agreement to terms
In bidding on any lot here offered, the bidder indicates acceptance of these terms and conditions of sale. Title of each lot passes when the auction house indicates ?sold?, thereafter, any loss by fire, theft, breakage, or any other cause is the sole responsibility of the purchaser. Merchandise must be packed and transported by the purchaser at his/her own risk and expense. If any employee or agent of Eastern Yunge Auction shall pack or transport the merchandise, it is fully at risk,responsibility of the purchaser, Eastern Yunge shall not be liable for any loss or damage that may cause by such employee or agent.
9.Bidder responsibility
All sales are final. The bidder is responsible for knowing on which item he/she is bidding. When becoming the winning bidder at auction, you have affected a contract and will be expected to pay for items in which you were evidenced to be successful bidder. Auction house will not honor ?mistakes?.
10.Additional terms and conditions
Any additional terms or conditions of sale, added by auction house, shall be announced prior to auction.
11.Applicable law
The parties hereto acknowledge that this agreement is made and entered into the laws of the Commonwealth of Virginia and will in all respects be interpreted, enforced and governed under the internal law of the State of Virginia.
