Conditions of Sale 1. La Maison d'Art acts as agent representing the owners of the works for sale. The agent, therefore, neither purchases rights nor does he undertake obligations on his own account. Every responsibility ex articles 1476 and subsequent ones of the civil code, remains with the owners of the works. 2. The lots are sold "as they are" including any faults and defects present when adjudication is made. 3. In order to take part in the auction-based sale procedure it is necessary to register. 4. The sale of the lots shall be concluded in favour of the person presenting the highest bid accepted by the Director of sales or auctioneer. 5. The offerer, together with the formulation of his/her offer, undertakes to pay La Maison d'Art the lot adjudication price as well as the auction commission, taxes and the other charges applicable to the sale and to the commission. 6. The auction commission to be paid to La Maison d'Art by the highest bidder is the following:- - 20 % of the adjudication price. 7. Upon adjudication the buyer shall pay the price, the rights and anything else, either in cash, by bank transfer, money order or credit card. 8. Once payment has been settled, the items sold can be collected by the buyer at his care and risk or they can be sent by express courier service. La Maison d'Art is authorized not to deliver what has been adjudicated if the payment of the amount due has not been paid in full. The shipping and packaging costs shall be borne by the buyer. 9. Failure to comply with the above terms shall entitle La Maision d'Art to demand fulfilment. 10. The auction shall be preceded by an exhibition of the works during which a manager of La Maison d'Art shall be available to respond to any query either in person, by e-mail or phone. The purpose of the exhibition is to give the opportunity to closely examine the state of preservation of the objects and to clarify any errors and/or inaccuracies that may have been made in the catalogue and/or the advertisement. After the adjudication, no complaint will be accepted save for what is provided for in point 11. 11. Any complaint as to the exactness of the attributions indicated in the auction catalogue must be raised by registered letter with acknowledgement of receipt to be sent within and not beyond 15 days from the adjudication date. Should the complaint be found to be groundless upon the documentation that must in any case be produced at the care and expense of the highest bidder, La Maison d'Art's only obligation shall be that of repaying the amounts already received, without interest, against the return of the items adjudicated, without any further compensation obligations on whatever basis. As agent, La Maison d'Art, cannot be held liable for the attributions and expertise relative to the items hammered. 12. During the auction, the director of sales may gather or separate the lots. As agent he/she may perform all the activities necessary to better perform the agency. 13. The item can be collected immediately after the payment has been settled either in cash, by bank transfer, money order or credit card. 14. All work over fifty years old are subject to the relative protection-related regulations. In particular, such works cannot be transported outside the Italian territory without having first obtained the certificate of free circulation by the competent authority. The cost of the issue of the free circulation certificates and/or export license shall be borne by the buyer. Any delay in the release of any licence does not constitute a cause for the resolution, cancellation or nullity of the sale, nor does it justify the delayed payment by the buyer. Should the Italian state forbid exportation, the sale shall be considered null. 15. These regulations are tacitly accepted by all bidders at the auction sale. The participants in the sale declare that any controversy deriving herefrom shall be deferred exclusively to the competence of the Court of Florence thus contextually accepting the exclusive Italian jurisdiction. 16. The buyer declares that ' under art. 23 of law decree No. 196 of 30.06.2003 ' he/she gives his/her consent to the transmission of his/her personal data and also acknowledges receipt of the information as per art. 13 of law decree No. 196 of 30.06.2003. Condizioni di vendita 1. La Maison d'Art agisce in qualita' di mandataria con rappresentanza dei proprietari delle opere poste in vendita; pertanto, non acquista diritti ne' assume obblighi in proprio. Ogni responsabilita' ex artt. 1476 ss. cod. civ. continua a gravare in capo ai proprietari delle opere. 2. I lotti sono venduti nelle "condizioni in cui si trovano" ivi compresi difetti ed imperfezioni presenti al momento dell'aggiudicazione. 3. La preventiva registrazione e' condizione necessaria per la partecipazione alla procedura di vendita mediante asta. 4. La vendita dei lotti si conclude in favore del soggetto che presentera' l'offerta piu' alta accettata dal Direttore di vendita, o banditore. 5. L'offerente, con la formulazione della propria offerta, si impegna a corrispondere a La Maison d'Art il prezzo di aggiudicazione del lotto oltre alla commissione per i diritti d'asta, imposte ed altri oneri applicabili alla vendita ed alla commissione. 6. Le commissioni per i diritti d'asta dovute a La Maison d'Art dall'Aggiudicatario sono le seguenti: - 20 % del prezzo di aggiudicazione. 7. All'atto dell'aggiudicazione l'acquirente dovrà provvedere al pagamento del prezzo, diritti e quant'altro in contanti, bonifico bancario, vaglia postale, carta di credito. 8. Dopo il pagamento gli oggetti venduti possono essere ritirati dall'acquirente a sua cura e rischio o inviati tramite Corriere espresso. La Maison d'Art è autorizzata a non consegnare quanto aggiudicato se prima non si è provveduto all'integrale pagamento di quanto dovuto. I costi della spedizione e dell’imballaggio saranno a carico dell'acquirente. 9. In caso di mancato adempimento nei termini perentori sopra stabiliti sarà facoltà de La Maison d'Art richiedere l'adempimento. 10. L'asta sarà preceduta da un'esposizione delle opere durante la quale un responsabile del La Maison d'Art . sarà a disposizione per ogni chiarimento di persona, tramite e-mail o telefonicamente. L'esposizione ha lo scopo di far bene esaminare lo stato di conservazione e la qualità degli oggetti e chiarire eventuali errori e/o inesattezze in cui si fosse incorsi nella compilazione del catalogo e/o dell’inserzione. Dopo l'aggiudicazione nessuna contestazione in merito potrà pertanto essere accolta, fatto salvo quanto previsto dal punto 11. 11. Eventuali contestazioni circa l'esattezza delle attribuzioni riportate nel catalogo d'asta dovranno essere mosse a mezzo raccomandata con ricevuta di ritorno da inviare entro e non oltre 15 giorni dalla data di aggiudicazione. Se la contestazione risultasse fondata, sulla base della documentazione che in ogni caso dovrà essere prodotta a cura e spese dell'aggiudicatario, La Maison d'Art sarà tenuta esclusivamente al rimborso delle somme già percepite senza interessi, dietro restituzione dei beni aggiudicati, senza alcun ulteriore obbligo di risarcimento a nessun titolo. Infatti La Maison d'Art., nella propria qualità di mandataria, non potrà ritenersi responsabile per le attribuzioni ed expertise relativi ai lotti battuti. 12. Durante la gara il direttore della vendita ha la facoltà di riunire o di separare i lotti. Lo stesso, in qualità di mandatario, potrà compiere tutte quelle attività per il migliore espletamento del mandato. 13. Il ritiro immediato del bene sarà possibile dopo l'effettivo pagamento che dovrà avvenire in contanti, bonifico bancario, vaglia postale, carta di credito. 14. Tutte le opere databili ad oltre cinquanta anni sono soggette alle relative norme di tutela. In particolare, non possono essere trasportate fuori dal territorio italiano senza avere ottenuto il certificato di libera circolazione da parte della competente autorita'. Si precisa che il costo del rilascio degli attestati di libera circolazione e/o licenza di esportazione e' a carico dell'acquirente. Il ritardo nel rilascio di una qualsiasi licenza non costituisce una causa di risoluzione, di annullamento e nullita' della vendita, ne' giustifica il ritardato pagamento da parte dell'acquirente. Nel caso lo Stato italiano ponga il veto all'esportazione la vendita sara' ritenuta nulla. 15. Il presente regolamento viene accettato tacitamente da tutti coloro che concorreranno alla vendita all'asta. I partecipanti alla vendita dichiarano che ogni eventuale controversia derivante dal presente atto sarà deferita in via esclusiva alla cognizione del Foro di Firenze, accettando contestualmente in tal modo l'esclusiva giurisdizione italiana. 16.Il soggetto acquirente dichiara di prestare il proprio espresso consenso ai sensi dell'art. 23 d.lgs. 30.06.2003 n. 196 alla trasmissione dei propri dati personali e dichiara, altresi', di aver ricevuto l'informativa di cui all'art. 13 d.lgs. 30.06.2003 n. 196.
